Reconsidering Prejudice In Alternative Dispute Resolution For Black Work Matters, Michael Z. Green
Reconsidering Prejudice In Alternative Dispute Resolution For Black Work Matters, Michael Z. Green
Faculty Scholarship
In the 1985 foundational article Fairness and Formality: Minimizing the Risk of Prejudice in Alternative Dispute Resolution, Richard Delgado and his co-authors identified major concerns with the growing use of alternative dispute resolution (ADR) to resolve disputes involving people of color. The seminal findings from that article highlighted the power differentials exacerbated by informal dispute resolution, and the article contributed immediately to a surge of robust critiques of the increasing use of alternative dispute resolution for those most vulnerable in our society.
More than thirty years after the Delgado article, a community of respected and prominent ADR and discrimination scholars, …

Weapon-Involved Violence And Mental Illness: An Empirical Examination Of The Policy Assumptions For Firearm And Other Dangerous Weapon Prohibitions, Heath J. Hodges
Department of Psychology: Dissertations, Theses, and Student Research
High-profile incidents of weapon-involved violence have galvanized public outrage, legislative proposals, and executive orders concerning individuals with mental illness and weapon access, particularly firearms. A review of public surveys and policy polls reveals multiple assumptions about the relationship between mental illness and violence, which have informed firearm prohibitions aimed at the mentally ill. However, few of these assumptions have been empirically investigated. With community (n = 154) and forensic psychiatric samples (n = 80), this study utilized a series of questionnaires to assess policy opinions, psychopathic traits, experiences with firearms, and perpetration rates for weapon-involved violence. Mental health …

Third-Person Perceptions, Hostile Media Effects, And Policing: Developing A Theoretical Framework For Assessing The Ferguson Effect, Justin Nix, Justin T. Pickett

Objectives
Policing in the United States has come under intense scrutiny following numerous deadly force incidents involving unarmed black citizens, which dominated the news media. Some have argued that consequently, a “chill wind” has blown through law enforcement, such that officers have become more distrustful of civilians, fearful of scandal, and are de-policing. To date, however, scholars have given insufficient theoretical and empirical attention to why and how media coverage of policing may lead to such outcomes.
Methods
We addressed this literature gap using data from a survey of officers in a metropolitan police department in the southeast.

So Made That I Cannot Believe: The Iccpr And The Protection Of Non-Religious Expression In Predominantly Religious Countries, Devin Carpenter
So Made That I Cannot Believe: The Iccpr And The Protection Of Non-Religious Expression In Predominantly Religious Countries, Devin Carpenter
Chicago Journal of International Law
The International Covenant on Civil and Political Rights (ICCPR) protects minorities’ rights of conscience and expression. The related jurisprudence, however, has yet to fully develop protections for the expression of non-religious minorities in predominately religious countries. Especially in the context of a violent reaction to non-religious expression and the reaction’s relation to the ICCPR’s prohibition of incitement, the jurisprudence needs clarification. This Comment provides a framework to do just that, while strengthening protections for non-religious minorities and staying faithful to the ICCPR’s text and Human Rights Committee (HRC) precedent. It focuses on Articles 18 and 19, which guarantee the freedom …

Active Calculus Multivariable, Steven Schlicker, David Austin, Matthew Boelkins
Open Textbooks
Active Calculus Multivariable is the continuation of Active Calculus to multivariable functions. Cyber!, Andrea M. Matwyshyn
Cyber!, Andrea M. Matwyshyn
BYU Law Review
This Article challenges the basic assumptions of the emerging legal area of “cyber” or “cybersecurity.” It argues that the two dominant “cybersecurity” paradigms—information sharing and deterrence—fail to recognize that corporate information security and national “cybersecurity” concerns are inextricable. This problem of “reciprocal security vulnerability” means that in practice our current legal paradigms channel us in suboptimal directions. Drawing insights from the work of philosopher of science Michael Polanyi, this Article identifies three flaws that pervade the academic and policy analysis of security, exacerbating the problem of reciprocal security vulnerability—privacy conflation, incommensurability, and internet exceptionalism. It then offers a new paradigm—reciprocal …
