Finality Is Not The Last Word, Bidish Sarma

Akron Law Review

Finality has long been upheld as a powerful governmental interest in the context of criminal adjudications. However, its nearly mythic status in our law belies its ongoing utility. Rather than fulfilling its historical goals of preserving resources and focusing incarcerated individuals on the task of rehabilitation, finality today undermines focus, facilitating mass incarceration and perpetual punishment. We are not required to accept finality as the last word; instead, we can and should interrogate its value in light of the system we have built.

Exploring Concerns About Discretion And Disparity In Second Look Sentencing, Douglas A. Berman

This essay explores the emergence of “second look” sentencing laws in the United States, which allow judicial review of previously imposed prison sentences under certain circumstances. Highlighting the expansion of these laws, the essay examines the broad discretion granted to judges and prosecutors in deciding when and how to reduce prison sentences against the backdrop of an earlier era of structured sentencing reforms aimed at regulating sentencing discretion and reducing disparities. Somewhat ironically, the rigidity and severity of some structured sentencing reforms have contributed to modern mass incarceration to engender the emerging “second look” sentencing movement.

Urban populations continue to rise and the frequency that pedestrians are exposed to vehicular traffic continues to increase. The result is an increase in automobile versus pedestrian collisions. This study aims to determine the efficacy of pedestrian bridges in reducing the rates of automobile-pedestrian collisions. Data for all automobile versus pedestrian collisions and injuries from July of 1997 through December of 2023 at four distinct intersections along Las Vegas Boulevard were retrieved from the Nevada Department of Transportation. The National Water Model (NWM) provides operational streamflow forecasts for 2.7 million stream reaches across the continental United States, yet technical barriers prevent widespread public access to this hydrological infrastructure. This paper presents RIVR (River Information Visualization and Risk), a cross-platform mobile application that transforms National Water Model forecasts into an accessible interface for non-technical users. Built with Flutter, the application deploys to iOS and Android from a single codebase and integrates NOAA forecast APIs, CIROH return-period thresholds, and interactive vector-tile mapping. To improve traffic safety, communities first need to know where serious crashes are actually happening. High-Injury Networks are designed to identify these locations, but they are usually built using only police-reported crash data. This research asks: Are we missing crashes—and injuries—by relying on police data alone? The research team first demonstrates that data from Emergency Medical Services and those from official databases differ substantially, and neither data set captures the full extent of collisions in a community. Forest fire and climate change are reshaping the snow hydrology of the Pacific Northwest of the United States, yet the combined effects of these disturbances on snow accumulation, storage, and melt timing remain poorly quantified in these Mediterranean mountain watersheds. This study integrates field-based snow and radiation observations with physically based modelling to evaluate how postfire forest structure, postfire snow albedo decay, and future climate change influence snow-water storage in the Breitenbush watershed of the western Oregon Cascades. Freedom House estimates that 75% of the world’s population lives in countries that experienced a democratic decline in 2020. Even in long established democracies, liberal democratic values have been shaken. 310 Prolific participants viewed eight AI-generated images of men who appeared to be Asian, Hispanic, Black, or White who were "suspects in an ongoing investigation." Participants viewed one of the two targets for each ethnic group, one with an arm tattoo and one without. Participants rated each target on characteristics such as intelligence, competency, and trustworthiness, and rated how likely they think it was that the target was the perpetrator. Men without a tattoo were rated more positively than those with a tattoo across all four racial/ethnic groups. Hispanic men, with or without a tattoo, were rated the most negatively. …

Public sector agencies are rapidly adopting AI systems to make critical decisions that span across services such as benefits eligibility, housing and homelessness services, child welfare services, mobility, inspections, and more. The purpose of this research is to investigate how methamphetamine use in Mississippi, especially in its rural areas, intersects with public health, policy, and suicide outcomes in the state. Mississippi's methamphetamine crisis has evolved significantly, shifting from locally produced drugs to cartel-supplied crystal methamphetamine, while state and federal policies have struggled to keep pace with the scale and complexity of the problem. Amicus curiae brief submitted by the American Immigration Lawyers Association and immigration law scholars in support of the respondents in Mullin v. Doe and Trump v. Miot before the Supreme Court of the United States. The brief argues that the Temporary Protected Status (TPS) statute strictly limits the Executive Branch's authority to terminate TPS designations and requires continuation of protection unless the statutory conditions justifying designation no longer exist. The amici further contend that TPS serves a critical humanitarian function by protecting individuals from removal, detention, and loss of work authorization while conditions in designated countries remain unsafe.

Driver rehabilitation is an underrepresented specialization within occupational therapy despite its critical role in supporting individuals with physical, cognitive, or visual impairments to drive safely and maintain community mobility. The literature reveals limited inclusion of driver rehabilitation in OT curricula, minimal fieldwork exposure, and scarce driver rehabilitation programs, resulting in fewer certified specialists. Barriers to program development include insufficient funding, lack of institutional support, and limited equipment access. Consequently, new graduates lack knowledge, confidence, and competence in this specialty area, reducing service availability for clients who rely on driving for independence and participation. Effective incident management is a cornerstone of transportation system performance, influencing roadway clearance times (RCTs) and the risk of secondary crashes. This study investigated how towing regulations involving large commercial vehicle crashes and jurisdictional variations affect the management of large-vehicle crashes, focusing on the relationship between regulatory frameworks, incident duration, and secondary crash occurrence with the state of Tennessee as a case study. Pre-adjudication detention involves confining juveniles while they await a hearing, aimed at ensuring court appearance and upholding public safety. However, the use of pre-adjudication detention has expanded significantly, which has raised concerns regarding the impact on juvenile justice outcomes. This study reviews established peer-reviewed research and observational data from internships to evaluate how this type of detention influences legal outcomes and juvenile development. The research findings demonstrate that detention is associated with harsher dispositions, higher recidivism rates, and long-term consequences. For example, a 38% reduction in high school graduation rates is attributed to pre-adjudication detention. Research has also shown that …

A lesser-known area of law in Idaho concerns the involuntary civil commitment process, a process by which thousands of people per year are committed to hospitals around the state.
