Cyber!, Andrea M. Matwyshyn
Cyber!, Andrea M. Matwyshyn
BYU Law Review
This Article challenges the basic assumptions of the emerging legal area of “cyber” or “cybersecurity.” It argues that the two dominant “cybersecurity” paradigms—information sharing and deterrence—fail to recognize that corporate information security and national “cybersecurity” concerns are inextricable. This problem of “reciprocal security vulnerability” means that in practice our current legal paradigms channel us in suboptimal directions. Drawing insights from the work of philosopher of science Michael Polanyi, this Article identifies three flaws that pervade the academic and policy analysis of security, exacerbating the problem of reciprocal security vulnerability—privacy conflation, incommensurability, and internet exceptionalism. It then offers a new paradigm—reciprocal …
Beyond The War: The Evolving Nature Of The U.S. Approach To Drugs, Don Stemen
Beyond The War: The Evolving Nature Of The U.S. Approach To Drugs, Don Stemen
Criminal Justice & Criminology: Faculty Publications & Other Works
Over the last forty years, perhaps no issue has affected the United States’s criminal justice system as profoundly as has drug policy. Since President Nixon declared drug abuse “America’s public enemy number one,”1 concerns about the manufacture, distribution, and possession of drugs have remained at the fore of criminal justice policy discussions.2 President Reagan’s subsequent pronouncement of drugs as “an especially vicious virus of crime” set a course for national drug policy that emphasized enforcement and punishment over treatment to “win the war on drugs.”3 Throughout the 1980s, increasing public concern about the effects of drug abuse4 further pressured policymakers …
Development Of An Optimal Controller And Validation Test Stand For Fuel Efficient Engine Operation, Jack G. Rehn Iii
Development Of An Optimal Controller And Validation Test Stand For Fuel Efficient Engine Operation, Jack G. Rehn Iii
Master's Theses (2009 -)
There are numerous motivations for improvements in automotive fuel efficiency. As concerns over the environment grow at a rate unmatched by hybrid and electric automotive technologies, the need for reductions in fuel consumed by current road vehicles has never been more present. Studies have shown that a major cause of poor fuel consumption in automobiles is improper driving behavior, which cannot be mitigated by purely technological means. The emergence of autonomous driving technologies has provided an opportunity to alleviate this inefficiency by removing the necessity of a driver. Before autonomous technology can be relied upon to reduce gasoline consumption on …

Rethinking Pilgrimage Routes Within The Context Of Safe Environments, Carlos Fernandes, Goretti Silva, Martín Gómez-Ullate
International Religious Tourism and Pilgrimage Conferences
Safety and security are complex, multidimensional concepts, that have undergone a significant change and are active elements of tourism, with a wide range of components belonging to it: political security, public safety, health and sanitation, personal data safety, legal protection of tourists, consumer protection, safety in communication, disaster protection, environmental security, getting authentic information, quality assurance of services etc. (Hall et al, 2009). Studying problems of safety and security has become vital for the tourism industry as it needs to understand what are the main factors influencing the perception of safety, the key elements that are treated as belonging to …

Death Row Dogs, Hard Time Prisoners, And Creative Rehabilitation Strategies: Prisoner-Dog Training Programs, Paul J. Larkin, Jr.
Death Row Dogs, Hard Time Prisoners, And Creative Rehabilitation Strategies: Prisoner-Dog Training Programs, Paul J. Larkin, Jr.
Catholic University Law Review
More and more prisons have witnessed the success of Prisoner-Dog Training Programs (PDPs) in the last few years. PDPs entail a prisoner training an animal (usually a dog) to be a service animal for the disabled or a well-behaved household pet. PDPs at state and federal prisons have turned out to be a win-win-win. The animals involved in the program are typically those at risk of being euthanized, giving those animals a second chance at life; the community benefits because people adopt well-behaved and trained animals; and the prisoner-trainers learn what it means to contribute to society in a material …
Miranda’S Near Death Experience: Reflections On The Occasion Of Miranda’S Fiftieth Anniversary, Eugene R. Milhizer
Miranda’S Near Death Experience: Reflections On The Occasion Of Miranda’S Fiftieth Anniversary, Eugene R. Milhizer
Catholic University Law Review
Miranda v. Arizona is widely regarded as one of the most controversial Supreme Court decisions in U.S. history. Shortly after the case was decided, Gallop Polls indicated that 63% of the public felt the Supreme Court was too soft on criminals. But despite its controversy, Miranda has become so widely accepted in popular culture that most people cannot imagine a criminal justice system without it. This wide spread acceptance, however, is more of a recent phenomenon in the landmark case’s history.
This article discusses Miranda’s tumultuous past; its harsh criticism from the legal community, academics, and the public at …

The Papal Encyclical Laudato Si’, Ann-Marie Kennedy, Nicholas J. C. Santos, S.J.
The Papal Encyclical Laudato Si’, Ann-Marie Kennedy, Nicholas J. C. Santos, S.J.
Journal of Management for Global Sustainability
This article seeks to reflect upon Laudato Si’, the papal encyclical on ecology and sustainable development, and uncover its apparent philosophical and practical approach to the environment. It begins with a discussion of paradigms of thought that outline the new ecological paradigm (NEP) suggested in the ecological literature, thereby helping to situate the ecosophy of Laudato Si’ within current thought. As we will show, Laudato Si’ differs from the NEP by linking the poor to our approach to sustainability and in its consideration of integral ecology. Specific principles for sustainability in business are then identified and strategic approaches are recommended, …

Nevada Supreme Court Summaries
The Nevada Parole Board can deny parole for any reason authorized by regulation or statute. However, inmates do have a statutory right to have a parole hearing under NRS 213.140(1). Therefore, in limited cases where the Nevada Parole Board clearly misapplied its own internal guidelines in assessing whether to grant parole to an inmate, a new parole hearing is warranted.

A Case Study Analysis Of The “Letter From Birmingham Jail”: Conceptualizing The Conscience Of King Through The Lens Of Paulo Freire, Tremaine T. Sails-Dunbar
A Case Study Analysis Of The “Letter From Birmingham Jail”: Conceptualizing The Conscience Of King Through The Lens Of Paulo Freire, Tremaine T. Sails-Dunbar
Pursuit - The Journal of Undergraduate Research at The University of Tennessee
The pedagogical qualities of Martin King’s “Letter from Birmingham Jail” can be observed through the lens of Paulo Freire as his illustration of thematic universe’s can be used as a framework to contextualize the conscience of King. King encountered obstacles, in his contemporary context, to his self-actualization that once cognitively subjugated were transformative to his being. Three questions are explored: What manifestations led to the writing of the “Letter from Birmingham Jail”? What were King’s transformative actions? Will an answer to the first help make sense of the second? I endeavor to briefly examine the “Letter from Birmingham Jail” through …
Surveillance By Algorithm: The Nsa, Computerized Intelligence Collection, And Human Rights, Peter Margulies
Surveillance By Algorithm: The Nsa, Computerized Intelligence Collection, And Human Rights, Peter Margulies
Florida Law Review
ISIS’s cultivation of social media has reinforced states’ interest in using automated surveillance. However, automated surveillance using artificial intelligence (“machine learning”) techniques has also sharpened privacy concerns that have been acute since Edward Snowden’s disclosures. This Article examines machine-based surveillance by the NSA and other intelligence agencies through the prism of international human rights.
Two camps have clashed on the human rights implications of machine surveillance abroad. The state-centric camp argues that human rights agreements like the International Covenant on Civil and Political Rights (ICCPR) do not apply extraterritorially. Moreover, the state-centric camp insists, machine surveillance is inherently unintrusive, like …
Motivating Constitutional Compliance, Erica Hashimoto
Motivating Constitutional Compliance, Erica Hashimoto
Florida Law Review
Some constitutional rights of criminal defendants lend themselves to systematic violations at the trial level. In particular, state officials may gravitate toward such violations when (1) the nature of the relevant right renders violations difficult to detect at the trial level, and (2) constitutional compliance imposes especially high costs. For rights with those two characteristics, a trial-level remedy may not adequately protect the right, and a robust appellate remedy may be necessary to provide an adequate incentive for constitutional compliance. But because the Court has not considered the importance of deterring constitutional violations outside of the exclusionary rule context, it …

Creating A Crisis Communication Plan For Small Or Mid-Sized Community Colleges With Monroe County Community College As The Model, Verkennes Joe
Master of Arts in Media and Communication Plan II Graduate Projects
Community colleges need to develop crisis communication plans to protect themselves from the ramifications of crises. While colleges and universities have been diligent about ensuring that they have crisis management plans in place, the same cannot be said for crisis communication plans. The effects of crises on the reputations, operations, and finances of community colleges can include losses of enrollment, decreases in donations, reductions in government funding, accreditation issues, and the severing of key partnerships. This is because crises can negatively impact organizational reputations, which are widely recognized as valuable, intangible assets. Having a solid crisis communication plan can help …

Cyber Security For Everyone: An Introductory Course For Non-Technical Majors, Marc J. Dupuis
Cyber Security For Everyone: An Introductory Course For Non-Technical Majors, Marc J. Dupuis
Journal of Cybersecurity Education, Research and Practice
In this paper, we describe the need for and development of an introductory cyber security course. The course was designed for non-technical majors with the goal of increasing cyber security hygiene for an important segment of the population—college undergraduates. While the need for degree programs that focus on educating and training individuals for occupations in the ever-growing cyber security field is critically important, the need for improved cyber security hygiene from the average everyday person is of equal importance. This paper discusses the approach used, curriculum developed, results from two runs of the course, and frames the overall structure of …

A Knowledge Graph Framework For Detecting Traffic Events Using Stationary Cameras, Roopteja Muppalla, Sarasi Lalithsena, Tanvi Banerjee, Amit Sheth
Kno.e.sis Publications
With the rapid increase in urban development, it is critical to utilize dynamic sensor streams for traffic understanding, especially in larger cities where route planning or infrastructure planning is more critical. This creates a strong need to understand traffic patterns using ubiquitous sensors to allow city officials to be better informed when planning urban construction and to provide an understanding of the traffic dynamics in the city. In this study, we propose our framework ITSKG (Imagery-based Traffic Sensing Knowledge Graph) which utilizes the stationary traffic camera information as sensors to understand the traffic patterns. The proposed system extracts image-based features …
Ecofeminism: The Path Towards Healing The Earth, Jamie Thompson
Ecofeminism: The Path Towards Healing The Earth, Jamie Thompson
Dialogue & Nexus
The concept of the patriarchy, or any concept in which one group dominates another, is inseparable from the formation of human kind’s domination of nature. This domination of nature has led to the current the ecological crisis humanity faces. Those who deny climate change can admit to the massive amounts of pollution, trash, and deforestation. Despite this worsening economic crisis, those in power have been slow to react. Women can ultimately provide and lead the movement to solve this ecological crisis through the growing movement of Ecofeminism. In the philosophy of Ecofeminism, individuals recognize and reject western dualistic thinking that …
