Command-Level Police Officers’ Perceptions Of The “War On Cops” And De-Policing, Justin Nix, Scott E. Wolfe, Bradley A. Campbell Jul 2017

Command-Level Police Officers’ Perceptions Of The “War On Cops” And De-Policing, Justin Nix, Scott E. Wolfe, Bradley A. Campbell

Criminology and Criminal Justice Faculty Publications

Policing has been the subject of intense public scrutiny for the better part of two years after several high-profile police killings of unarmed African Americans across the United States. The scrutiny has been so extreme that some contend there is currently a “war on cops”—whereby citizens are emboldened by protests and negative media coverage of the police, and are lashing out by assaulting police officers more frequently. In response, it is argued that officers are de-policing (i.e. avoiding proactive stops). We surveyed command-level police officers from a southeastern state about their attitudes concerning the war on cops and de-policing. The …

Constructing The 'Addict': A Discourse Analysis Of National Newspapers Concerning North America's First Supervised Injection Site, Katie Sills Jul 2017

Constructing The 'Addict': A Discourse Analysis Of National Newspapers Concerning North America's First Supervised Injection Site, Katie Sills

Social Justice and Community Engagement

Safe injection sites provide injection drug users with a safe space to inject drugs with clean supplies under the supervision of medical professionals. This study centres on a discursive analysis of newspaper representations of Insite, North America’s first supervised injection site, located in the Downtown Eastside of Vancouver, British Columbia, Canada. Insite opened in 2003 under an exemption from the Controlled Drugs and Substances Act and has provided benefits to its clients through a reduction in public injections, decreased spread of infectious disease, and by providing clients with referrals to other community and social services. Despite these accomplishments the Canadian …

Long-Term Management And Condition Assessment Of Concrete Culvert, Zhenting Zou Jul 2017

Long-Term Management And Condition Assessment Of Concrete Culvert, Zhenting Zou

Dissertations

Infrastructure is the backbone of national security, economic growth, public safety and other aspects of the society. Nationwide, the condition of America’s infrastructure was graded as “D+” by the American Society of Civil Engineers (ASCE) in 2013.

Owners and responsible agencies have employed various cost-effective maintenance and repair methods as well as analytical tools to repair and extend the service life of the infrastructure. However, without a long-term plan, maintenance work can be delayed by lack of funds. Maintenance delay may cause significant reduction in condition state leading to premature failure of the infrastructure. Consequently, a long-term rehabilitation plan is …

Is The "Act Of God" Dead?, Clifford J. Villa Jul 2017

Is The "Act Of God" Dead?, Clifford J. Villa

Faculty Scholarship

In more than twenty years with the U.S. Environmental Protection Agency (EPA) before joining the legal academy, I saw many communities affected by fires, floods, hurricanes, earthquakes, and other natural disasters. However, I never saw a case where the act of God defense prevailed against environmental liability. Confirming this personal experience, I later learned that the number of reported cases where the act of God defense had prevailed against environmental liability, under all statutes and all federal circuits, was also exactly zero.

This raises two obvious questions: (1) why does the act of God defense so often fail? and (2) …

The Impact Of Csr Efforts On Firm Performance In The Energy Sector, Robert Lloyd Jul 2017

The Impact Of Csr Efforts On Firm Performance In The Energy Sector, Robert Lloyd

Doctor of Business Administration (DBA)

The purpose of this research was to investigate the relationship between Corporate Social Responsibility (CSR) and the financial performance for publicly-traded firms operating in the energy sector. The energy sector has a unique role to play in global CSR efforts because of the size of the firms within that industry, their impact on the environment, and the operational risks that come with energy production. Previous research has been conducted on the relationship between CSR engagement and financial performance in various contexts, but this research has shown mixed outcomes – in some cases there is a positive relationship between CSR and …

Flood Plan Management: An Evaluation Of Nebraska’S Comprehensive Plans For Flooding, Rashad J. Moxey Jul 2017

Flood Plan Management: An Evaluation Of Nebraska’S Comprehensive Plans For Flooding, Rashad J. Moxey

Community and Regional Planning Program: Professional Projects

This study examined Comprehensive Plans for 53 Nebraska communities to determine how well 60 indicators of flood risk information were incorporated. The indicators were divided into three categories, factual base information, goals and actions and implementation. The majority of plans were created by independent firms as Nebraska does not require state-level oversight. Detailed review of each community plan identified general areas of weakness and opportunities for improvement. The average number of indicators present in the 53 plans was 4.84. None of the three categories was found to be well represented. Indicators per category showed low overall representation; Factual Base 12.0%, …

Mesonets: Mesoscale Weather And Climate Observations For The United States, Rezaul Mahmood, Ryan Boyles, Kevin Brinson, Christopher Fiebrich, Stuart Foster, Ken Hubbard, David Robinson, Jeff Andresen, Dan Leathers

High Plains Regional Climate Center: Staff Publications

Mesoscale in situ meteorological observations are essential for better understanding and forecasting the weather and climate and to aid in decision-making by a myriad of stakeholder communities. They include, for example, state environmental and emergency management agencies, the commercial sector, media, agriculture, and the general public. Over the last three decades, a number of mesoscale weather and climate observation networks have become operational. These networks are known as mesonets. Most are operated by universities and receive different levels of funding. It is important to communicate the current status and critical roles the mesonets play. Most mesonets collect standard meteorological data …

Justice Scalia, Implied Rights Of Action, And Historical Practice, Anthony J. Bellia Jul 2017

Justice Scalia, Implied Rights Of Action, And Historical Practice, Anthony J. Bellia

Notre Dame Law Review

This Essay examines a specific area that Justice Scalia influenced through the methods of interpretation that he applied—namely, the question of “implied rights of action.”

The idea that federal courts historically applied common law causes of action to remedy federal statutory violations without congressional authorization is a myth. From the first, federal courts heard only those causes of action that Congress had authorized them to hear. And there is reason to think that early federal courts would not have been understood to have power to define their own causes of action had Congress not provided this authorization from the start. …

The More? Uniform Code Of Military Justice (And A Practical Way To Make It Better), Sean Patrick Flynn

Notre Dame Law Review

This Note offers suggestions for the successful transition of the military sentencing system, in light of the responses to the federal sentencing system. It goes on to argue that ,because sentencing guidelines are detrimental to the defendant, the military sentencing process should offer a guaranteed, but waivable, two days of preparation to the defendant post-conviction and presentencing.

Pushing The Limits: Reining In Ohio's Residency Restrictions For Sex Offenders, Taurean J. Shattuck Jul 2017

Pushing The Limits: Reining In Ohio's Residency Restrictions For Sex Offenders, Taurean J. Shattuck

Cleveland State Law Review

The danger to children posed by convicted sex offenders living near schools, parks, and bus stops has been greatly exaggerated by the media. In turn, many state legislatures have attempted to find solutions to this perceived problem, imposing sanctions that seem to keep the "problem" at bay. A relatively new approach prevents those convicted of sex crimes from living within a certain distance of places where children congregate. Ohio is one of the states that has adopted this approach. The problem with this approach, however, is that imposing such restrictions on all individuals convicted of certain crimes imposes barriers to …

The Fort Mcmurray Wildfire 2016: Risk Perceptions And Behaviours Among Evacuees, Christopher James Kearns

Dissertations

The devastating wildfires in the Fort McMurray, Alberta, region in May of 2016 forced the evacuation of almost 90,000 people from their homes. This study examines and compares risk perceptions and evacuation behaviours between young adults, 18 to 24 years of age and older adults, 25 years and older, and between genders. The study participants (n = 299) were students and staff at Keyano College in Fort McMurray. They indicated only slight differences in their perceptions of risk and their evacuation behaviours between both the age groups and by gender. Environmental cues were significant indicators of risk for all participants. …

What Prohibition Teaches About Guns And Abortion: How Alcohol Can Save Individual Rights, Jesse D.H. Snyder

UC Law SF Journal on Gender and Justice

The Supreme Court has made numerous decisions regarding the constitutionality of abortion and gun ownership. Both highly cherished individual rights are systematically and consistently litigated. This article will explore how the documented history of Prohibition can be used to save both abortion and gun rights by examining how individual rights impact society as a whole. In addition, this article will examine the impact a oncerecognized right has when it is no longer in place. Prohibition can be used as a mechanism to ensure ongoing protections of these cherished individual rights.

The Dual Role Of State Attorneys General In American Federalism: Conflict And Cooperation In An Era Of Partisan Polarization, Paul Nolette Jul 2017

The Dual Role Of State Attorneys General In American Federalism: Conflict And Cooperation In An Era Of Partisan Polarization, Paul Nolette

Political Science Faculty Research and Publications

A key development during the Obama Administration was the increasing importance of state attorneys general (AGs) in national policymaking. This article examines the dual role that AGs played during the Obama years. The first role was highly contentious, with Republican AGs leading several multistate challenges to Obama Administration priorities and successfully limiting President Obama’s policy legacy. The second role was more cooperative, involving increasing coordination between AGs and their federal counterparts in national enforcement efforts. Relying on case studies in the areas of immigration enforcement, climate change regulation, and the oversight of for-profit higher education, this article highlights several crucial …
