In order to ensure the same criteria was being applied across the board, the Librarians at Fanshawe College developed an eResource Selection Priority Matrix. This presentation discusses the creation process and implementation of this matrix, as well as lessons learned during the process.

Nevada Supreme Court Summaries

The Nevada Supreme Court held that the juvenile court properly certified a juvenile as an adult because the seriousness of his offense and his prior adjudications outweighed the subjective factors in Seven Minors. Additionally, the Court held that a court’s certification of cognitively impaired juveniles for adult proceedings does not offend the Eighth Amendment.

Injustice Under Law: Perpetuating And Criminalizing Poverty Through The Courts, Judge Lisa Foster May 2017

Injustice Under Law: Perpetuating And Criminalizing Poverty Through The Courts, Judge Lisa Foster

Georgia State University Law Review

Money matters in the justice system. If you can afford to purchase your freedom pretrial, if you can afford to immediately pay fines and fees for minor traffic offenses and municipal code violations, if you can afford to hire an attorney, your experience of the justice system both procedurally and substantively will be qualitatively different than the experience of someone who is poor. More disturbingly, through a variety of policies and practices—some of them blatantly unconstitutional—our courts are perpetuating and criminalizing poverty. And when we talk about poverty in the United States, we are still talking about race, ethnicity, and …

A Promise Unfulfilled: Challenges To Georgia’S Death Penalty Statute Post-Furman, William Cody Newsome May 2017

A Promise Unfulfilled: Challenges To Georgia’S Death Penalty Statute Post-Furman, William Cody Newsome

Georgia State University Law Review

In Furman v. Georgia, the U.S. Supreme Court agreed with Furman’s counsel. Three Justices agreed that Georgia law, as applied, was arbitrary and potentially discriminatory. Moreover, one Justice challenged the value of the death penalty and doubted it served any of the alleged purposes for which it was employed.

Although many challenges subsequent to Furman have been raised and arguably resolved by the Court, the underlying challenges raised by Furman appear to remain prevalent with the Court. Justice Breyer recently echoed the concurring opinions of Furman in his dissenting opinion from Glossip v. Gross, when he stated: “In …

The Influence Of Age, Work Experience, Education Level, And Score On A Standardized Pre-Employment Competency Exam On The Outcome Of A Pre-Employment Polygraph Exam, David M. Torres

Seton Hall University Dissertations and Theses (ETDs)

This study examined the influence of age, work experience, education level, and score on a standardized pre-employment competency exam on the outcome of a pre-employment polygraph exam. Due to the strict selection requirements and competitive nature of sensitive government and public safety positions, organizations compete in the costly endeavor to hire qualified applicants efficiently and effectively. As these organizations fail to meet the required hiring levels, their responsibilities in public and national security cannot be carried out. This study was conducted in an effort to reduce the time and financial resources an organization must appropriate on applicants that cannot successfully …

Following The Spirit Of The Law: Col. Eberhard P. Deutsch And The Legal Division Of United States Forces Austria, 1945-1946, Peter J. Casey

LSU New Orleans Theses and Dissertations

As World War II neared its end in Europe, the Allied powers faced a difficult situation with the occupied nation of Austria. Considering the complicated Austrian relationship with Nazism, the Allies had to decide how the nation would be liberated, occupied, and rehabilitated. Almost instantaneously, the United States, Great Britain, and France became at odds with a vengeful Soviet Union seeking to build a defensive shield of Communist European client states that included Austria. This study will show that as the head of the American Legal Division, Col. Eberhard P. Deutsch, United States Army, was instrumental in the reformation of …

The Rise Of The Maquiladoras And Crimes In Mexico, Christelle K. Bamona May 2017

The Rise Of The Maquiladoras And Crimes In Mexico, Christelle K. Bamona

Master's Theses

While it is generally argued that a stronger labor market is negatively associated with crime, there exists a “consensus of doubt” around the relationship between employment and crime. This paper examines the impact of the rise of female labor participation in manufacturing on various types of crimes in Mexico from 1998 to 2012. A fixed effects specification and an instrumental variable approach with regional and time fixed effects are employed to compare the crime rates in municipalities that were heavily exposed to local factory openings to municipalities that did not receive a labor shock of the same magnitude. By introducing …

This Hazard Communication Program (HCP) will be used to make our employees more aware of the safety and health hazards associated with chemical substances produced, used, or transported through our facilities. This HCP is complimentary to the Chemical Hygiene Plan and will apply to all facilities that are not chemical research laboratories, including, but not limited to maintenance, security, custodial …

Better Alternatives For Youth: Peace, Education And Human Rights, Abraham Jones May 2017

Better Alternatives For Youth: Peace, Education And Human Rights, Abraham Jones

Master's Theses

Many urban youth in the United States live in what are identified as high stress neighborhoods, where trauma is a normative reality within which common life themes permeate. Colloquially, the communities in these high stress areas reclaim space by naming them as hoods, barrios and ghettos. However, depending on one’s perception, these words can have a negative connotation. Even when these communities hold various forms of community cultural wealth and capital, urban narratives are often dominated by false common perceptions that associate these spaces with the violence that occurs within them. There is a need for spaces that produce counter …

Analysis On The Impact Of Driving Under The Influence In Inland Empire, California, Roger J. Chin

OSRI Journal of Student Research and Innovation

Drunk driving is an issue that directly and indirectly affects everyone in society. According to the National Highway Traffic Safety Administration, in 2010 there were approximately 2,715 driving fatalities involving alcohol or drugs in the state of California. In those 2,715 fatalities, 1,848 involved alcohol (“California Counties,” 2011). The Role Of The Prison-Industrial Complex In Demilitarization, Corporate Outsourcing, & Immigration Policy, Shellie Anna Shimmel May 2017

The Role Of The Prison-Industrial Complex In Demilitarization, Corporate Outsourcing, & Immigration Policy, Shellie Anna Shimmel

OSRI Journal of Student Research and Innovation

The traditional system of justice in the United States, based on the goals of retribution, incapacitation, rehabilitation, deterrence, and restitution, has been replaced with a corporate model of mass punishment based on profits, expediency, and the exploitation of free labor. This corporation is known as the “Prison- Industrial Complex,” and is made up of an enormous, interweaving system of correctional institutions, profit-driven corporations, and politicians (Davis, 1998; Schlosser, 1998). Some question whether the creators of the Prison-Industrial Complex could have predicted or anticipated the outcome of their actions (Reinarman & Levine, 2004). I will show their actions were in fact …

Colleges May Take Blame For Government Actions., Aldemaro Romero Jr.

Publications and Research

In the last few weeks a number of news events have taken place that may not have been very noticeable, but which can seriously affect higher education in a very detrimental way.

The first event was the publication of the results of a survey conducted by New America, a non-partisan think-tank based in Washington, D.C. The poll surveyed 1,600 people and found that the American public is becoming more and more ambivalent about the value of higher education. Three-quarters of the respondents agreed that it is easier to be successful with a college degree, but one-quarter said higher education is …
