From The Oppressed To The Terrorist: Muslim-American Women In The Crosshairs Of Intersectionality, Sahar F. Aziz Jan 2012

From The Oppressed To The Terrorist: Muslim-American Women In The Crosshairs Of Intersectionality, Sahar F. Aziz

Faculty Scholarship

In the post-9/11 era, Muslim women donning a headscarf in America find themselves caught at the intersection of bias against Islam, the racialized Muslim, and women. In contrast to their male counterparts, Muslim women face unique forms of discrimination not adequately addressed by Muslim civil rights advocacy organizations, women's rights organizations, or civil liberties advocates.

This paper examines how the September 11th attacks adversely impacted the lives of headscarved Muslim women in ways different than Muslim men. Ten years after 9/11, there is a plethora of literature about what has become known as "post-9/11 discrimination." Most of the discussion focuses …

Sharing Secrets: Examining Deferred Action And Transparancy In Immigration Law, Shoba S. Wadhia Jan 2012

Sharing Secrets: Examining Deferred Action And Transparancy In Immigration Law, Shoba S. Wadhia

Faculty Scholarship

This Article is about deferred action and transparency in related immigration cases falling under the jurisdiction of the Department of Homeland Security (DHS). While scholars from other genres have written extensively on the topic of prosecutorial discretion, the subject is largely absent from immigration scholarship, with the exception of early research conducted by Leon Wildes in the late 1970s and early 2000s, and a law review article I published in 2010 outlining the origins of prosecutorial discretion in immigration law and related lessons that can be drawn from administrative law and criminal law. That article ends with specific recommendations for …

Recent Crime Legislation: The Challenge For Prison Health Care, Adelina Iftene, Allan Manson Jan 2012

Recent Crime Legislation: The Challenge For Prison Health Care, Adelina Iftene, Allan Manson

Articles, Book Chapters, & Popular Press

This article reviews the potential effects of Bill C-10 and related legislation that provide for more legal minimum sentences and reduce the possibility of conditional release. Without more resources overcrowding - an already pressing issue in Canadian corrections - will increase. We further review the potential effects of overcrowding as exemplified in other jurisdiction.

Insecure Refugees: The Narrowing Of Asylum-Seeker Rights To Freedom Of Movement And Claims Determination Post-9/11 In Canada, Constance Macintosh Jan 2012

Insecure Refugees: The Narrowing Of Asylum-Seeker Rights To Freedom Of Movement And Claims Determination Post-9/11 In Canada, Constance Macintosh

Articles, Book Chapters, & Popular Press

This chapter has a modest goal: to track some legislative changes since 9/11 which impact on two rights of asylum-seekers where those changes are linked to or justified by security concerns. These are the rights of asylum-seekers to have their claim determined, and to not be detained. This article identifies how legislation restricting these key rights of asylum-seekers has largely been promoted as necessary for Canada to be able to protect its public from criminality and security threats. The article thus queries whether measures, especially those introduced under Bill C-11, The Balanced Refugee Reform Act and those proposed under Bill …

Who Said The Crawford Revolution Would Be Easy?, Richard D. Friedman Jan 2012

Who Said The Crawford Revolution Would Be Easy?, Richard D. Friedman

Articles

One of the central protections of our system of criminal justice is the right of the accused in all criminal prosecutions "to be confronted with the witnesses against him." It provides assurance that prosecution witnesses will give their testimony in the way demanded for centuries by Anglo-American courts-in the presence of the accused, subject to cross-examination- rather than in any other way. Witnesses may not, for example, testify by speaking privately to governmental agents in a police station or in their living rooms. Since shortly after it was adopted, however, the confrontation right became obscured by the ascendance of a …

Should Mass Comments Count?, Nina A. Mendelson

Articles

I am grateful to the Michigan Journal of Environmental & Administrative Law for the opportunity to reply to “Rulemaking vs. Democracy: Judging and Nudging Public Participation That Counts,” a terrific article by Professor Cynthia Farina, Mary Newhart, and Josiah Heidt of the Cornell eRulemaking Institute (“CeRI”). Farina, Newhart, and Heidt’s continuing commitment to structuring public engagement in e-rulemaking, both through scholarship and CeRI’s Regulation Room project, is one of the most hopeful signs for the future of that process. In their Article, the authors are concerned with agency treatment of large volumes of public comments in rulemaking, an increasingly common …

Funding Port-Related Infrastructure And Development: The Current Debate And Proposed Reform, Christopher T. Cook Jan 2012

Funding Port-Related Infrastructure And Development: The Current Debate And Proposed Reform, Christopher T. Cook

Fordham Urban Law Journal

Given the lack of consensus and certainty in how funding should best be generated to meet critical infrastructure and development needs, this Note proposes an amendment to the Shipping Act to provide port authorities with the express power to impose fees for the construction, operation, and maintenance of qualifying port-related infrastructure and development initiatives. The amendment would effectively spread the costs specific to qualifying initiatives over the useful life of the project. Part I discusses the relevant provisions and judicial standards associated with the Tonnage Clause and Shipping Act. Part II addresses the efforts by both Congress and port authorities …

Significant Entanglements: A Framework For The Civil Consequences Of Criminal Convictions, Colleen F. Shanahan Jan 2012

Significant Entanglements: A Framework For The Civil Consequences Of Criminal Convictions, Colleen F. Shanahan

Faculty Scholarship

A significant and growing portion of the U.S. population is or has recently been in prison. Nearly all of these individuals will face significant obstacles as they struggle to reintegrate into society. A key source of these obstacles is the complex, sometimes unknown, and often harmful collection of civil consequences that flow from a criminal conviction. As the number and severity of these consequences have grown, courts, policymakers, and scholars have struggled with how to identify and understand them, how to communicate them to defendants and the public, and how to treat them in the criminal and civil processes. The …

The Law, Security And Civil Society Freedoms, Mandeep S. Tiwana, Brett J. Kyle Jan 2012

The Law, Security And Civil Society Freedoms, Mandeep S. Tiwana, Brett J. Kyle

Political Science Faculty Publications

In the past decade, civil society space across the globe has been challenged by pressing concerns about national security. The analysis in this chapter demonstrates that CSOs in the twenty-five countries of the CSI examined for this volume report a range of restrictive legal environments and illegitimate attacks from their local or central governments. International law provides for fundamental freedoms of association, but these guarantees have come under attack. As the data presented in this chapter show, CSOs in both democratic and non-democratic states report notable restrictions on their activities. This chapter proceeds as follows. First, it outlines recent trends …

Evidence-Based Hazmat Medical Surveillance, Michael D. Jacobson Jan 2012

Evidence-Based Hazmat Medical Surveillance, Michael D. Jacobson

Master of Public Health Program Student Publications

Background: Hazardous materials (HAZMAT) teams are tasked with neutralizing substances that pose a dire threat to human health. As a result, communities invest substantially in medical surveillance to protect first responders. Yet, little is known as to the actual exposures, consequent injuries, and cost-effectiveness of medical surveillance.

Objective: The purposes of this study were: 1) Determine actual HAZMAT threats. 2) In light of these threats, evaluate current regulatory requirements, recommendations and practices for their basis in evidence.

Methods: National HAZMAT data was analyzed for trends and compared with local response records from 2008 through 2011. Regulations applicable to medical surveillance …

Prosecution In 3-D, Kay L. Levine, Ronald F. Wright Jan 2012

Prosecution In 3-D, Kay L. Levine, Ronald F. Wright

Faculty Articles

Despite the multidimensional nature of the prosecutor’s work, legal scholars tend to offer a comparatively flat portrait of the profession, providing insight into two dimensions that shape the prosecutor’s performance. Accounts in the first dimension look outward toward external institutions that bear on prosecutors’ case-handling decisions, such as judicial review or the legislative codes that define crimes and punishments. Sketches in the second dimension encourage us to look inward, toward the prosecutor’s individual conscience.

In this Article we add depth to the existing portrait of prosecution by exploring a third dimension: the office structure and the professional identity it helps …

General Equilibrium Effects Of Prison On Crime: Evidence From International Comparisons, Justin Mccrary, Sarath Sanga Jan 2012

General Equilibrium Effects Of Prison On Crime: Evidence From International Comparisons, Justin Mccrary, Sarath Sanga

Faculty Scholarship

We compare crime and incarceration rates over time for the United States, Canada, and England and Wales, as well as for a small selection of comparison countries. Shifts in U.S. punishment policy led to a five-fold increase in the incarceration rate, while nearly every other country experienced only minor increases in incarceration. The large shifts in U.S. punishment policy do not seem to have caused commensurately large improvements in public safety.

Judicial Decision Making In A World Of Natural Law And Natural Rights, George C. Christie Jan 2012

Judicial Decision Making In A World Of Natural Law And Natural Rights, George C. Christie

Faculty Scholarship

This article was my contribution to a symposium celebrating the achievements of John Finnis held at the Villanova University School of Law. Finnis’ greatest work is his Natural Law and Natural Rights. I agree with Finnis’ rejection of an approach to natural law which focuses on the notion of natural rights. Finnis’ approach instead focuses on a natural law that is based on the idea that there are certain basic human goods such as the search for knowledge, the maintenance of life, the sharing of fellowship with other human beings, the capacity to enjoy aesthetic experiences, and the exercise …

Herding Katz: Gps Tracking And Society's Expectations Of Privacy In The 21st Century, Zachary Gray Jan 2012

Herding Katz: Gps Tracking And Society's Expectations Of Privacy In The 21st Century, Zachary Gray

UC Law Constitutional Quarterly

For nearly forty-four years, the Supreme Court has adhered to the same test for its Fourth Amendment jurisprudence, first announced in Justice Harlan's concurrence in Katz v. United States. Despite the judiciary's steadfast use of the test since its enunciation, the decisions since Katz have been anything but consistent.

Most recently, this nation's federal courts were confronted with questions about the legitimacy of using GPS tracking devices. In its attempt to resolve the issue, the Supreme Court's decision in United States v. Jones strayed from applying Katz and instead relied on the common-law trespass doctrine.

In an attempt to determine …
