Modeling Municipal Service Integration : A Comparative Case Study Of New York And Philadelphia 311 Systems, Taewoo Nam Jan 2012

Modeling Municipal Service Integration : A Comparative Case Study Of New York And Philadelphia 311 Systems, Taewoo Nam

Legacy Theses & Dissertations (2009 - 2024)

An increasing number of city governments are looking to the consolidation of municipal services to make their cities more efficient, effective, transparent, and accountable. A 311 system, as a consolidated channel for non-emergency contact services, is one strategy being employed. Despite growing attention to 311 systems as a preferred approach to city-level service integration, there is a paucity of research on integration of the related city services. Considering the gap in theoretical and practical knowledge of city-level service integration, this study addresses two questions: 1) How do city governments integrate critical city services? and 2) What influences city-level service integration …

Bail: Reforming Policies To Address Overcrowded Jails, The Impact Of Race On Detention, And Community Revival In Harris County, Texas, Marcia Johnson, Luckett Anthony Johnson Jan 2012

Bail: Reforming Policies To Address Overcrowded Jails, The Impact Of Race On Detention, And Community Revival In Harris County, Texas, Marcia Johnson, Luckett Anthony Johnson

Northwestern Journal of Law & Social Policy

Starting in the 1970s, the U.S. federal government and many state and local governments adopted “get tough” policies against crime. These new strict policy initiatives produced an explosion of incarceration in prisons throughout the country. They also impacted local jails as well, particularly in the numbers of persons detained pre-trial. This Article explores this phenomenon and its implications for local governments, as well as its unforeseen consequences on communities, particularly communities of color. The Article uses Harris County, Texas to exemplify the systematic problems resulting from the over-jailing of its citizens, particularly persons who are detained pre-trial. We attempt to …

Health Behind And Beyond Bars : Understanding The Link Between Incarceration And Health, Lauren C. Porter Jan 2012

Health Behind And Beyond Bars : Understanding The Link Between Incarceration And Health, Lauren C. Porter

Legacy Theses & Dissertations (2009 - 2024)

The primary aim of this dissertation is to better understand the link between incarceration and health. Drawing on a sample of young adults from the National Longitudinal Study of Adolescent Health (Add Health), the effect of incarceration on self-rated health, serious injury, STD infection, cold/flu symptoms, and blood pressure is assessed. The effect of incarceration on health behavior is also examined, including diet, smoking, binge drinking, and physical activity. In order to rule out selection bias, current and former inmates are compared to respondents who have been arrested (or arrested and convicted of a crime), but not incarcerated. Findings suggest …

Exploring Change In Local Criminal Justice Systems: An Examination Of The Implementation Of The Justice Reinvestment At The Local Level Model In Three U.S. Counties, Suzanne Rebecca Neusteter Jan 2012

Exploring Change In Local Criminal Justice Systems: An Examination Of The Implementation Of The Justice Reinvestment At The Local Level Model In Three U.S. Counties, Suzanne Rebecca Neusteter

Dissertations, Theses, and Capstone Projects

Tough on crime policies in the U.S. began to emerge in the 1970s and steeply escalated through the 1980s and 1990s, prompting massive growth of correctional populations and criminal justice costs. Although many of these policy and legislative reforms were enacted at the federal and state levels, they have trickled down and greatly affected localities across the country. The recent economic downturn has exerted additional pressures on local governments. These factors have prompted the development of a number of planned change strategies designed to curb the escalating growth and related costs in criminal justice systems. One such approach, Justice Reinvestment …

Punitive Juvenile Justice And Public Trials By Jury: Sixth Amendment Applications In A Post-Mckeiver World, Martin R. Gardner Jan 2012

Punitive Juvenile Justice And Public Trials By Jury: Sixth Amendment Applications In A Post-Mckeiver World, Martin R. Gardner

Nebraska Law Review

This Article argues that the continued homage to McKeiver in an era of punitive juvenile justice is the misguided result of judicial inattention to the distinction between punitive and rehabilitative dispositions. In Part II, I clarify this distinction and demonstrate why understanding it is essential to a sound analysis of whether jury determinations and public proceedings are constitutionally required in delinquency adjudications. I show that the concepts of rehabilitation and punishment are distinct and, for purposes of constitutional analysis, mutually exclusive. From this discussion I derive a conceptual framework, which I apply in Part IV to analyze several cases. These …

Thinking Locally: Law, Aging And Municipal Government: Findings From A National Survey, A. Kimberley Dayton, Israel (Issi) Doron

Faculty Scholarship

Municipal law, which has been largely ignored in the body of elder-rights scholarship, often plays a far more important role in the everyday lives of older persons than the principally aspirational concepts of international law. Accordingly, this article examines how well modern cities have fulfilled their potential role in assuring the civil and human rights of older persons. The author concludes, based on the results of a national study, that local law is not currently fulfilling its potential as a means to expand the rights of older citizens. Few cities across the country appear to have taken more than minor …

Tax Deductions For Charitable Contributions: Domestic Activities, Foreign Activities, Or None Of The Above, Eric M. Zolt Jan 2012

Tax Deductions For Charitable Contributions: Domestic Activities, Foreign Activities, Or None Of The Above, Eric M. Zolt

UC Law Journal

Warren Buffett, Bill Gates, and sixty-seven other billionaires have pledged to give a majority of their wealth for charitable purposes. The total dollar amount of potential funding for charitable activities is staggering. So is the potential loss of tax revenue. Because of past, current, and future tax benefits, U.S. taxpayers have funded and will fund a substantial portion of these charitable activities without any input in how the money is spent. These billionaires are not just being generous with their own money, but with the money of the American people. Should we allow tax benefits to subsidize charitable activities and …

Cable Median Barrier Failure Analysis And Prevention, Dean L. Sicking, Cody S. Stolle Jan 2012

Cable Median Barrier Failure Analysis And Prevention, Dean L. Sicking, Cody S. Stolle

Mid-America Transportation Center: Final Reports and Technical Briefs

Cross-median crashes have been identified as one of the highest injury or fatality risk crash types. Although crossmedian crashes account for only 2% to 5% of all median crash events, they are disproportionately represented in the number and frequency of fatalities on interstate roadways. Many states have utilized cable median barriers to reduce the risk of cross-median crashes, frequently with great success. However, cable median barriers are also fixed obstacles to errant vehicles. Cable median barriers can place occupants at increased risk of severe injury or fatality if the barrier fails to adequately contain and redirect errant vehicles, resulting in …

Project Risk And Appeals In U.S. Forest Service Planning, Marc J. Stern, S. Andrew Predmore, Wayde C. Morse, David N. Seesholtz Jan 2012

Project Risk And Appeals In U.S. Forest Service Planning, Marc J. Stern, S. Andrew Predmore, Wayde C. Morse, David N. Seesholtz

United States Department of Agriculture, Forest Service / University of Nebraska-Lincoln: Faculty Publications

The National Environmental Policy Act (NEPA) requires U.S. Forest Service planning processes to be conducted by interdisciplinary teams of resource specialists to analyze and disclose the likely environmental impacts of proposed natural resource management actions on Forest Service lands. Multiple challenges associated with these processes have been a source of frustration for the agency. One of these challenges involves administrative appeals through which public entities can challenge a Forest Service decision following a NEPA process. These appeals instigate an internal review process and can result in an affirmation of the Forest Service decision, a reversal of that decision, or additional …

Back To The Future: The Curious Case Of United States V. Jones, Erin E. Murphy Jan 2012

Back To The Future: The Curious Case Of United States V. Jones, Erin E. Murphy

Faculty Articles

Historically, the Supreme Court has couched the protections of the Fourth Amendment in the language of privacy and property. Yet expectations about freedom from government interference are no longer solely expressed in those terms. People routinely trade their privacy or property interests for complimentary e-mail services or faster toll crossings, and yet unfettered access to such information strikes many observers as contrary to the Fourth Amendment’s core values. If neither privacy nor property theories provide a constitutional basis for oversight, however, then what does? In Jones, the Justices were confronted with just this dilemma. In response, as this Essay will …

Going Outside The Law: The Role Of The State In Shaping Attitudes To Private Acts Of Violence, Tom R. Tyler, Jonathan Jackson, Aziz Huq, Ben Bradford Jan 2012

Going Outside The Law: The Role Of The State In Shaping Attitudes To Private Acts Of Violence, Tom R. Tyler, Jonathan Jackson, Aziz Huq, Ben Bradford

Public Law and Legal Theory Working Papers

Why do people believe that violence is acceptable? In this paper we study people’s normative beliefs about the acceptability of violence to achieve social control (as a substitute for the police, for self-protection and the resolution of disputes) and social change (through violent protests and acts to achieve political goals). Addressing attitudes towards violence among young men from various ethnic minority communities in London, we find that procedural justice is strongly correlated with police legitimacy, and that positive judgments about police legitimacy predicts more negative views about the use of violence. We conclude with the idea that police legitimacy has …

Communication Technology In Disaster Management, Denise Nicole Walker

Wayne State University Theses

ABSTRACT

COMMUNICATION TECHNOLOGY IN DISASTER MANAGEMENT

by DENISE WALKER

This thesis will analyze different case studies involving catastrophic disasters. I will compare their rescue response from the government to FEMA's response to Katrina, to establish a basis for comparison. The Midwest Floods and California fires will be compared to Hurricane Katrina in New Orleans because these places are prone to natural disasters. I will look at each of these states ecology to explain why these states are prone to floods, fires and hurricanes. Unlike the Midwest and California, Hurricane Katrina received far less help from the government and FEMA. I …

International And Canadian Law Rules Applicable To Cyber Attacks By State And Non-State Actors, Matthew E. Castel Jan 2012

International And Canadian Law Rules Applicable To Cyber Attacks By State And Non-State Actors, Matthew E. Castel

Canadian Journal of Law and Technology

This essay, which contains a broad ranging overview of several important issues raised by the recent number of cyber attacks in Canada and elsewhere, begins with a definition of cyberspace and cyber war. It is followed by a brief survey of some cyber attacks that have occurred in Canada and elsewhere in recent years. The first part addresses the question whether present rules of international law applicable to armed attacks using kinetic weapons apply to the wide notion of cyber attacks by a state actor against the government and critical civilian infrastructures of another state and concludes that they do. …

The Federal Workforce Development Program: An Analysis Of Probationers And Characteristics Associated With And Predictive Of Successful Reentry, Kelley Mcnichols Jan 2012

The Federal Workforce Development Program: An Analysis Of Probationers And Characteristics Associated With And Predictive Of Successful Reentry, Kelley Mcnichols

Electronic Theses and Dissertations

With years of research focusing on soaring incarceration rates, the phenomena of prisoner reentry has been largely overlooked. The majority of incarcerated people will return to the community setting. In fact, millions of recently released offenders are on some form of community based supervision. Today, recidivism is a problem that plagues prisoner reentry. In order to address the challenge of prisoner reentry successfully, reentry initiatives have been established in an attempt to change the way corrections is conceptualized. The purpose of this study was to examine characteristics of probationers that are associated with and predictive of successful reentry. The data …

Resuscitating Roberts - How Courts Should Construe The Emergency Exception To The Sixth Amendment's Confrontation Clause, Sloan A. Heffron Jan 2012

Resuscitating Roberts - How Courts Should Construe The Emergency Exception To The Sixth Amendment's Confrontation Clause, Sloan A. Heffron

UC Law Constitutional Quarterly

This paper argues that in the wake of Crawford, Davis, and Bryant, trial courts need a workable definition of "ongoing emergency," as well as a test that can be applied in assessing the admissibility of statements made under such circumstances. The paper first offers a definition for "ongoing emergency". It then offers a totality-of-the-circumstances test that can be applied in determining if a declarant's statement occurs during the course of an ongoing emergency.
