Satellite Telemetry Of Great Frigatebirds Fregata Minor Rearing Chicks On Tern Island, North Central Pacific Ocean, Morgan E. Gilmour, E. A. Schreiber, Donald C. Dearborn Jan 2012

Satellite Telemetry Of Great Frigatebirds Fregata Minor Rearing Chicks On Tern Island, North Central Pacific Ocean, Morgan E. Gilmour, E. A. Schreiber, Donald C. Dearborn

All Faculty Scholarship

The Papahānaumokuākea Marine National Monument in the Northwestern Hawaiian Islands protects breeding habitat for many migratory animals. We used satellite telemetry to describe the areas in which a mobile top predator, the Great Frigatebird Fregata minor, traveled on foraging trips during the early chick-rearing period from a breeding colony on Tern Island, French Frigate Shoals. Identification of potential foraging events, indicated by a reduction in transit rate, allowed us to assess whether wide-ranging marine species such as Great Frigatebirds remain inside the protective boundaries of the Monument while brooding young chicks. Four of 11 foraging trips extended outside of the …

End Of An Error: Replacing Manifest Disregard With A New Framework For Reviewing Arbitration Awards, The, Kenneth R. Davis Jan 2012

End Of An Error: Replacing Manifest Disregard With A New Framework For Reviewing Arbitration Awards, The, Kenneth R. Davis

Cleveland State Law Review

Guided by the purposes of the FAA, its legislative history, and the role of commercial arbitration in modern society, this Article proposes a new framework for the judicial review of arbitration awards. Awards deciding federal statutory rights such as those conferred by securities law and civil rights law should be reviewed for errors of law. As recognized in Wilko and McMahon, federal rights deserve protection, even in arbitration. There is one other type of award that requires judicial correction. Despite the statements in Hall Street and Concepcion that the FAA provides the exclusive grounds for vacatur, the courts must correct …

The Distorted Reality Of Civil Recourse Theory , Alan Calnan Jan 2012

The Distorted Reality Of Civil Recourse Theory , Alan Calnan

Cleveland State Law Review

In their recent article Torts as Wrongs, Professors John C.P. Goldberg and Benjamin C. Zipursky offer their most complete and accessible explanation of the civil recourse theory (CRT) of tort law. A purely descriptive account, CRT holds that tort law is exclusively a scheme of private rights for the redress of legal wrongs and is not a pragmatic mechanism for imposing strict liability or implementing public policy. The present paper challenges this view by revealing critical errors in its perspective, methodology, and analysis. It shows that Goldberg and Zipursky do not objectively observe tort law and uncritically report what they …

David Bederman, Master And Commander, Katherine Brokaw Jan 2012

David Bederman, Master And Commander, Katherine Brokaw

Emory Law Journal

Deep down, Professor David Bederman identified, I am convinced, with Captain Jack Aubrey. This may surprise the reader who knew David as a slightly built, mild-mannered, gentle, and bespectacled scholar, given that Jack Aubrey (played by Russell Crowe in the movie Master and Commander) is described throughout the books that chronicle his maritime career as an enormous, blond, muscular Anglo-Saxon. You may not think of David Bederman as a swashbuckler á la Errol Flynn.

The Classical Foundations Of David Bederman, Polly J. Price

Emory Law Journal

Professor David Bederman's scholarly contributions spanned many fields. Underlying his work was an immense facility with history--a judicious understanding of historical method along with breadth of knowledge, painstakingly obtained. His contributions in admiralty and international law, for example, proceeded from a keen understanding of developments over time in those fields. It is this feature of his work--David Bederman as legal historian--on which I write.

Crime, Punishment, And The Psychology Of Self-Control, Rebecca Hollander-Blumoff Jan 2012

Crime, Punishment, And The Psychology Of Self-Control, Rebecca Hollander-Blumoff

Emory Law Journal

Criminal law, by design, assigns culpability for intentional, volitional action. Criminal law theory and criminal law doctrine thus both place an important emphasis on an individual's ability to control his or her behavior.

Bridging The Research Gap: Making Hri Useful To Individuals With Autism, Elizabeth Kim, Rhea Paul, Frederick Shic, Brian Scassellati

Communication Disorders Faculty Publications

While there is a rich history of studies involving robots and individuals with autism spectrum disorders (ASD), few of these studies have made substantial impact in the clinical research community. In this paper we first examine how differences in approach, study design, evaluation, and publication practices have hindered uptake of these research results. Based on ten years of collaboration, we suggest a set of design principles that satisfy the needs (both academic and cultural) of both the robotics and clinical autism research communities. Using these principles, we present a study that demonstrates a quantitatively measured improvement in human-human social interaction …

Testing Our Teachers, Andrew Mckinley Jan 2012

Testing Our Teachers, Andrew Mckinley

Emory Law Journal

In recent years, a number of school districts have begun drug testing their teachers, only to find that the Supreme Court's special needs exception is failing. As it has in other corners of its Fourth Amendment jurisprudence, the Court has erected an exception predicated on a vague "reasonableness" standard, the application of which often varies with the ad hoc interpretations of individual courts.

Turkish Journal of Veterinary & Animal Sciences

This study describes the anatomical, light microscopic, and ultrastructural characterization of the immune organs in ostrich chicks. In this study 6 healthy 8-week-old ostrich chicks were processed for light and transmission electron microscopy. Hematoxylin and eosin as well as improved Weigert staining were used for light microscopy. The small thymus, which clustered caudally along both sides of the neck, contained Hassall's corpuscles in the medulla. The cloacal bursa, which formed the hanging and lateral walls of the cloaca, enveloped the cloaca but did not form a truly independent bursa. Inside the bursa convex papillae were densely distributed on the surface …

A Retrospective Study Of Anaplasma In Minnesota Cattle, Aneela Durrani, Sagar Goyal

Turkish Journal of Veterinary & Animal Sciences

To determine the seroprevalence of Anaplasma in Minnesota cattle, the database of the Veterinary Diagnostic Laboratory (VDL), University of Minnesota was searched over a 10 year period (2001 to July 2010). A total of 438,407 bovine serum samples were tested by complement fixation test (CFT) and competitive enzyme linked immunosorbent test (cELISA). The positive rate of seroprevalence by CFT was 2.4% out of 211,484 samples, with a 0.13% anticomplementary result. The VDL at the University of Minnesota started using cELISA after 2002, and CFT application was suspended as diagnostic test for anaplasmosis after 2005 due to its complexity. With cELISA, …

The Effect Of Bleeding On Peripheral Blood And Head Kidney Hematopoietic Tissue In Common Carp (Cyprinus Carpio), Elzbieta Kondera, Aneta Dmowska, Monika Rosa, Malgorzata Witeska

Turkish Journal of Veterinary & Animal Sciences

Adverse environmental conditions (contamination of water with nitrite, pesticides, or other pollutants), nutritional deficiencies, bacterial and viral infections, and parasitic invasions may induce anemia in fish, in both natural and aquaculture conditions. Changes in hematological values and cellular composition of peripheral blood and head kidney hematopoietic tissue of bled common carp (Cyprinus carpio L.) were evaluated over a 4 week period post-bleeding (30% blood loss). The results showed that fish very quickly compensated for anemia. Erythrocyte count (RBC), hemoglobin concentration (Hb), and hematocrit (Ht) gradually increased to values significantly higher than they were before bleeding; this was accompanied by an …

The Effect Of Different Extenders On The Motility And Morphology Of Ram Sperm Frozen Or Stored At 4 °C, Recai̇ Kulaksiz, Çi̇ğdem Çebi̇, Ergün Akçay

Turkish Journal of Veterinary & Animal Sciences

This study was conducted to evaluate the effects on sperm motility and abnormality in ram semen extended with skimmed milk (M), sodium citrate (SC), Tris (T), and Bioxcell® (B) after storage in liquid form at 4 °C and in frozen form. Ejaculates were collected from 3 Akkaraman rams by artificial vagina twice a week during the non-breeding season. After pooling, each pooled ejaculate was split into 4 equal aliquots and diluted with skimmed milk (M), sodium citrate (SC), Tris (T), and Bioxcell® (B) extenders. Sperm motility was significantly higher (P < 0.05) in M compared with B, SC, and T on the first and second days (48 h) of storage. With regard to the percentage of total abnormal spermatozoa, the results in M were different from (P < 0.05) from those of SC and T on the first day (24 h) of storage but no different from B. Differences among extenders were found to be significant post-thawing for spermatozoa motility and the percentage of total abnormal spermatozoa. The total abnormality of semen diluted with M was significantly lower than that observed in the other extenders. Consequently, it was found that skimmed milk was better than the other extenders in terms of the sperm parameters evaluated during liquid storage and post-thaw.

A Loop-Mediated Isothermal Amplification (Lamp) Assay For Rapid Detection Of Anaplasma Phagocytophilum Infection In Dogs, Chungchen Lee, Yungchang Lin, Chauloong Tsang, Yangtsung Chung

Turkish Journal of Veterinary & Animal Sciences

A simple and rapid diagnostic method of Anaplasma phagocytophilum infection was established, employing the loop-mediated isothermal amplification (LAMP) reaction. With 1 set of 4 specific primers targeting the citrate synthase (gltA) gene of A. phagocytophilum, the LAMP assay rapidly amplified the target DNA sequence in a single tube in 1 h, requiring only a water bath for reaction. When visualized by gel electrophoresis, the LAMP products appeared as a ladder-like pattern, with many bands of different sizes from 180 base pairs up to the loading well. The results obtained from testing 32 clinical blood samples of dogs demonstrated that the …

The Role Of Notch Receptors And Ligands In Regulation Of Immune Responses, Gerard F. Hoyne Jan 2012

The Role Of Notch Receptors And Ligands In Regulation Of Immune Responses, Gerard F. Hoyne

Health Sciences Papers and Journal Articles

Notch signalling has an important role in the immune system in directing cell fate decisions in a range of diverse cell types. We are beginning to obtain a better understanding of the roles that the different Notch ligands and receptors play in both cellular differentiation of precursor cells and the regulation of immune responses by mature lymphocytes in the periphery. This review will examine the key findings that have emerged in relation to function of Notch in differentiation of T cells, B cells and dendritic cells and how modulation of Notch signalling seems to have potential for therapeutic applications in …

Thiamethoxam has been used as a major insecticide to control the B-biotype sweetpotato whitefly, Bemisia tabaci (Gennadius) (Hemiptera: Aleyrodidae). Due to its excessive use, a high level of resistance to thiamethoxam has developed worldwide over the past several years. To better understand the molecular mechanisms underlying this resistance in B. tabaci, gene profiles between the thiamethoxam-resistant and thiamethoxam-susceptible strains were investigated using the suppression subtractive hybridization (SSH) library approach. A total of 72 and 52 upand down-regulated genes were obtained from the forward and reverse SSH libraries, respectively. These expressed sequence tags (ESTs) belong to several functional categories based …

Conserving Montana's Sagebrush Highway: Long Distance Migration In Sage-Grouse, Rebecca Elizabeth Smith Jan 2012

Conserving Montana's Sagebrush Highway: Long Distance Migration In Sage-Grouse, Rebecca Elizabeth Smith

Graduate Student Theses, Dissertations, & Professional Papers

Landscape conservation is the mechanism for conserving migratory wildlife in sagebrush ecosystems. We study further a greater sage-grouse (Centrocercus urophasianus; hereafter ‘sage-grouse’) population with the longest-known annual migration, a 240-km journey between summer range in north central Montana, USA, and Saskatchewan, Canada, to winter range north of the Missouri River. We learned more about grouse migration by asking: Do birds fly quickly through a corridor, or do they use stopover habitats within a larger migratory pathway? New GPS-tracking technology revealed that migrating grouse frequent stopover habitats along multiple routes that coalesce to form an integrated pathway. A month-long fall migration …

Authentic Human Development And Vector Forces In Education: Drawing On The Thought Of Bernard Lonergan, S.J. In Addressing Some Key Issues In Educational Philosophy, Andrew Dwight

Jesuit Higher Education: A Journal

Our basic response as humans to a world we did not create is not thought but intentionally oriented by affectivity. Our understanding of the nature of this intentionality has profound implications for our educational design and practice, from the level of curriculum development through to individual teaching moments. The work of Bernard Lonergan seek to understand the constituent elements of the primordial drive that leads to our sense of understanding, understanding that for Lonergan necessarily involves our agency. This paper considers Lonergan‘s articulation of the operations as we engage in our world, as well as some implications such an understanding …
