The Bologna Process And Its Impact In Europe: It's So Much More Than Degree Changes, Laurel S. Terry Jan 2008

The Bologna Process And Its Impact In Europe: It's So Much More Than Degree Changes, Laurel S. Terry

Vanderbilt Journal of Transnational Law

The Bologna Process is a massive, multi-year project designed to create the "European Higher Education Area" by the year 2010. It began ten years ago, when four European Union(EU) countries signed a relatively vague declaration. It has grown to include forty-six countries, including all of the EU Member States and nineteen non-EU countries. The Bologna Process countries have agreed on ten "action lines" for restructuring European higher education. These action lines are nothing short of revolutionary--they address everything from a three-cycle degree system (e.g., bachelor-master's-doctorate degrees), European-wide quality assurance efforts, mobility of higher education students and staff, "recognition" in one …

International Law's Mixed Heritage: A Common/Civil Law Jurisdiction, Colin B. Picker Jan 2008

International Law's Mixed Heritage: A Common/Civil Law Jurisdiction, Colin B. Picker

Vanderbilt Journal of Transnational Law

This Article provides the first application of the emerging mixed jurisdiction jurisprudence to a comparative analysis of international law. Such a comparative law analysis is important today as the growth and increasing vitality of international juridical, administrative and legislative institutions is placing demands on international law not previously experienced. International law is unsure where to look for help in coping with these new stresses. In significant part this isolation can be attributed to a general view among international law scholars that international law is sui generis, and hence there is little to be gained from national legal systems. This Article …

A Tale Of Two Networks: Terrorism, Transnational Law, And Network Theory, Christopher J. Borgen Jan 2008

A Tale Of Two Networks: Terrorism, Transnational Law, And Network Theory, Christopher J. Borgen

Faculty Publications

Talk of networks and "network theory" has become almost ubiquitous in the field of counterterrorism. Terrorist organizations are networks. Terrorists have been empowered by the Internet, ethnic diasporas, and cell phones—networks all. Many of the putative targets of terrorists—electrical grids, oil pipelines, and transportation systems, to name a few—are themselves networks. And, perhaps less often mentioned, terrorists are increasingly hampered by national and international laws that foster cooperation and coordination among states—a network of laws.

From "smart mobs" to "net wars," from narco-trafficking to the Internet, network theory has provided insights into decentralized social organizations and their coordinated action. Both …

Cyber Influence And International Security, Franklin D. Kramer, Larry Wentz

Defense Horizons

This paper examines the growing role of cyber influence in shaping international security, strategic competition, and state behavior in the information age. It explores how information technologies, digital networks, and cyber capabilities are increasingly used to influence political outcomes, shape perceptions, disrupt adversaries, and advance national objectives below the threshold of conventional conflict. This paper analyzes the strategic implications of cyber-enabled influence operations for U.S. national security and discusses the evolving challenges posed by information dominance, technological interconnectivity, and nontraditional forms of conflict in the digital era.

The After-Shocks Of Twombly: Will We "Notice" Pleading Changes?, Ettie Ward Jan 2008

The After-Shocks Of Twombly: Will We "Notice" Pleading Changes?, Ettie Ward

St. John's Law Review

(Excerpt)

Part I will briefly discuss the pre-Twombly view of notice pleadings. To some extent, our understanding of what the rules required and what lawyers actually did was a romanticized view of pleading. Actual pleadings were rarely as "barebones" as we imagine. Further, in recent decades, rules, statutes, court decisions, and practical considerations have further eroded the notice pleading construct.

Part II will give a brief synopsis of the Twombly decision and then discuss the majority and dissent's views on pleadings generally.

Part III will examine selected cases post-Twombly and make some general observations and predictions as to …

Radically American: John Dos Passos, Culture And Politics, Alice Béja Jan 2008

Radically American: John Dos Passos, Culture And Politics, Alice Béja

Reconstruction: Studies in Contemporary Culture

This essay takes the well-known and near-canonical figure of John Dos Passos, considering his own claims to a form of radicalism independent of political parties and their perceived ideological rigidity. Drawing upon documentary and non-fiction writings, the essay evaluates the writer’s negotiations of radicalism within the constraints of a so-called national political character.

Robot Controller Architecture: Layered Mode Selection Logic With Fuzzy Sensor Fusion Network, Traig E.B. Born Jan 2008

Robot Controller Architecture: Layered Mode Selection Logic With Fuzzy Sensor Fusion Network, Traig E.B. Born

Theses and Dissertations

A behavior based robot controller was implemented using Layered Mode Selection Logic as a behavior coordination mechanism and a Fuzzy Sensor Fusion Network to provide perception. A series of collision experiments were conducted to create a Fuzzy Sensor Fusion Network capable of detecting collisions using acceleration readings from wheel encoders. An obstacle avoidance behavior was created, and it was demonstrated that the robot could be constrained by movable obstacles. The avoidance behavior was modified to create an obstacle manipulation behavior. This behavior allowed the robot to escape when enclosed by movable obstacles. The fuzzy sensor fusion network was enhanced to …

Self-Reported Listening Strategies By Students In An Intensive English Language Program, Holly Montgomery Jan 2008

Self-Reported Listening Strategies By Students In An Intensive English Language Program, Holly Montgomery

Theses and Dissertations

The purpose of this research is to add to knowledge about cognitive and metacognitive listening strategies by second language learners. A survey was developed and administered in which questions solicited a retrospective self-report of students' listening habits. The listening strategies used for this study are limited to main idea identification and translation, because they succinctly exemplify the broad groups of strategies to which they belong. Respective sections of the questionnaire address academic, authentic, and informal listening contexts, in order to isolate and differentiate between the strategies' reported use in each, revealing discrepancies and similarities between reports of strategy use in …

Heuristic Health Resource Referral (H2r2) Engine, Duy Vo Jan 2008

Heuristic Health Resource Referral (H2r2) Engine, Duy Vo

Master's Projects

Searching for health resources is difficult for many individuals because it requires domain knowledge and understanding of search engines techniques. Our system proposes a paradigm shift whereby users provide as much or as little information as they feel comfortable, and we endeavor to match them with relevant health resources. The system first attempts to identify risk factors through a heuristic engine that employs fuzzy logic and then searches for health resources based on the user’s profile. We aim to unburden the user from having to understand complex health information and sometimes esoteric search techniques. Our preliminary findings show that a …

The Effects Of Automated Essay Scoring As A High School Classroom Intervention, Kathie L Frost Jan 2008

The Effects Of Automated Essay Scoring As A High School Classroom Intervention, Kathie L Frost

UNLV Retrospective Theses & Dissertations

This quasi-experimental, mixed methods study investigated whether students writing development and proficiency, in combination with teacher-led instruction, are significantly affected by the use of an automated essay scoring (AES) system. The ninth grade standard and honors English students were divided into control and treatment groups at a large, urban high school. Student writing was examined for any changes in proficiency, measured by human- and AES-scored holistic measures. A developmental writing index was used to analyze the rate of change in pre- and post-essays. The AES system was further researched by comparing the treatment and control groups' trait score categories. Finally, …

Sheltering Corporate Assets From Political Extraction, Lorenzo Caprio, Mara Faccio, John J. Mcconnell Jan 2008

Sheltering Corporate Assets From Political Extraction, Lorenzo Caprio, Mara Faccio, John J. Mcconnell

Purdue CIBER Working Papers

We hypothesize that firms structure their asset holdings so as to shelter assets from extraction by politicians and bureaucrats. Specifically, in countries where the threat of political extraction is higher, we hypothesize that firms will hold a lower fraction of their assets in liquid form. Consistent with this conjecture, using firm-level data from 109 countries, we find that, across countries, corporate holdings of cash and marketable securities are negatively correlated with measures of political corruption. Further, we find that annual investment in property, plant, equipment, and inventory plus dividends is positively correlated with the measures of corruption suggesting that owners …

A Bioarchaeological Perspective On Egyptian Colonialism In Nubia During The New Kingdom, Michele Buzon Jan 2008

A Bioarchaeological Perspective On Egyptian Colonialism In Nubia During The New Kingdom, Michele Buzon

Department of Anthropology Faculty Publications

During the New Kingdom, Egypt began a military campaign to regain command over Nubia. Extremely successful, their control extended to the fourth cataract by the time of Thutmose III. The circumstances of this power, however, are not well known. It is unclear whether Egyptian colonists or locals administered Nubia during this time. Using a bioarchaeological approach via the study of human skeletal remains and archaeological data from the New Kingdom site of Tombos in Nubia and comparative Egyptian and Nubian skeletal samples, this paper addresses these long-standing questions. Analysesuggest that the Tombos individuals were an ethnically and biologically mixed group. …

Cardozo Journal of Conflict Resolution

This article examines the mediation process within the Registry of Interpreters for the Deaf Ethical Practices System and suggests when and how technology may be utilized to enhance that process. Background information regarding the interpreting profession, the Deaf Community, and the process for filing and reviewing grievances will provide a context for this discussion. An overview of the technologies already being used within the Deaf Community and interpreting field will help to determine where new technologies can be introduced most effectively. Each of the three steps in the EPS will be analyzed to assess how additional technologies can be integrated …
