The academic literature generally assumes that an aggregate-risk-utility test is employed to determine whether conduct was reasonable or negligent. This aggregate-risk-utility test is a transparent implementation of the basic impartiality and aggregation principles of utilitarianism and the most popular (Kaldor-Hicks) interpretation of economic efficiency. Thus, the test's assumed prevalence as the criterion of reasonableness in negligence law has been highlighted by legal economists as confirmation of the utilitarian efficiency foundations of tort law, while those, including Ronald Dworkin, who think that the law, including tort law, is or should be grounded on principles of justice have sought to demonstrate that, …

Negligence In The Courts: Introduction And Commentary, In Symposium, Negligence In The Courts: The Actual Practice, Richard W. Wright

This article is an introduction to and commentary on the contributions to a "Symposium on Negligence in the Courts: the Actual Practice." The contributors all conclude that the tests of negligence that are actually employed by the courts differ from the aggregate-risk-utility test that is generally assumed in the academic literature, including the Restatement of Torts. Patrick Kelley and Laurel Wendt's survey of all the standard jury instructions on negligence in the United States finds only one instruction, in Louisiana, that mentions a risk-utility or cost-benefit test of negligence, and that instruction merely suggests, as a discretionary option, the weighing …

High-Energy Ball Milling Of Polymers, Jabari Robinson

With metallic materials, the mechanism of milling is generally regarded as a combination of fracturing and cold-welding of powder particles. The same general mechanism is expected to apply polymers, but some aspects of the mechanism may be different for polymers due their chainlike molecular nature, lower moduli, and higher sensitivity to temperature. In spite of some potential problems some researchers have recently demonstrated that milling can be used to produce polymers and blends with acceptable mechanical properties. C. Bai and associates used high-energy ball milling at three temperatures on poly (ethylene terephthalate) and produced favorable results. Spontak et. al. cryogenically …

It often takes very little to make the difference between financial failure and success, but in times of extreme market volatility, even the relatively sophisticated investor can sometimes be caught off guard. People cannot afford to ignore their investments. Without a coordinated strategy, it can be difficult to build an effective investment portfolio that meets individual financial needs. The purpose of this study was to examine Taiwanese leadership styles and succession practices, by reviewing current theory and practice and by conducting interviews with ten leaders of Taiwanese enterprises. The discussion with these leaders focused on their personal characteristics and behaviors related to their leadership styles, their leadership approaches, their relationship with their subordinates, the effects of their leadership styles and their succession practices. The interview data were also analyzed within the context of the literature review’s discussion on the characteristics of Chinese leadership and the traditional Chinese family enterprise. Longleaf Ridge Special Area (LRSA) located in the Angelina National Forest is the westernmost example of a longleaf pine savanna community. Ecologically, the area is one of the most diverse communities in Texas. Due to its size, abundant natural and historical resources, numerous outdoor recreation opportunities exist. In this study, GIS was used to develop a forest recreation concept plan on LRSA. Most of the geospatial data came from public entities. Information for demand analysis on forest recreation was obtained from the 2000 National Survey on Recreation and the Environment database. Will a simple global masking model based on image detection be successful at predicting the readability of transparent text? Text readability was measured for two types of transparent text: additive (as occurs in head-up displays) and multiplicative (which occurs in see-through liquid crystal display virtual reality displays). Text contrast and background texture were manipulated. Data from two previous experiments were also included (one using very low contrasts on plain backgrounds, and the other using higher-contrast opaque text on both plain and textured backgrounds).
