Action Is An Action Is An Action Is An Action, Bradley Scott Shannon Jan 2002

Action Is An Action Is An Action Is An Action, Bradley Scott Shannon

Washington Law Review

The misuse of legal language is both rampant and problematic. This is particularly true with respect to the terminology employed by the Federal Rules of Civil Procedure. This Article begins with a general discussion of the importance of using proper legal terminology (with an emphasis on Rules terminology), followed by a discussion as to why, in spite of the problems caused by the misuse of legal terminology, such misuse persists. The Article then considers six Rules terms that should be familiar to every attorney—action, claim, averment, paper, dismissal, and judgment—and discusses the various ways in which these terms are being …

Constructing A Common Ukrainian Identity: An Empirical Study, Igor Khrestin '02 Jan 2002

Constructing A Common Ukrainian Identity: An Empirical Study, Igor Khrestin '02

Honors Projects

This study will examine the factors influencing the construction of a common national identity in Ukraine. The uniqueness of the Ukrainian case stems from its oppressive Russian-dominated past, its communist experience, and a weak role of nationalism prior to independence. Until 1991, Ukraine lacked the necessary components to be considered a successful nation-state. Literally translated as "borderland," Ukraine has never had a readily-identifiable common territory or a common people. Harsh assimilatory policies of its rulers have left a sharply divided society, with differing languages, customs, and conflicting identities. When the Soviet Union collapsed, the state of Ukraine proclaimed its independence …

Social Organization And Reproductive Behavior In Southern Ghana, Dominic K. Agyeman, John B. Casterline Jan 2002

Social Organization And Reproductive Behavior In Southern Ghana, Dominic K. Agyeman, John B. Casterline

Poverty, Gender, and Youth

The objective of this research is to examine the association between social organization and reproductive behavior in one setting in sub-Saharan Africa. The particular focus is on the effects of social organization on the diffusion of innovative reproductive ideas and behaviors. Social diffusion is assumed to be strongly affected by patterns of informal social interaction, and these in turn are assumed to be determined in part by the social organization of local communities (gender relations, employment activity, voluntary organizations). The research draws on data collected in six communities in southern Ghana. The analysis reveals a weaker than expected association between …

Catalunya Invisible: Contemporary Drama In Barcelona, Sharon G. Feldman Jan 2002

Catalunya Invisible: Contemporary Drama In Barcelona, Sharon G. Feldman

Latin American, Latino and Iberian Studies Faculty Publications

During the winter of 2000, Lluís Pasqual staged a Catalan version of Anton Chekov's The Cherry Orchard at Barcelona's Teatre Lliure, the historic home of Catalonia's most stable, accomplished, and distinguished repertory theatre company. In Chekov's play, Madame Lyobov Andreyevna Ranyevskaya, an emblem of the fading elegance and dwindling supremacy of the Russian aristocracy, is compelled by her situation of financial despair to sell her estate and cherry orchard to the nouveau-riche Lopakhin and then return to Paris on the eve of the Revolution. The orchard that was once admired for its beauty eventually will be destroyed in order to …

A Word-And-Flesh Profession: A Response To White And Brueggemann, Marie Failinger Jan 2002

A Word-And-Flesh Profession: A Response To White And Brueggemann, Marie Failinger

Faculty Scholarship

Speech remakes the world through a relationship among words, speaker, and hearer. On one hand, this view of the human encounter as essentially rhetorical precludes an understanding of speech as purely subjectivist or emotivist self-expression. On the other hand, this same view of human speech interaction precludes the understanding of speech acts as mere descriptions of previously discovered or reasoned truth, either empirical or abstract. Professor White reaffirms this triad among words, speaker, and hearer with what he has identified as the “deeply reciprocal” dynamic of language. Professor Brueggemann also describes the speech acts between Moses, Abraham, and their God …

We Know More Than We Are, At First, Prepared To Acknowledge: Journeying To Develop Critical Thinking, Peter John Taylor Jan 2002

We Know More Than We Are, At First, Prepared To Acknowledge: Journeying To Develop Critical Thinking, Peter John Taylor

Working Papers in Critical, Creative and Reflective Practice

Exponents of critical thinking emphasize the teaching of skills and dispositions for scrutinizing the assumptions, reasoning, and evidence brought to bear on an issue by others and by oneself. In short, they promote thinking about thinking. But how do students come to see where there are issues to be opened up and identify them without relying on some authority? The current form of my evolving "answer" is that people need support to grapple with inevitable tensions in personal and intellectual development—support to undertake journeys that involve risk, open up questions, create more experiences than can be integrated at first sight, …

Igbo As An Endangered Language, Chukwuma Azuonye Jan 2002

Igbo As An Endangered Language, Chukwuma Azuonye

Africana Studies Faculty Publication Series

At first sight, the question "Is Igbo an endangered language," would appear to be grossly misplaced, since the survival of the language seems to be well guaranteed by its status both as one of the three main languages of Nigeria and one of the major languages of literature, education, and commerce in Africa. Furthermore, with its well over 25 million native speakers who live in one of the most densely populated areas of the world with an exceptionally high fertility rate and a traditional world view and culture that promote the raising of large families, it would appear that there …

The Ballad Of Transborder Arbitration, Thomas E. Carbonneau Jan 2002

The Ballad Of Transborder Arbitration, Thomas E. Carbonneau

Faculty Scholarship

International commercial arbitration (ICA) is many things positive. Because business transactions cannot take place without a functional system of adjudication,ICA has enabled parties to engage in and pursue international commerce. As a result, it has had an enormous impact upon the international practice of law, the structuring of a de facto international legal system, and the development of a substantive world law of commerce. In a word, ICA has been a vital engine in the creation of a transborder rule of law. Furthering this design, the arbitral "method"has even been applied to the unruly political problems that attend international trade …

Forensic Interviews Of Children: The Components Of Scientific Validity And Legal Admissibility, Nancy E. Walker Jan 2002

Forensic Interviews Of Children: The Components Of Scientific Validity And Legal Admissibility, Nancy E. Walker

Law and Contemporary Problems

The problems associated with assessments of children's reports of victimization in criminal proceedings came to national attention during the 1980s and 1990s in a series of highly publicized trials of daycare staff. Walker describes information that professionals need to know if they are to conduct valid interview of children in forensic contexts.
