Progressive Race Blindness: Individual Identity, Group Politics, And Reform, Darren L. Hutchinson
Progressive Race Blindness: Individual Identity, Group Politics, And Reform, Darren L. Hutchinson
Faculty Articles
This Article responds to the advocates of "progressive race blindness" with several critiques of their central claims. Part I examines the contours of progressive race blindness in greater detail, giving centrality to the emergence of this theory in legal scholarship. Part I sets forth the common themes articulated in progressive race blindness arguments and highlights important differences among its proponents. Part II isolates several problems with the progressive race blindness literature and demonstrates that these weaknesses make the literature unhelpful as a political or legal theory and even dangerous to the cause of antiracism. Part III offers suggestions for future …
Federalism, Treaties, And International Human Rights Under The Canadian Constitution, Jamie Cameron
Federalism, Treaties, And International Human Rights Under The Canadian Constitution, Jamie Cameron
Articles & Book Chapters
This article explores the relationship between federalism, treaties, and international rights under the Canadian Constitution. A comment on comparative analysis precedes the introduction to that project. Recognizing that the similarities and differences that distinguish federal states offer a distinctive source of insight, the discussion draws on American parallels when feasible. Even so, the article's main objective is to explain how Canada ratified and implemented international instruments in the face of the significant restrictions on the national government's treaty power. In general terms, after analyzing a constitutional jurisprudence that subordinated sovereignty in foreign relations to principles, of federalism, the article explores …

Measured Interpretation: Introducing The Method Of Correspondence Analysis To Legal Studies, Bernard E. Harcourt
Measured Interpretation: Introducing The Method Of Correspondence Analysis To Legal Studies, Bernard E. Harcourt
Faculty Scholarship
Professor Harcourt develops and advocates a method to more rigorously measure and evaluate how qualitative “social meaning” variables relate to legal practices and public policies. The method integrates in-depth qualitative interviews with an experimental free associational component, map analysis of the interviews, and a methodology, correspondence analysis, that remains little known in the United States despite its acceptance in other parts of the world. Correspondence analysis, according to Professor Harcourt, is a tool that allows researchers to visually represent the relationship between structures of social meaning and the contexts and practices within which they are embedded. This method opens up …
The Relationships Between Attitude, Motivation, Anxiety, And Proficiency In English As A Second Language Of First-Year University Students In Puerto Rico, Carmen Mercedes Cortés
The Relationships Between Attitude, Motivation, Anxiety, And Proficiency In English As A Second Language Of First-Year University Students In Puerto Rico, Carmen Mercedes Cortés
Dissertations
Purpose of the study. The purpose of this study was to determine the attitudes, motivation, and anxiety levels of first-year university students toward the learning and use of English as a second language. The study also examined the nature of the relationships between attitudes, motivation and anxiety, and English proficiency asmeasured by the College Entrance Examination Board.
Method. A Spanish version of The Attitudes/Motivation Test Battery (Gardner, 1985a), "Espejo de Actitudes: Aprendizaje del Inglés como Segundo Idioma en Puerto Rico," was administered to first-year college students at the University of Puerto Rico, Mayagüez Campus. These students came from various …

A Linguistic Evaluation Of The Somali Women's Self Sufficiency Project, Ann Marie Kasper
Dissertations and Theses
This thesis evaluated a program of the Lutheran Community Services of Oregon, an English as a Second Language training program for Somali refugee women. This study examined the English test results and questionnaires of 28 pairs of Somali women and North American volunteers involved in tutoring. The evaluation included communicating with the Somali women, North American tutors, and Lutheran Community Services staff. The researcher created a literacy test, piloted it, and created questionnaires with the assistance of the staff. Before the tutoring began, the researcher created a needs assessment for the Somali participants and visited each Somali woman's home with …
The Development Of The Concept Of Salvation In Lutheran And Seventh-Day Adventist Parochial, Secondary-School Students, Megan G. Brown
The Development Of The Concept Of Salvation In Lutheran And Seventh-Day Adventist Parochial, Secondary-School Students, Megan G. Brown
Dissertations
Problem. This study took an initial look at the development of the concept of salvation in Lutheran parochial school adolescents, comparing them with Seventh-day Adventist (SDA) parochial school adolescents. This was the first study to compare denominations using the Salvation Concept Interview (SCI).
Method. This study was descriptive and comparative. The SCI was used to interview 16 Lutherans and 21 SDAs ages 15 to 18. Subjects also completed a religious activities survey and a drawing. Parents completed a survey of demographic data and personal and family religious activities. Data were analyzed qualitatively and quantitatively.
Results. The concept …
Teaching Children To Understand And Remember Information They Can Use Now And Later, Patricia Vespa
Teaching Children To Understand And Remember Information They Can Use Now And Later, Patricia Vespa
Honors Capstones
The purpose of researching various methods is to plan for future instruction. Children listen to learn language, and their listening vocabulary is far greater than their speaking or writing (Farris, 200l p.13). Listening to expository science books with new words encourages new vocabulary. Adults and children use drawings and symbols to communicate a variety of information effectively. I wanted to see how much information students comprehended, and also if they preferred drawing or writing to communicate it. Since they could do either or both in the same time frame, comparisons could be made as to which they preferred. I also …

A Preferred Vision For Administering Elementary Schools : A Reflective Essay, Tony R. Hiatt
A Preferred Vision For Administering Elementary Schools : A Reflective Essay, Tony R. Hiatt
Graduate Research Papers
Each day, various sources of input develop innovative ideas that could have a positive impact on education, and it is vital that all professional members of education listen to the ideas that are produced and reflect on them. Educators make these contributions by keeping an open mind and maximizing opportunities for children to grow socially and academically through positive experiences during their lives.
In education, we are preparing young people to practice life skills effectively in order to make a community a safe, pleasant place for everybody to live. As an administrator, I hope to serve as an educational leader …
Afterword: The Role Of The Competition Community In The Patent Law Discourse, Hillary Greene
Afterword: The Role Of The Competition Community In The Patent Law Discourse, Hillary Greene
Faculty Articles and Papers
The Federal Circuit is the most visible point of the intersection between competition and patent law. When a single case contains both competition and patent issues, precedents of that court, including those pertaining to governing legal burdens or presumptions, will be critical. It is worth considering whether and how actual or assumed consumer welfare trade-offs are reflected in those decisions. Additionally, the basic decision to confer patents, and the attendant choices regarding their breadth, scope, and other aspects, also reflect social value judgments that directly implicate competition. The competition community can help both to focus attention upon and to illuminate …
Burning Down The House: Does Limiting The Innocent Spouse's Right To Recovery Make Sense, Ronald S. Ribaudo
Burning Down The House: Does Limiting The Innocent Spouse's Right To Recovery Make Sense, Ronald S. Ribaudo
Missouri Law Review
Homeowners purchase property insurance to protect themselves from fortuitous yet foreseeable risks, such as lightning strikes, poor electrical wiring, and perhaps, even arson by a stranger. One risk not anticipated is that one’s spouse would intentionally damage or destroy the family home. When this happens, is there coverage? This Note argues that the Missouri Court of Appeals for the Western District of Missouri’s decision in DePalma v. Bates County Mutual Insurance Co. establishes a per se rule of recovery that is flawed in two respects. First, it is inconsistent with the court’s claim that the policy language controlled the court’s …

The Effectiveness Of Mainstreaming Special Needs Students With Regular Students In A High School Classroom Setting, Michael A. Maciejewski
OTS Master's Level Projects & Papers
The goals of this study were to answer the following questions: 1. Are special needs students as successful in a regular classroom setting as other students are? 2. Do special needs students work and learn as well as other students in a regular classroom setting? 3. Do special needs students respond to the various teaching methods as well as other students? 4. Do special needs students respond to media and training aids as well as other students? 5. Is mainstreaming special needs students in a regular classroom setting successful overall or should other improvements be made?
Integrating Academic And Non-Academic Instruction For Students With Emotional/Behavioral Disorders, Robert A. Gable, Jo M. Hendrickson, Stephen W. Tonelson, Richard Van Acker
Integrating Academic And Non-Academic Instruction For Students With Emotional/Behavioral Disorders, Robert A. Gable, Jo M. Hendrickson, Stephen W. Tonelson, Richard Van Acker
Communication Disorders & Special Education Faculty Publications
Students with emotional/behavioral disorders exhibit a wide range of academic and behavioral problems. Not surprisingly, there is growing support for integrating instruction to address overlapping students' needs in both areas. In this article, we discuss instructional variables that contribute to a positive classroom climate and that serve as setting events for more focused group-individual instructional programs. We draw on the accumulated research to identify common non-academic challenges that should be incorporated into those programs. We examine issues that relate to the efficacy of instruction and also the cultural and chronological age differences among students and how they relate to planning …
The Subject Of Linguistic Analysis: Competence, Performance, Style, Hector A. Torres
The Subject Of Linguistic Analysis: Competence, Performance, Style, Hector A. Torres
English Language and Literature Faculty Publications
The competence and performance distinction has a complex history in linguistic theory. With this short essay, I would like to step into the flow of that complex history by posing the question of difference, which asks what difference difference makes to linguistic theory. My argument will be that the difference difference makes can be registered through the design feature of language liguistic theory dubs reflexivity. For linguistic theory, reflexivity is not just one design feature among the others inasmuch as it is reflexivity itself that motivates the question of difference.

Neutrosophy, A New Branch Of Philosophy, Florentin Smarandache
Branch Mathematics and Statistics Faculty and Staff Publications
In this paper is presented a new branch of philosophy, called neutrosphy, which studies the origin, nature, and scope of neutralities, as well as their interactions with different ideational spectra. The Fundamental Thesis: Any idea is T% true, I% indeterminate, and F% false, - where T, I, F are standard or non-standard subsets included in ]0-, 1+[. The Fundamental Theory: Every idea tends to be neutralized, diminished, balanced by ideas (not only , as Hegel asserted) - as a state of equilibrium. Neutrosophy is the base of neutrosophic logic, a multiple value logic that generalizes the fuzzy logic, of neutrosophic …

In 1960s Abraham Robinson has developed the non-standard analysis, a formalization of analysis and a branch of mathematical logic, that rigorously defines the infinitesimals. Informally, an infinitesimal is an infinitely small number. Formally, x is said to be infinitesimal if and only if for all positive integers n one has xxx < 1/n. Let &>0 be a such infinitesimal number. The hyper-real number set is an extension of the real number set, which includes classes of infinite numbers and classes of infinitesimal numbers. Let’s consider the non-standard finite numbers 1+ = 1+&, where “1” is its standard part and “&” its non-standard part, …
Continuity In Dynamic Coalition Operations, Holly A. H. Handley, Larry K. Wentz, Alexander H. Levis
Continuity In Dynamic Coalition Operations, Holly A. H. Handley, Larry K. Wentz, Alexander H. Levis
Engineering Management & Systems Engineering Faculty Publications
The combination of participating organizations in a coalition operation often changes over time; the coalition is dynamic and evolves over the course of its mission. A given organization may participate in the coalition only at the stage where its expertise or resources are most needed, while other organizations may participate through the entire course of the operation. As these are independent organizations coming together for a limited time to meet a specific goal, the structure of the coalition must be able to accommodate the different command arrangements, procedures, and other characteristics of each organization. In order to develop a theory …

Jose Marti's Ismaelillo: An English Translation, Tyler Fisher
HIM 1990-2015
Few figures in the history of the Americas are surrounded with more colorful lore and acclamation than the Cuban politician, teacher, patriot, and poet Jose Marti. Among Marti's literary contributions, his Ismaelillo, a collection of fifteen poems published in 1882, claims prominence as both Marti's first book of poems and as a seminal Latin American text. Celebrated for its sincere communication of paternal love and lauded as the genesis of Hispanic literary modernism, Ismaelillo captures the longing of an exiled father separated from his son and homeland. Its language is at once evocative of classical Spanish literature and innovative, incorporating …
