A Feedback Loop Of Exclusion: The Treatment Of Bilingualism In The Courtroom, Simone Stover

Northwestern University Law Review

In the 1991 case Hernandez v. New York, the United States Supreme Court characterized bilingualism as a race-neutral trait that can be used to exclude individuals from jury service. This Note proceeds by demonstrating how the current state of the law undermines the interests of bilingual individuals and then proposes a solution. Focusing specifically on Hispanic bilingual Spanish speakers, this Note first employs Professor Jennifer Lackey’s multi-directional credibility model to show that bilingual Spanish speakers suffer injustice in the courtroom due to both credibility deficits and excesses. The research questions in this essay ask whether or not the Nebraska State Archives contains literature in the Russian and Spanish languages. These documents, and others written in English on the same topic, are introduced and analyzed throughout the essay, exploring the history of immigrants from Russia and Latin America. As well as history, the documents delve into the current state of these immigrant groups, and how their traditions have changed Nebraska and continue to influence it today. Luis Jiménez’s Southwest Pietà (1984) intended to combat cultural amnesia that obscured Native Americans’ and Mexicans’ contributions to the state. Jiménez’s Pietà sought to counter the iconography that shaped New Mexico’s colonialist heritage. But Old Town Albuquerque shrouds Native American and Mexican contributions to the region. Albuquerque’s public art has often been deployed as a wedge to write and rewrite narratives about land inhabitants, but the city’s public art tells a powerful story about race and place in New Mexico. Christ Child Bearing the Instruments of the Passion (acc.# 228017) is a 17^th century Peruvian Viceregal painting on copper belonging to the Carl & Marilynn Thoma Art Foundation. The painting depicts the Christ Child on a flower laid path as he carries the instruments of the passion also known as the Arma Christi Paintings executed on copper convey new and challenging preservation issues based on their materials and techniques.. The work had been heavily restored and exhibited several condition issues, including significant overpaint and broad losses.
