Moral Limits Of Dworkin's Theory Of Law And Legal Interpretation, David B. Lyons
Faculty Scholarship
At the foundation of Justice for Hedgehogs is a commitment to moral objectivity – the doctrine that there are right answers to moral questions. This nicely complements Dworkin’s legal theory, which holds that right answers to legal questions depend on right answers to moral questions. Without the doctrine of moral objectivity, Dworkin could not reasonably maintain, as he does, that law provides determinate answers to legal questions.

Attending To Presence: A Study Of John Duns Scotus' Account Of Sense Cognition, Amy F. Whitworth
Dissertations (1934 -)
This project is guided and motivated by the question concerning the nature of the phantasm as that which mediates between sensation and intellection in John Duns Scotus' account of cognition. Scotus embraces Aristotle's claim that the intellect cannot think without the phantasm. The phantasm is in a corporeal organ, yet the immaterial intellect must act with it to produce an intelligible species. In this project I examine the critical elements of Scotus' cognitive theory in order to understand the nature of the phantasm.
In the first chapter I discuss key elements of Aristotle's metaphysics and give a close, textual reading …
The Attestation Of The Self As A Bridge Between Hermeneutics And Ontology In The Philosophy Of Paul Ricoeur,

The Attestation Of The Self As A Bridge Between Hermeneutics And Ontology In The Philosophy Of Paul Ricoeur, Sebastian Kaufmann
Dissertations (1934 -)
Ricoeur defines attestation as the "assurance of being oneself acting and suffering" or as the "assurance - the credence and the trust - of existing in the mode of selfhood." In this dissertation I discuss the concept of attestation in Ricoeur's philosophy in relation to the main dimensions of the self: Capacities, personal identity, memory and otherness. I state that attestation is the key to the three dialectics of Ricoeur's hermeneutics of the self: The dialectic between reflection and analysis, the dialectic between idem-identity and ipse-identity and the dialectic between oneself and other. In these three dialectics, attestation, as the …

Arabic Influences In Aquinas's Doctrine Of Intelligible Species, Max Herrera
Dissertations (1934 -)
In contemporary literature, one can find much information concerning Thomas Aquinas's doctrine of intelligible species. However, none of the literature takes into account how and why Aquinas developed his doctrine of intelligible species. Often, it is purported that Aquinas is just following Aristotle. However, this is not the case. There are aporiae in the Aristotelian corpus, and those who followed Aristotle tried to resolve the intellection and hylomorphism aporia, an aporia that arose as a result of denying Platonic forms and affirming hylomorphism. Among those who attempted to resolve this aporia were Avicenna and Averroes from whom Aquinas drew and …

Historicity And Ecological Restoration, Eric Desjardins
Research Day (Arts & Humanities, FIMS, and Education)
Traditional ecological restoration often relies on ideals of reversibility and balance of nature. I suggest that we should change these for a path-dependent view of natural processes. This conceptual shift also invites for philosophical and methodological revisions, such as favouring “futuristic” dynamic goals and alternative state models.

Idealization In Scientific Explanation, Robert Batterman, Nicolas Fillion, Robert Moir, James Overton
Research Day (Arts & Humanities, FIMS, and Education)
Many phenomena pose interesting “fundamental” questions for both physics and philosophy of science. Understanding and explanation often seem to require non-Galilean, essential idealizations. But idealizations are false. This fact suggests that we need to give up on the view that truth is a necessary condition for explanation.

The Logical Structure Of Dreams And Their Relation To Reality, Jeremy Barris
Humanities Faculty Research
The contradictions and non sequiturs often found in dreams (or, equivalently, dream-narratives) are not in fact logical errors, but express and work with a type of logic that characterizes the deepest dimensions of our waking reality. These are the dimensions in which we deal with ourselves as a whole, our lives as a whole, or with the sense of reality as a whole. We do so, for example, in situations of deep personal transformation, or of recognition of deep difference of outlook. The paper argues that the logic of these situations is validly one of contradiction and non sequitur, that …

On The Status Of Women In Philosophy
Articles and Chapters in Academic Book Collections
Most of the time and in the most important and everyday ways, the status of women in philosophy departments is nugatory. But as opposed to projects proposing to “socialize” or "domesticate" men in the hopes of thereby changing the culture of university or academic philosophy (a bootless undertaking in the barest empirical sense), I submit that one might better extend the traditional privileges of intellectual preoccupation and distraction (and so on) to women professors of philosophy and not only to men as those who currently profit from just these privileges. In addition to a limited discussion of men’s shoes, the …

Copyright's Derivative Works Doctrine And An Upside-Down Proviso, Wendy J. Gordon
Scholarship Chronologically
It is sometimes observed that questions of "justice in acquisition" do not much arise any more. However, judges face those questions on a daily basis in courtrooms adjudicating copyright and patent matters. In United States copyright law, for example, an intriguing dilemma regarding derivative works has developed that raises what appears to be a new issue regarding John Locke's sufficiency proviso.

Culture, Acculturation, And Social Capital: Latinos And Use Of Mental Health Services, Edward Mcfield Jr.
Loma Linda University Electronic Theses, Dissertations & Projects
Studies suggest that the prevalence of mental illness in Latinos is similar to that of other groups; however, Latinos are less likely than non-Latino whites to access mental health services, and when they do, the quality of care is poor. To better understand the factors that influence use of mental health services among Latinos, a descriptive, cross-sectional, correlational study was conducted (N= 340; 219 non-consumers and 121 consumers), which examined the association between social capital, acculturation, cultural beliefs or explanatory models of illness, stigma, need, and mental health service use. An innovative integrative model drawing from Andersen's Behavioral …
