The Nonexceptionalism Thesis: How Post-9/11 Criminal Justice Measures Fit In Broader Criminal Justice, Francesca Laguardia

Contrary to the assumption that ‘‘9/11 changed everything,’’ post-2001 criminal justice practices in the area of terrorism show a surprising consistency with pre-2001 criminal justice practices. This article relies on an analysis of over 300 terrorism prosecutions between 2001 and 2010, as well as twenty full trial transcripts, content-coding, and traditional legal analysis, to show the continuity of criminal justice over this time in regard to some of the most controversial supposed developments. This continuity belies the common assumption that current extreme policies and limitations on the due process are a panicked response to the terror attacks of 2001. On …

All these power dynamics are historically-situated within the cultural context and community of Hangberg, a place forged by the race-based forced removals of Apartheid. British and Dutch colonization, Apartheid's racial regime, and the post-Apartheid oligarchical state, are all historical and contemporary authoritative forces that are impacting the everyday lives of people in Hangberg. In this thesis, I explore what accounts for worker consent to precarious employment in the context of rapid industrial change in the rural United States. In recent years, domestic oil development has transformed the landscape of western North Dakota and Eastern Montana into a zone of oil production now known as “the Bakken.” The acute demand for labor brought about by this development resulted in vastly inflated wages, which in turn drew workers from around the U.S. and the world. The purpose of this dissertation is twofold: first, to explore the relevance of environmental gentrification, a concept largely applied to urban settings, as a means to understand social change in rural and small town Appalachia; and secondly, drawing upon political economy perspectives within environmental sociology and the tradition of early Frankfurt School critical theory, to contextualize the process of environmental gentrification within global capitalism. After working through an elaboration of entropy, I explore its relevance to social life through an eclectic but necessary survey of a key set of scholars whose work focuses upon the sacrifice and criminalization of the poor, the intensification of exclusion and genocidal contexts, and finally, the possibility of a politics of change through indigenous knowledges. We address how enterprise is related to, another important discourse, strategy. From a discourse analysis of the talk of small firm owner-managers, emerges a view of strategy and enterprise as a single, integrated entity, bound together by some commonalities but more importantly by paired opposites reminiscent of ideological dilemmas (Billig, Condor, Edwards, Gane, Middleton & Radley, 1988). The present analysis of the Euro looks for the marks that function systems make on what we commonly take for the European money. Clearly distinguishing between coins and currency, the Euro coins and banknotes are not taken for economic tokens per se but for storage devices that contain both economic and noneconomic information. A systemic analysis of the function system references on these storage devices shows that the economy has left fewer marks on the Euro than politics, art, and the mass media systems have. This paper examines how people mobilize around notions of distributive justice, or ‘moral economies’, to make claims to resources, using the process of post‐socialist land privatization in the Mekong Delta region of southern Vietnam as a case study. First, I argue that the region's history of settlement, production, and political struggle helped to entrench certain normative beliefs around landownership, most notably in its population of semi‐commercial upper peasants. I then detail the ways in which these upper peasants mobilized around notions of distributive justice to successfully press demands for land restitution in the late 1980s, drawing on Vietnamese newspapers and …

To what degree does instrumental reason influence election news coverage? Using Habermas's understanding of system/life-world as a heuristic, I map the rationalization process of political communication. This illuminates the institutional logics at play in the field of politics and the field of journalism, and the way the social dynamics between them enable the framing of political life as a strategic game. This understanding is then contextualized within an analysis of the media frames that informed the Canadian federal election of 2011. Why are most capitalist enterprises of any size organized as authoritarian bureaucracies rather than incorporating genuine employee participation that would give the workers real authority? Even firms with employee participation programs leave virtually all decision-making power in the hands of management. The standard answer is that hierarchy is more economically efficient than any sort of genuine participation, so that participatory firms would be less productive and lose out to more traditional competitors. The 2010 BP Deepwater Horizon oil spill in the Gulf of Mexico awakened communities to the increased risk of large-scale damage along their coastlines presented by new technology in deep water drilling. Normal accident theory and high reliability theory offer a framework through which to view the 2010 spill that features predictive criteria linked to a qualitative assessment of risk presented by technology and organizations. Item generation has received only cursory attention in the research literature, despite the fact that it seems obvious that poorly written items will result in poor psychometric properties of measures. In this paper, we review the literature on item generation, develop a typology of threats to construct validity, and evaluate five commonly usedorganizational research measures with respect to typology. Our results demonstrate that the sampled measures have significant problems that may represent threats to construct validity. recommendations for improved item generation practice are offered.

This short nontechnical article reviews the Arrow Impossibility Theorem and its implications for rational democratic decisionmaking. In the 1950s, economist Kenneth J. Arrow proved that no method for producing a unique social choice involving at least three choices and three actors could satisfy four seemingly obvious constraints that are practically constitutive of democratic decisionmaking. Any such method must violate such a constraint and risks leading to disturbingly irrational results such and Condorcet cycling. When “one of our own” commits mass murder, mechanisms that sustain our social order are opened to question. Based on two samples of newspaper editorials written in 1995 ‐ either after the poison gas attack in the Tokyo subway or after the Oklahoma City bombing ‐ evidence is provided that Japanese editorialists advised strategies for retaining order, whereas Oklahoman authors endorsed ones for reestablishing it. In accordance with Simmel’s distinction between faithfulness and gratitude as social forms, Japanese advised faithful continuation of wholesome interactions with their terrorists, whereas Oklahomans expressed gratitude for rescue workers’ assistance. Purpose: The purpose of this study was to examine the associations between nursing home administrator (NHA) leadership style and staff turnover.

Design and Methods: We analyzed primary data from a survey of 2,900 NHAs conducted in 2005. The Online Survey Certification and Reporting database and the Area Resource File were utilized to extract organizational and local economic characteristics of the facilities. A general linear model (GLM) was used to estimate the effects of NHA leadership style, organizational characteristics, and local economic characteristics on nursing home staff turnover for registered nurses (RNs), licensed practical nurses (LPNs), and nurse’s aides (NAs).
