For more than half a century, the retributivists and the crime-control instrumentalists have seen themselves as being in an irresolvable conflict. Social science increasingly suggests, however, that this need not be so. Doing justice may be the most effective means of controlling crime. Perhaps partially in recognition of these developments, the American Law Institute's recent amendment to the Model Penal Code's "purposes" provision – the only amendment to the Model Code in the 47 years since its promulgation – adopts desert as the primary distributive principle for criminal liability and punishment. Criminal Offending Among Respondents To Protective Orders: Crime Types And Patterns That Predict Victim Risk, Carol E. Jordan, Adam J. Pritchard, Danielle Duckett, Richard Charnigo

Office for Policy Studies on Violence Against Women Publications

Research has shown that respondents to protective orders have robust criminal histories and that criminal offending behavior often follows issuance of a protective order. Nonetheless, the specific nature of the association between protective orders and criminal offending remains unclear. This study uses two classes of statistical models to more clearly delineate that relationship. The models reveal factors and characteristics that appear to be associated with offending and protective order issuance and provide indications about when a victim is most at risk and when the justice system should be most ready to provide immediate protection.

Academic disciplines have been characterized as static institutions that do not change or conform to outside forces. Abbott (1999) and Silbey (2000) have discussed this issue in relation to how the history of refereed journals in the social sciences can provide information on department, institution, and disciplinary changes that often wear a false guise of continuity. This paper analyzes the content of Criminal Justice Policy Review by replicating the methodology Silbey (2000) used to study the content of Law & Society Review in terms of editorship, authorship, article contents, method and mode of research, and article topics. Intimate partner violence (“IPV”) victims are increasingly turning to the courts for help, too often with poor results. Successful witness tampering by offenders sabotages the court system by silencing victims through an array of unlawful conduct, including coercion and violence. The doctrine of forfeiture by wrongdoing should afford a viable solution, but several obstacles constrain its efficacy. Much confusion exists regarding witness tampering and forfeiture law as a result of the recent trilogy of the Crawford, Davis, and Giles Supreme Court decisions. Adolescent females are becoming the fastest growing population amongst juveniles being held in detention and referred to juvenile courts. Unfortunately such increases are linked to a lack of alternative services available for youths during the adjudication process. Upon being arrested, delinquent girls are suffering from a host of health, emotional and social issues for which there is also a lack of programming and detailed research. However, emerging evidence indicates that female delinquency is characterized by a multitude of overlapping problems that distinguish them from male delinquents. Sex, Drug Courts, And Recidivism, Doria Nour Dandan

Research studies have identified gender differences in the drug abusing patterns and treatment needs of men and women. Even so, studies on the drug court model have not assessed drug court effectiveness across sex. Using secondary data collected from the Ada County Drug Court, the recidivism rates of drug court participants (n=259) and probationers (n=235) were analyzed. Drug court participants were found to be less likely to recidivate compared to probationers, which supports previous research on drug court effectiveness. Regression analyses failed to find an interaction between group membership and sex, thereby indicating that the effect of the drug court …

High levels of violent crime and disorder area concentrated within certain neighborhoods of northwest Las Vegas, Nevada. In April 2009 a police order-maintenance unit designed to reduce minor and major offenses was initiated in these areas. Drawing on the Broken Windows Hypothesis, the unit combined detailed crime analysis with extensive police efforts to address specific community problems. This paper discusses the implementation and impact of the police order-maintenance unit during its operation.

Predicting Police Discretion: A Traffic Stop Analysis, Andrew Girard

Examines Donald Black's (1976) theory of pure sociology with data from traffic stops collected over eight months during seventy hours of "ride alongs" with eight different police departments in Rhode Island. Posits that the social structure of each traffic stop is predictable based on observable characteristics of the parties involved and that distance in social space increases the likelihood of a police officer issuing a citation to a driver, while social characteristics similar to that of the police officer reduces the likelihood of a driver receiving a citation. This study examines the individual- and institutional-level variables that are correlated with violence and disorder within a jail facility. Previous research indicates that deviant behavior is one of the main challenges that negatively impacts the safe and effective management of correctional facilities. While many studies have been conducted on prison populations, few studies have focused upon jail populations. Using official institutional data, this study explores the factors associated with general infractions and violent misconduct among a stratified random sample of inmates (n=447) incarcerated during a one year period in a large county jail facility. Sex offender registration laws are very controversial. All fifty states require adult sex offenders to register. Twenty-eight states have extended registration and community notification requirements to juveniles (Hiller, 1998). These states seem to have failed to look at the uniqueness of juvenile sex offending. Juveniles have a very low recidivism rate and complex issues of culpability from age-of-consent laws. Applying Megan's Law to juveniles could have considerable negative consequences for juveniles' social development, particularly because one of the main stipulations of the law requires the juvenile to notify their school. Since the shootings at Virginia Tech, academic institutions and police departments have dedicated substantial resources to alleviating concerns regarding campus safety. The incident in Blacksburg and the similar tragedy at Northern Illinois University have brought renewed attention to the prevention of violence at colleges and universities.

Campus professionals must assess the risk posed by known individuals, as well as by anonymous writers of threatening communications. The authors offer threat assessment and management strategies to address the increased demands faced by campus law enforcement, mental health, and administration officials who assess and manage threats, perhaps several simultaneously.

Recent research on social disorganization theory shows general support for economic and stability measures of disorganization, but spatial dispersions and the disaggregation of homicides of crime have not been fully examined. 1985-1995 homicide data from the El Paso Police Department's detective logs and US Census data are combined to explore social disorganization in El Paso, the impact of ports of entry, and how motive interacts with social disorganization. Findings for total homicides in El Paso support existing social disorganization research. Motive specific homicides displayed distinct relationships to the disorganization measures. This paper tells the story of Pesach Rubenstein and how he cheated the hangman in 1876. Rubenstein was charged, tried, and convicted in Kings County, New York, for the 1875 murder of his 19 year-old cousin, Sarah Alexander. The Rubenstein case is noteworthy in that it received unprecedented media attention in the 1870s, involved the use of rudimentary forensic evidence at the trial, and divided the community on issues of religion, ethnicity, immigration (the victim and defendant were recent Jewish immigrants from Poland), and imposition of the death penalty. There are no exhaustive statistics available on the crimes committed by law enforcement officers, and only a small number of studies provide specific data on police crimes. The purpose of the current study is to examine the character of police arrests known to the media. Cases were identified through a content analysis of news coverage using the internet-based Google^TM News search engine and its Google News Alerts search tool. The study focuses on the crimes committed by experienced officers who are approaching retirement.
