Diversity in the judiciary is essential to ensure impartiality, public confidence, and the perception that all members of society are represented on the bench. Minorities and women are significantly underrepresented as judges in Florida in proportion to their numbers in the general population. Because we live in an increasingly global world, diversity is best described when people of different races, colors, ethnicity and genders work to develop a mutual respect for each other. Written over fifteen years ago by Ivan Leigh Head, a highly distinguished Canadian international lawyer, foreign policy expert, and international development thinker, the words contained in the above quotation point firmly at this great man's analytic incisiveness and hint at the sheer depth of his fairness of mind. For although the net transfer of resources from the much poorer geopolitical "South" to a far richer "North" remains to this day one of the most important obstacles to international development, rarely have the dominant accounts of international development given this phenomenon the pride of place that it surely deserves.

After the collapse of the Soviet Union, the United States came to Eastern Europe spreading the gospel of democracy and the American Rule of Law. In addition to encouraging Western ideology, the United States was there to forge new economic relationships and, following the terrorist attacks of September 11, 2001, to accelerate the creation of military alliances through membership in the North Atlantic Treaty Organization (NATO) and the newly-formed "coalition of the willing." This article reviews the work of the Special Commission of the Hague Conference on Private International Law, which meet during the first nine days of December 2003 to consider a Draft Text on Choice of Court Agreements. Negotiations originally sought a rather comprehensive convention on jurisdiction and the recognition and enforcement of judgments, with a preliminary draft convention being prepared in October 1999, and further revised at the first part of a Diplomatic Conference in June 2001. When it became clear that some countries, particularly the United States, could not agree to the convention being considered, negotiations were redirected at …

This thesis examines the Judges Club of Egypt [JCE] between January 1985 and March 2004. My research demonstrates that Egyptian judges rely on the JCE as a space for defending democratic reform and the independence of the Judiciary in Egypt. I will argue that while several laws and internal regulations within the Egyptian judicial structure forbid judges from being involved in any political activity, Egyptian judges craft strategic discursive mechanisms for expanding the role of the JCE beyond its seemingly confined function within the court. A recent survey conducted in a sample of 83 countries by the Inter-Parliamentary Union in collaboration with the World Bank Institute on the Relations between the Legislature and the Executive in the Context of Parliamentary Oversight allows cross-national comparison for the role of legislatures in the budgetary process. One of the survey’s most significant indications is that legislatures in presidential systems are generally more involved in the preparation of the budget than legislatures in either parliamentary or semi-presidential systems. The picture, however, is very different when we look at legislatures’ oversight of the budget. Parliaments are generally more involved in …

We suggest a Tournament of Judges where the reward to the winner is elevation to the Supreme Court. Politics (and ideology) surely has a role to play in the selection of justices. However, the present level of partisan bickering has resulted in delays in judicial appointments as well as undermined the public's confidence in the objectivity of justices selected through such a process. More significantly, much of the politicking is not transparent, often obscured with statements on a particular candidate's "merit"- casting a taint on all those who make their way through the judicial nomination process. While American, British, and French reactions to the American Revolution are well-known, those of the German people are not, despite the presence of almost 30,000 German soldiers in America fighting for the British army and hundreds of German volunteers fighting for the American patriots. The participation of German soldiers on both sides of the conflict inspired numerous works of German poetry, prose, and drama, all largely forgotten in the wake of the French Revolution and the rise of German Classicism and Romanticism. Compellence: An Empirical Perspective, Michael G. Dziubinski

Compellence, the use of a contingent threat of force to get a target state to modify a behavior, is an understudied area of international relations. An empirical examination of this area reveals patterns of the frequency of attempted compellence and successful compellence that are not explained by current research or broader international relations theories. In the post-World War II period (1946–2001), the pattern is a rapid drop and continued suppression of success, but a continuation of compellence attempts at the historic level. Existing compellence research and international relations theory do not explain this puzzling disparity of low success and continued …

The market for sovereign debt differs from the market for corporate debt in several important ways including the risk of opportunistic default by sovereign debtors, the importance of political pressures, and the presence of international development organizations. Moreover, countries are subject to neither liquidation nor standardized processes of debt reorganization. Instead, negotiations between a sovereign debtor and its creditors lead to a voluntary restructuring of the sovereign's debt. One of the greatest difficulties in restructuring claims against sovereign debtors is balancing the interests of the majority of the creditors with those of minority creditors. Holdout creditors serve as a check …

This thesis examines issues that emerge from the investigation of the relationship between John Locke's arguments for religious toleration as found in his Letter Concerning Toleration and his construction of a minimum dogma for Christianity in his The Reasonableness of Christianity. The first chapter follows the development of minimum dogma from its origin in the experience Eric Voegelin terms the leap in being, through Xenophanes' concept of "seemliness," to the minimum dogmas of Plato. Access to health is an often-overlooked aspect of the right to health. Without practical access, the right to health becomes an empty promise. International human rights conventions and declarations do not directly mention access to health, but the above comment on the International Covenant on Economic, Social, and Cultural Rights does address the issue.

This dissertation is a study of the thought of Michael Oakeshott with particular emphasis on his writings about the character of religion and aesthetics. The dissertation as a whole makes the case that a certain moral vision-one informed by religious and aesthetic considerations-lies at the center of Oakeshott's thought and informs his political philosophy. The dissertation begins as an examination of Oakeshott's debts to St. Augustine and to British Idealist thinkers such as F. H. Bradley, and moves to a study of Oakeshott's own views on religion and aesthetics. It turns next to a consideration of Oakeshott's two essays entitled …
