Authorship, and hence, initial ownership of copyrighted works is oftentimes controlled by the 1976 Copyright Act’s work made for hire doctrine. This doctrine states that works created by employees within the scope of their employment result in the employer owning the copyright. One key determination in this analysis is whether the hired party is an employee or independent contractor. In 1989, the U.S. Supreme Court, in CCNV v. Reid, answered the question of how employees are distinguished from independent contractors by setting forth a list of factors courts should consider. While previous research has emphasized the role of political connections in facilitating entrepreneurial performance in China’ early reform period (1978 – 1999), this study argues that regional institutions had been increasingly conducive to entrepreneurial activities and, thus, also played a key role in China’s entrepreneurial success during that period. The structure of the American workplace depends on the ability to distinguish between employees and independent contractors. Unfortunately, the law provides little to guide employers in classifying workers. The legal tests to determine worker status are confusing, yield inconsistent results, and are not suited to the evolving employment relationship. Traditionally, courts examine the amount of control exerted over the putative employee by the employer: The more control exerted by the employer over the work, the more likely it is that the worker will be considered an employee. This quest is for pirate maps to blue oceans. The key problem involved is that blue oceans turn red whenever these maps make their way from pirates to mainstream entrepreneurs. Pirates therefore have an essential need for maps to the next blue oceans. In drawing on form theory, this article develops a map sheet, on which it appears that, throughout history, pirates navigated social borders. An analysis of the gaps in past and present maps of social differentiation then allows for the discovery of a largely uncharted quadrant of the blue ocean for entrepreneurship and entrepreneuring.

The purpose of this paper is to examine conflict management in exchanges in small firm networks which are embedded in the dense socio-economic exchanges that typify industrial districts. Informal conflict management strategies used by managers in vertical and horizontal, symmetrical and asymmetrical relationships are identified and analysed. The methodology chosen is that of in-depth semi-structured interviews with 22 small company owner/managers in an industrial district in the south-east of France. Interviews were conducted with a highly homogenous group of company managers of firms smaller than 50 employees. Based on the eclectic theory of entrepreneurship, this article analyzes macro-level determinants of national rates of formal versus informal entrepreneurship. Our evaluation of the factors identified in this theory reveals a set of empirically-testable, higher-order determinants: economic opportunities, quality of governance, macro-level resources and abilities, performance-based culture and socially-supportive culture. The results of our analysis obtained through the PLS (partial least squares) approach to structural equation modeling contribute to the entrepreneurship literature by providing an empirically-supported model that shows how formal and informal entrepreneurship are driven differently. During the 17th and 18th centuries, trade relations with the newcomers introduced to Aboriginal peoples: 1) capitalism; 2) the capitalist view toward land; 3) the exploitation of resources. This qualitative exploratory study seeks to present a deeper understanding of entrepreneurs of Indian ethnicity operating firms in the formal sector in Christchurch, New Zealand. Our over-arching guiding question was: Why do first generation ethnic minority immigrants become entrepreneurs? The literature is, however, biased on the US experience, lacks a comparative perspective between migrants and non-migrants and is primarily anecdotal in nature. In this paper, we explore mining in Arctic Canada from the perspective of the people on the communities there, in particular the Inuit, the pre-colonial people of the area. To do so, we first provide a brief overview of the history of mining in Canada including recent incursions into Nunavut.
