Women’S Organizations In Tunisia: Transforming Feminist Discourse In A Transitioning State, Caitlin Mulrine

On October 23rd, Tunisians voted in their first democratic election in the state’s history with much at stake after overthrowing the 23 year reigning dictator. As the era of Ben-Ali politics and social policy unraveled, Tunisians began to develop their own sophisticated political discourse as they collaborated to decide the direction of their state. Within this discourse, there emerged a sharp divide within the population, masked by Ben-Ali’s suppressive politics, over the issue of religion. Islamists, organized under Al-Nahda and other independent parties, stood in opposition to secularists who aimed to maintain a separation between religion and state. …

On Equality: The Anti-Interference Principle, Donald J. Kochan

This Essay introduces the “Anti-Interference Principle” – a new term on the meaning of equality, or at least one not yet so-named in the equality lexicon – as a necessary foundation for achieving the goal of true equality. Equality has a long-standing place in the discussion of politics and jurisprudence and remains a struggle of definition today. Rather than rehash the mass of scholarship, this Essay seeks to summarize the general equality concept, and propose that the legal discourse on equality center on a requirement that governmental power must protect and respect equal treatment and opportunity, unconstrained, not equal outcomes. …

In enacting the Defense of Marriage Act, Congress chose to protect heterosexual marriage because of its “deep and abiding interest in encouraging responsible procreation and child-rearing. Simply put, government has an interest in marriage because it has an interest in children.” Ironically, DOMA may harm, rather than protect, the interests of some children – i.e., the children of gay and lesbian couples.
Both state and federal law reflect the belief that children are better off being raised by two parents in an intact family. This belief is reflected in the marital presumption of paternity, which presumes that a married woman’s …

The approximately two million gay and lesbian elders in the United States are an underserved and understudied population. At a time when gay men and lesbians enjoy an unprecedented degree of social acceptance and legal protection, many elders face the daily challenges of aging isolated from family, detached from the larger gay and lesbian community, and ignored by mainstream aging initiatives. Drawing on materials from law, history, and social theory, this book integrates practical proposals for reform with larger issues of sexuality and identity.
