Do Racial Stereotypes Contribute To Medical Misdiagnosis Of Child Abuse? Investigating Tunnel Vision In The Emergency Room, Cynthia J. Najdowski, Kimberly M. Bernstein, Katherine S. Wahrer

Despite growing recognition that misdiagnoses of child abuse can lead to wrongful convictions, little empirical work has examined how the medical community may contribute to these errors. Previous research has documented the existence and content of stereotypes that associate race with child abuse. The current study examines whether emergency medical professionals rely on this stereotype to fill in gaps in ambiguous cases involving Black children, thereby increasing the potential for misdiagnoses of child abuse. Specifically, we tested whether the race-abuse stereotype led participants to attend to more abuse-related details than infection-related details when an infant patient was Black versus White. …

Then-Representative Jack Kemp and President Ronald Reagan originated the “safety net” conception of U.S. health and welfare laws in the late 1970s and early 1980s, defending proposed cuts to New Deal and Great Society programs by asserting that such cuts would not take away the “social safety net of programs” for those with “true need.” Legal scholars have adopted their metaphor widely and uncritically. This Article deconstructs the safety net metaphor and counsels against its use in understanding health and welfare laws. Police brutality and killings of Black Americans have recently sparked nationwide protests. Among the many expressions of anger and indignation, one stands out as a unique feature of this wave of the social movement: public scrutiny of civic symbols. Protestors have defaced, torn down, and called for the removal of monuments that represent our country’s racist past, as well as structural racial injustice today. วิทยานิพนธ์ “การประกาศรายชื่อบุคคลที่มีพฤติการณ์เกี่ยวข้องกับการก่อการร้ายเป็น “บุคคลที่ถูกกำหนด” ตามพระราชบัญญัติป้องกันและปราบปรามการสนับสนุนทางการเงินแก่การก่อการร้ายและการแพร่ขยายอาวุธที่มีอานุภาพทำลายล้างสูง พ.ศ. 2559 : กรณีศึกษาขบวนการแนวร่วมปฏิวัติแห่งชาติมลายูปัตตานี (Barisan Revolusi Nasional Melayu Patani หรือ BRN)” ฉบับนี้ มุ่งศึกษาเพื่อวิเคราะห์สถานการณ์การก่อเหตุความไม่สงบในพื้นที่จังหวัดชายแดนภาคใต้ ที่นำไปสู่ปรากฏการณ์การก่อการร้ายของขบวนการแนวร่วมปฏิวัติแห่งชาติมลายูปัตตานี (Barisan Revolusi Nasional Melayu Patani หรือ BRN) รวมถึงวิเคราะห์ผลกระทบตลอดจนแนวทางในการประกาศรายชื่อ BRN ให้เป็นบุคคลที่ถูกกำหนดในลักษณะที่เป็นกลุ่มองค์กร ตามพระราชบัญญัติป้องกันและปราบปรามการสนับสนุนทางการเงินแก่การก่อการร้ายและการแพร่ขยายอาวุธที่มีอานุภาพทำลายล้างสูง พ.ศ. 2559 ผลการศึกษา พบว่า การก่อเหตุความไม่สงบในพื้นที่จังหวัดชายแดนภาคใต้ของขบวนการแนวร่วมปฏิวัติแห่งชาติมลายูปัตตานี (Barisan Revolusi Nasional Melayu Patani หรือ BRN) คือ การก่อการร้าย ตามประมวลกฎหมายอาญาของไทย ซึ่งมีลักษณะความเป็นองค์กรอาชญากรรม ผลจากการประกาศรายชื่อ BRN ให้เป็นบุคคลที่ถูกกำหนด จะเป็นจุดเริ่มต้นในการนำมาตรการบังคับทางกฎหมายมาใช้กับกลุ่มองค์กรที่เกี่ยวข้องกับการก่อการร้าย อันมีผลให้สถานะของ BRN ถูกรับรองอย่างเป็นทางการโดยองค์กรที่ใช้อำนาจตุลาการ (ศาล) ว่าเป็นกลุ่มก่อการร้ายอันส่งผลต่อการระงับการดำเนินการกับทรัพย์สินของ BRN และข่ายงานผู้เกี่ยวข้องสัมพันธ์ มิให้มีการทำธุรกรรมด้วยประการใด ๆ หรือนำทรัพย์สินไปใช้ในการก่อการร้าย แต่หากพฤติการณ์ที่เกี่ยวข้องกับการก่อการร้ายได้เปลี่ยนแปลงไป ยังคงมีกลไกในการเพิกถอนรายชื่อออกจากการเป็นบุคคลที่ถูกกำหนดได้ตามกฎหมาย แนวทางในการประกาศรายชื่อ BRN ให้เป็นบุคคลที่ถูกกำหนด เจ้าหน้าที่ผู้สืบสวนสอบสวนจะต้องพิสูจน์ความเชื่อมโยงของสถานการณ์การก่อการร้ายในเหตุการณ์ต่าง ๆ ว่าเป็นการก่ออาชญากรรมโดยกลุ่มบุคคลในองค์กรอาชญากรรมเดียวกัน อันได้แก่ องค์กร BRN โดยพิสูจน์ทราบให้ได้ว่ามีเหตุอันควรสงสัยและมีพยานหลักฐานอันสมควรว่า กลุ่ม BRN มีพฤติการณ์ที่เกี่ยวข้องกับการก่อการร้ายหรือการสนับสนุนทางการเงินแก่การก่อการร้าย โดยนำมาตรการทางเลือก ได้แก่ ยุติธรรมเชิงสมานฉันท์, ยุติธรรมชุมชน เข้ามาประกอบการดำเนินการทั้งก่อนและหลังการประกาศรายชื่อกลุ่ม BRN เป็นบุคคลที่ถูกกำหนด เพื่อให้การป้องกันและปราบปรามอาชญากรรมก่อการร้ายของไทยมีประสิทธิภาพมากยิ่งขึ้นและเป็นต้นแบบในการดำเนินการกับองค์กรอาชญากรรมก่อการร้ายอื่นๆ ที่มีรูปแบบเดียวกันกับ BRN ต่อไป

Prior Discipline And Performance Among Police Officers: Does Organizational Fairness Matter?, Richard Helfers, Paul D. Reynolds, Jon Maskaly

Using a survey of police officers (n=1080) in a southern state of the USA, this study examines how overall performance is influenced by organizational fairness and prior disciplinary actions. In particular, this study focuses on the relationship between organizational treatment and officers’ self-acknowledged engagement in more innocuous forms of negative workrelated behaviors, general task performance, and extra-role behaviors. Results suggest prior disciplinary actions and organizational treatment are related to officer performance. Our findings highlight fair treatment’s relationship to enhanced prosocial activities and reduced negative work behaviors. Sculpting the Public Land Base in Northern Minnesota Counties: Past, Present and Future. This 3-article dissertation addresses the large public land base in the Arrowhead Region of Northern Minnesota. One fourth of all lands in the state are public lands, with the overwhelming majority located in the Arrowhead Region. These counties have anywhere from 30% to 92% public lands. The region relies heavily on a natural resource economy. Methodology for research includes secondary data analysis from several preexisting research projects and studies. The objective of this study was to assess the awareness of rural women on breast cancer and its screening methods in Southwest Nigeria. Descriptive cross-sectional survey design with the aid of a semi-structured questionnaire was used to generate data among 422 rural women in selected communities in Egbeda local government area of Ibadan. The qualitative data was generated through in-depth interviews among rural women and key informant interviews among health workers in the communities. The study revealed that only 63.7% were aware of breast cancer screening methods compared to 31.6% who were not aware of it. The commonly known screening …

การศึกษาเรื่อง "เหยื่อจากศัลยกรรมความงามและกระบวนการเยียวยาเหยื่อในประเทศไทย" นี้ มีวัตถุประสงค์เพื่อ 1) ศึกษาสถานการณ์การตกเป็นเหยื่ออาชญากรรมเกี่ยวกับศัลยกรรมความงาม 2) ศึกษากระบวนการเยียวยาผู้ตกเป็นเหยื่อการทำศัลยกรรมที่เกิดความผิดพลาด และ 3) ศึกษาแนวทางป้องกันและเยียวยาการตกเป็นเหยื่อศัลยกรรมความงาม งานวิจัยนี้เป็นการวิจัยเชิงคุณภาพ ทำการศึกษารวบรวมข้อมูลจากเอกสารวิชาการและข่าวที่นำเสนอในปี 2558-2562 ที่ปรากฏในสื่อ เก็บข้อมูลโดยวิธีการสัมภาษณ์เชิงลึกจากผู้ที่ตกเป็นเหยื่อจากการทำศัลยกรรมความงาม ซึ่งผู้ให้ข้อมูลสำคัญ คือ ผู้ที่ได้รับความเสียหาย ญาติและผู้ใกล้ชิดกับผู้ที่ได้รับความเสียหายจากการศัลยกรรมความงามจากหมอกระเป๋าและคลินิกศัลยกรรมความงาม จำนวน 5 คน รวมทั้งผู้เกี่ยวข้องกับกระบวนการเยียวยาผู้เสียหายจากการทำศัลยกรรมที่มีประสบการณ์ในการทำงานไม่น้อยกว่า 5 ปี รวมทั้งหมด 9 คน ในพื้นที่กรุงเทพมหานครและปริมณฑล ผลการศึกษาพบว่า สถานการณ์ความรุนแรงที่ผู้ตกเป็นเหยื่อได้รับผลกระทบที่ปรากฏให้เห็นภายนอกทั้งทางร่างกายและจิตใจตั้งแต่บาดเจ็บเล็กน้อย เสียโฉม พิการและเสียชีวิต อีกทั้งพบว่ารูปแบบการทำศัลยกรรมกับหมอกระเป๋าได้รับความนิยมในกลุ่มสาวประเภทสอง เพราะความต้องการตอบสนองด้านความงาม ต้องการเหมือนผู้หญิง เป็นส่วนสำคัญที่ผลักดันให้ทำศัลยกรรมความงาม ปัจจุบันความนิยมเหล่านี้ขยายวงกว้างในกลุ่มผู้หญิง เกือบทุกช่วงอายุ เนื่องจากอิทธิพลของกระบวนการสร้างอัตลักษณ์โดยใช้สื่อทางสังคม การโฆษณา การรีวิว และการบอกกันแบบปากต่อปาก การเยียวยาผู้ตกเป็นเหยื่อจากการศัลยกรรมความงามพบว่ามีการเยียวยาโดยสังคมผ่านทางสื่อโซเชียลมีเดีย องค์กรต่างๆที่ไม่หวังผลกำไร, การเยียวยาโดยคู่กรณีที่ก่อให้เกิดความเสียหายผ่านกระบวนการไกล่เกลี่ย และการบังคับตามคำพิพากษาของศาล ประกอบกับการเยียวยาโดยภาครัฐผ่านพระราชบัญญัติค่าตอบแทนผู้เสียหายและค่าทดแทนและค่าใช้จ่ายแก่จำเลยในคดีอาญา พ.ศ. 2544 และ การเยียวยาตามพระราชบัญญัติหลักประกันสุขภาพ พ.ศ.2545 ในมาตรา 41 ที่นำหลักการชดเชยความเสียหายโดยไม่ต้องพิสูจน์ความผิดมาใช้ แต่ยังไม่ครอบคลุมความเสียหายจากการทำศัลยกรรมความงาม ข้อเสนอแนะจากงานวิจัยเพื่อเป็นแนวทางป้องกันการตกเป็นเหยื่อศัลยกรรมความงาม คือ ควรเพิ่มช่องทางตรวจสอบใบอนุญาตประกอบกิจการสถานเสริมความงาม, การมีข้อกำหนดเกี่ยวกับคุณลักษณะของแพทย์ที่จะทำศัลยกรรมความงาม, การทำความเข้าใจระหว่างแพทย์และผู้รับบริการถึงขั้นตอนและวิธีการรักษา การผ่าตัด และผลกระทบ, มีการควบคุมข้อความที่ใช้โฆษณาของคลินิกศัลยกรรมให้มีความเหมาะสม, การประชาสัมพันธ์ให้ความรู้แก่ประชาชนถึงผลดีและผลเสียที่อาจเกิดขึ้นภายหลังการทำศัลยกรรมความงาม และการตรวจสอบแพทย์และคลินิกศัลยกรรมความงาม รวมทั้งการผสานการทำงานเชิงรุกของหน่วยงานภาครัฐและมีหน่วยงานกลางกำกับดูแลเฉพาะเรื่องศัลยกรรมความงาม และแนวทางการเยียวยาความเสียหายจากการทำศัลยกรรมความงาม คือ เพิ่มเติมข้อกำหนดในพระราชบัญญัติพระราชบัญญัติหลักประกันสุขภาพ พ.ศ.2545 ในมาตรา 41 ให้มีการชดเชยที่ครอบคลุมความเสียหายจากการทำศัลยกรรมความงาม, จัดให้มีการประกันภัยความรับผิดทางการแพทย์ หรือกองทุนเพื่อเยียวยากรณีเกิดความผิดพลาดจากการทำศัลยกรรมความงาม

Recent publications report that adults known as Generation Z, between the ages of 18 to 23, increasingly rely upon social media to gain knowledge of social issues. Given social media's embeddedness in Generation Z's life, this study sought to understand if or how social media has influenced and possibly empowered Generation Z to act on social issues, particularly global climate change. This study used a phenomenological research method, which focused on the commonality of Generation Z's lived experience. Researchers used state-level data on youth justice policies and practices to explore the association between state policy environments and recent changes in the use of residential placements for adjudicated youth (i.e., confinement). The study assigned a score to each of the 50 states based on the extent to which their youth justice policy environments could be considered "progressive" as opposed to punitive or regressive. Using data from the National Center for Juvenile Justice's compendium of justice system characteristics, "Juvenile Justice, Geography, Policy, Practice & Statistics" (JJGPS), the research team created an index that accounts for 16 policies that are more …

The current study adds some of the first light into the initial impacts of the largest global health crisis in a generation on family and domestic violence, the long-term repercussions of which may take decades to unpack. Statewide trends in juvenile arrests for domestic violence (DV)-related offending are examined, taking into account school closures for in-person learning in March 2020 and the subsequent mandate for an in-person learning option in Florida in August 2020. A group of Nepali diaspora members, represented by the Non-Resident Nepali Association (NRNA), started a campaign in 2009 to establish the Open University of Nepal (OUN) in partnership with the government of Nepal. Their motivation was to develop a quality university for the masses by mobilizing local, diaspora, and international collaborators for producing and disseminating knowledge in the public domain. The university was subsequently established in 2017 but it drifted away from many of the original objectives. Why do some countries have fewer women in parliament than do others? Recent studies find that women have less access to positions of political power in countries facing external threats. Exist-ing studies, however, do not differentiate between types of threat. We theorize that territorial threats are a particular driver of gender inequality in national parliaments. When a country’s land is under threat, people prefer having “tough” representatives in the national legislature who are competent on the military and defense moreso than when a country faces other threats. Critical race feminists call attention to the ways in which multiple and overlapping forms of privilege and discrimination shape individual experiences and perspectives. In this article, we argue that judiciaries cannot be fully inclusive if their composition does not reflect a society’s intersecting sources of disadvantage. We consider intersectional inclusion on high courts from a compar-ative perspective. Most existing practices of representation on high courts promote the inclusion of groups as if they are internally homogenous. การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษาปัญหาและอุปสรรคของการสืบสวนสอบสวนคดียาเสพติดและเพื่อศึกษาแนวทางการพัฒนารูปแบบการสืบสวนสอบสวนคดียาเสพติดในลักษณะองค์กรอาชญากรรมข้ามชาติในประเทศไทย โดยการวิจัยครั้งนี้เป็นการวิจัยเชิงคุณภาพและการวิจัยเชิงปริมาณโดยการศึกษาเอกสาร การสัมภาษณ์เชิงลึก การประชุมกลุ่มย่อยและการเก็บแบบสอบถามจากบุคลากรในกระบวนการยุติธรรม เครื่องมือในการวิจัยได้แก่ แบบสัมภาษณ์เชิงลึกแบบมีโครงสร้าง แบบประชุมกลุ่มย่อยและแบบสอบถามและผู้วิจัยวิเคราะห์ข้อมูลโดยการวิเคราะห์เนื้อหารวมถึงสถิติพรรณนา ผลการวิจัยพบว่า 1) ปัญหาและอุปสรรคของการสืบสวนสอบสวนคดียาเสพติดในประเทศไทยประกอบด้วย 1.1) ด้านนโยบายและยุทธศาสตร์ที่ยังขาดยุทธศาสตร์ที่มีประสิทธิภาพและขาดนโยบายในการป้องกันและปราบปรามคดียาเสพติดในลักษณะองค์กรอาชญากรรมข้ามชาติอย่างจริงจัง 1.2) ด้านกฎหมายและการลงโทษซึ่งการบังคับใช้กฎหมายและการลงโทษยังขาดประสิทธิภาพและไม่มีการนำมาตรการมาใช้อย่างจริงจัง 1.3) ด้านหน่วยงานที่เกี่ยวข้องการปฏิบัติงานในการสืบสวนสอบสวนแต่ละหน่วยงานแตกต่างกัน ตลอดจนไม่ได้รับความร่วมมือจากหน่วยงานที่เกี่ยวข้องในการให้ข้อมูลที่เป็นประโยชน์ต่อรูปคดีและ 1.4) ด้านบุคลากร เจ้าหน้าที่รัฐขาดประสบการณ์ในคดียาเสพติดในลักษณะองค์กรอาชญากรรมข้ามชาติและ 2) แนวทางการพัฒนารูปแบบการสืบสวนสอบสวนคดียาเสพติดในลักษณะองค์กรอาชญากรรมข้ามชาติในประเทศไทยภาครัฐต้องมีแนวทางการพัฒนาในด้าน 2.1) นโยบายและยุทธศาสตร์โดยการพัฒนานโยบายและยุทธศาสตร์ให้สอดคล้องกับสถานการณ์ยาเสพติด 2.2) ด้านกฎหมายและการลงโทษ เช่น การแก้ไขกลไกทางกฎหมาย/แนวทางการปฏิบัติระเบียบที่เกี่ยวข้องให้เหมาะสมให้เจ้าหน้าที่เข้าถึงข้อมูลต่าง ๆ ได้อย่างรวดเร็ว 2.3) ด้านหน่วยงาน สร้างความร่วมมือกับภาคเอกชนในการเข้าถึงข้อมูล ตลอดจนหน่วยงานภาคีทั้งในและต่างประเทศและ 2.4) ด้านบุคลากร เช่น ความรู้ความเข้าใจ ความเชี่ยวชาญ ตลอดจนการจัดสรรทรัพยากรบุคคลให้เหมาะสมทั้งนี้การพัฒนาดังกล่าวเพื่อให้การดำเนินการสืบสวนสอบสวนคดียาเสพติดในลักษณะองค์กรอาชญากรรมข้ามชาติในประเทศไทยมีประสิทธิภาพมากขึ้นและนำผู้กระทำผิดมาลงโทษตามกฎหมาย
