Over 2.5 million youth remain disconnected from education or the workforce well into their adult lives. Nearly one-third of youth who remain disconnected are Black, Indigenous Persons of Color (BIPOC) from low-income communities. The purpose of this research study was to gain an understanding of what systems and processes support re-engagement for formerly disconnected, and subsequently re-engaged, BIPOC students from alternative high school programs in the State of California. The recent U.S. Supreme Court ruling in Bostock v. Clayton County is a landmark piece of case law that offers fundamental rights to LGBT persons. This essay reflects on how this case arrived at the Supreme Court and its implications for theory and praxis. The overall conclusion is that cautious optimism is warranted.

Scholars debate the role of legal institutions in promoting human rights in Africa. Much of the discussion focuses on Anglophone countries and does not examine the gender of litigants. We propose a constitutionalism constrained perspective that argues that which and whose rights are adjudicated are shaped by the context of constitutional reform. Where reformists are primarily concerned with safeguarding civil and political rights, high courts may protect civil and political rights claims more often than socio-economic ones. This qualitative case study explores the leadership values and practices of a principal in a sixth through twelfth-grade school in the Rocky Mountain West to determine how leadership values and practices support the implementation of equitable and socially just practices in the school. Five key themes emerged: (a) equity as a Black/non-Black construct; (b) a lack of knowledge and awareness of the historical contexts of marginalized populations; (c) moral courage for all members of the school; (d) equity as an initiative or program; (e) resistance to deep equity work. Body dissatisfaction is a globally prevalent issue among adolescents, particularly for those living in industrialized societies (Griffith et al., 2017). Body dissatisfaction is considered a central component of obesity intervention (Huh et at., 2011; Mitola et al., 2007) and eating disorder etiology (Kelly et al., 2005; Saunders & Frazier, 2016). There is a disproportionate burden of illness and death among racial/ethnic minorities related to COVID-19. The importance of reaching groups suffering the most with resources such as advance directive guidance, telehealth, and culturally sensitive education materials is vital to providing quality, inclusive care. A crisis presents an opportunity to unite and problem-solve to help avoid the dire consequences facing inaction. In this way, inclusive responses by hospices, social workers, other community partners during the COVID-19 pandemic can help reach and alleviate the pain of those groups most afflicted. The standard psychological treatment available for Latino men who are newly released from prison has remained unchanged for over thirty years and focuses on decreasing recidivism through cognitive-behavioral interventions by managing and decreasing law-breaking behaviors. However, clinical experience with inmates suggests that personal experiences, cultural values, and intergenerational trauma along with the long-term impact of poverty, gang ties, and repeated incarceration will all influence post-release behavior. Understanding these areas could help draw out protective factors and innate resiliency, therefore informing treatment and helping newly released inmates from becoming repeat offenders. Development Of An Unorthodox Support Model To Mentor Undocumented Immigrant Students, Keisha Chin Goosby

This article addresses the need to better understand impactful mentoring models for undocumented immigrant students (UIS). Based on interviews of 18 mentors of UIS who were college graduates, findings include diverse effective mentoring models, specific mentoring styles and strategies, how mentors identified and leveraged the community cultural wealth of UIS, and the forms of support that mentors used which highlight an unorthodox approach to mentoring UIS. A new model for mentoring UIS is presented with a framework on how to engage in new research. Recommendations are provided for schools, districts, colleges, and universities.

I define girlboss feminism as emergent, mediated formations of neoliberal feminism that equate feminist empowerment with financial success, market competition, individualized work-life balance, and curated digital and physical presences driven by self-monetization. I look toward how the mediation of girlboss feminism utilizes branded and affective engagements with representational politics, discourses of authenticity and rebellion, as well as meritocratic aspiration to promote cultural interest in conceptualizing feminism in ways that are divorced from collective, intersectional struggle. I question the stakes involved in reducing feminist interrogations and commitments to discourses of representation, visibility, and meritocracy. I argue that while girlboss feminism may …

Rapid urbanization is currently taking place in developing regions that have yet to address already existing and persistent inequities within their urban centers. There is perhaps no urban policy issue more critical for governments of the global South than the elimination of slums and informal settlements, along with the development of equitable access to affordable housing for low-income residents. Ethiopia has taken on this challenge through its Integrated Housing Development Program (IHDP), which incorporates slum clearance and resettlement through a government-led development of condominium housing targeting those displaced and other low and middle-income residents in the city.

In this article, we argue that we have much to learn from the adolescent developmental experiences of social justice activists on the frontlines. Our team of authors includes the four youth social leaders at the center of the empirical work emerging from our qualitative research. We ground the Freirean concept of conscientização, roughly interpreted in English as critical consciousness building, in the lived experiences of these four youth social leaders in Colombia who have fought tirelessly for justice in their communities. This qualitative study employs a phenomenological research approach that examines the school counselor’s experiences and training. The purpose of this study is to explore if school counselors received training in critical race theory (CRT), culturally sustaining pedagogies (CSP), and social justice (SJ), and if they implement these theories in practice. Semi-structured interviews were used with eleven practicing school counselors. Thematic content analysis was used with a critical discourse lens to identify explicit and implicit themes within the data. This study examined person and environment contextual factors associated with career decision-making difficulties among Black first-generation students (FGSs) attending predominantly white institutions (PWIs). Using Lewin’s field theory, we investigated the predictive value of person and environment factors on help-seeking behaviors for 63 Black FGS attending PWIs. We used a non-experimental correlational research design, along with hierarchical regression analysis, to investigate the predictability of contextual factors on previous career services use and intention to seek counseling for racist career barriers. There is limited work regarding multiple indicators of social status in the legal system (e.g., power and SES). The present study investigated the influence of defendant social status on case judgments in a first-degree rape case. The experiment used a 2 (defendant power: high vs. low) x 2 (defendant SES: high vs. low) x 2 (participant gender) between-subjects design. A sample of 282 community members were recruited via Amazon’s Mechanical Turk. Distancing—a cognitive reappraisal strategy—increases conciliatory policy support (i.e., policies redressing inequity) by reducing anger. Related but distinct research has used construal level theory (CLT), which explains the relationship between psychological distance and mental representations (e.g., events and attitudes), to explore intergroup relations. CLT demonstrates increased psychological distance induces abstract thinking, which leads to high-level construal (HLC) mindsets. HLC mindsets, like distancing, decrease political polarization and prejudice toward out-groups. As both distancing (an appraisal technique) and HLC mindsets (a potential outcome of appraisal techniques) may decrease political polarization and prejudice toward outgroups, across two experiments, the present work investigated whether …

Unaccompanied youth are migrant children who travel by themselves to the United States, mostly from Central America and Mexico. Since 2014, more than 200,000 unaccompanied youth have entered the United States, with approximately 28,000 residing in Los Angeles, California (U.S. Customs and Border Protection [CBP], CBP 2018, 2019, 2020, 2021a, 2021b). Hundreds of these young migrants have enrolled in public schools (Pierce, 2016). Schools seek adequate and effective ways to support these students’ complex needs and aspirations. This study sought to understand the impact of a leader’s social justice orientation on their praxis of social justice. The study also sought to discover the successes and challenges associated with enacting social justice. Nine Catholic secondary school leaders in the California Archdiocese participated in the study. Semi-structured interviews and document analysis were used to understand how social justice orientation affects social justice praxis. The data analysis indicates that the social justice outcomes of a school site are greatly impacted by the school leader’s justice-orientation. This Article connects the failed, inequitable U.S. coronavirus pandemic response to conceptual and structural constraints that have held back U.S health reform for decades and calls for reconstruction. For more than a half-century, a cramped “iron triangle” ethos has constrained health reform conceptually. Reforms aimed to balance individual interests in cost, quality, and access to health care, while marginalizing equity, solidarity, and public health. In the iron triangle era, reforms unquestioningly accommodated four legally and logistically entrenched fixtures — individualism, fiscal fragmentation, privatization, and federalism — that distort and diffuse any reach toward social justice. การศึกษาเรื่อง การศึกษาการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทย มีวัตถุประสงค์เพื่อศึกษารูปแบบการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทย ศึกษาการบังคับใช้กฎหมาย ปัญหาและอุปสรรคที่เกิดจากการบังคับใช้กฎหมาย ตลอดจนแสวงหาข้อเสนอแนะต่อการป้องกันและปราบปรามการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทยโดยใช้วิธีการในการดำเนินการวิจัย คือ การวิจัยเชิงคุณภาพด้วยการศึกษาค้นคว้าจากเอกสาร และการสัมภาษณ์เชิงลึกผู้ให้ข้อมูลสำคัญ จำนวน 13 คน ประกอบด้วยพนักงานศุลกากร เจ้าพนักงานตำรวจ พนักงานสอบสวนคดีพิเศษ พนักงานอัยการ เจ้าหน้าที่กรมควบคุมมลพิษ ผู้แทนองค์กรพัฒนาเอกชนด้านสิ่งแวดล้อม และผู้เชี่ยวชาญด้านกฎหมายสิ่งแวดล้อม ผลการศึกษาพบว่า รูปแบบของการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทยที่พบมากที่สุด คือ การนำเข้าเศษพลาสติก ด้วยการขนส่งทางเรือโดยบรรจุของเสียในตู้สินค้า ซึ่งมีประเทศต้นทางที่สำคัญ คือ ประเทศสหรัฐอเมริกา โดยผู้กระทำผิดใช้วิธีการฉ้อฉลทางเอกสารเป็นหลัก และเป็นการกระทำโดยองค์กรอาชญากรรมข้ามชาติ ในขณะที่หน่วยงานบังคับใช้กฎหมายก็เผชิญกับปัญหาและอุปสรรคในการบังคับใช้กฎหมาย อาทิเช่น ปัญหาช่องว่างของกฎหมายในเรื่องหลักเกณฑ์การเปรียบเทียบงดการฟ้องร้องตามกฎหมายศุลกากร เป็นต้น อันนำมาสู่ข้อเสนอแนะเชิงนโยบายในการงดการเปรียบเทียบงดการฟ้องร้องเพื่อดำเนินคดีผู้กระทำผิดในชั้นศาล การนำพระราชบัญญัติป้องกันและปราบปรามการมีส่วนร่วมในองค์กรอาชญากรรมข้ามชาติ พ.ศ. 2556 มาใช้ในการปราบปรามการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทย ตลอดจนการจัดการกับของเสียที่เป็นของกลางและของตกค้างด้วยการส่งกลับต้นทาง เป็นต้น

การวิจัยนี้ มีวัตถุประสงค์ในการนำเสนอขั้นตอนของกระบวนการตรวจพิสูจน์พยานหลักฐานดิจิทัลในประเทศไทย กฎหมายที่เกี่ยวข้อง ตลอดจนปัญหาและอุปสรรค เพื่อนำไปสู่ข้อเสนอเชิงนโยบายในการปรับปรุงกฎหมายและพัฒนากระบวนการตรวจพิสูจน์พยานหลักฐาน โดยเนื้อหาเกี่ยวกับลักษณะเฉพาะของพยานหลักฐานดิจิทัล กระบวนการตรวจพิสูจน์พยานหลักฐานดิจิทัล ประเด็นปัญหาและอุปสรรคจากผู้ที่เกี่ยวข้อง ข้อเสนอเชิงนโยบายและเชิงปฏิบัติ โดยใช้วิธีการวิจัยเชิงคุณภาพจากเอกสาร การลงพื้นที่สัมภาษณ์เชิงลึกและกรณีศึกษา จากการศึกษาพบว่า กระบวนการตรวจพิสูจน์พยานหลักฐานดิจิทัลในประเทศไทย 4 ขั้นตอน มีปัญหาและอุปสรรค คือ 1) การรวบรวมพยานหลักฐาน มีปัญหาในการรวบรวมพยานหลักฐานให้สมบูรณ์ขณะเกิดเหตุโดยไม่ถูกเปลี่ยนแปลงแก้ไข 2) การเก็บรักษาพยานหลักฐาน ไม่เป็นไปตามมาตรฐานการจัดเก็บ และการจัดการพยานหลักฐานดิจิทัล 3) การวิเคราะห์พยานหลักฐานดิจิทัล บุคลากรบางส่วนขาดความเชี่ยวชาญที่จำเป็นเฉพาะด้าน 4) การนำเสนอผลพิสูจน์พยานหลักฐานดิจิทัล มีการโต้แย้ง หรือขาดน้ำหนักในการรับฟังในชั้นพิจารณาคดี ข้อเสนอแนะจากการศึกษาครั้งนี้ คือ ควรมีการปรับปรุงพัฒนากระบวนการตรวจพิสูจน์พยานหลักฐานดิจิทัลในประเทศไทยให้มีมาตรฐานการปฏิบัติที่ชัดเจนในทั้ง 4 ขั้นตอนให้สอดคล้องกับมาตรฐานสากล บุคลากรควรได้รับการอบรมเพิ่มเติมในประเด็นความเชี่ยวชาญเฉพาะด้าน เพื่อช่วยลดปัญหาและอุปสรรคในการปฏิบัติงาน มีการแก้ไขกฎหมายที่เกี่ยวข้อง รวมถึงสนับสนุนให้มีการจัดตั้งสภาวิชาชีพนิติวิทยาศาสตร์ และจัดตั้งหน่วยงานเฉพาะที่ทำหน้าที่ในการกำกับดูแล โดยเริ่มต้นจากการส่งเสริมบทบาทของศูนย์ดิจิทัลฟอเรนสิกส์ที่มีอยู่เดิม เพื่อให้การป้องกันปราบปรามอาชญากรรมคอมพิวเตอร์ในประเทศไทยมีประสิทธิภาพมากขึ้น การวิจัยนี้ ได้รับการสนับสนุนทุนการศึกษาจากทุนการศึกษาหลักสูตรดุษฎีบัณฑิต “100 ปี จุฬาลงกรณ์มหาวิทยาลัย” (The 100th Anniversary Chulalongkorn University Fund for Doctoral Scholarship) และทุน 90 ปี จุฬาลงกรณ์มหาวิทยาลัย กองทุนรัชดาภิเษกสมโภช [The 90th Anniversary of Chulalongkorn University Fund (Ratchadaphiseksomphot Endowment Fund)]

วิทยานิพนธ์เรื่องสายลับกับการสืบสวนปราบปรามอาชญากรรมยาเสพติดในประเทศไทย มีวัตถุประสงค์เพื่อศึกษาถึงความเป็นมาและบทบาทของสายลับในการสืบสวนปราบปรามอาชญากรรมยาเสพติดในประเทศไทย พร้อมทั้งศึกษาความสัมพันธ์ระหว่างเจ้าหน้าที่สืบสวนกับบุคคลที่เป็นสายลับในการทำงานปราบปรามยาเสพติด เพื่อวิเคราะห์ผลกระทบที่เกิดขึ้นจากการนำสายลับมาใช้ในการสืบสวนปราบปรามอาชญากรรมยาเสพติด โดยเป็นการศึกษาเชิงคุณภาพด้วยการวิจัยเชิงเอกสารและการสัมภาษณ์เชิงลึกจากผู้ให้ข้อมูลสำคัญ ประกอบด้วย เจ้าหน้าที่รัฐ สายลับ และบุคลากรในกระบวนการยุติธรรม จำนวนทั้งสิ้น 27 ท่าน ผลการศึกษาพบว่า สายลับเป็นกลวิธีในการหาข่าวที่ปรากฏหลักฐานมาตั้งแต่สมัยบรรพกาล ตราบจนกระทั่งสังคมมีพัฒนาการทางด้านกฎหมายและกระบวนการยุติธรรมทางอาญา วิธีการใช้สายลับจึงได้ถูกนำมาปรับใช้ในการทำงานสืบสวนของเจ้าหน้าที่ตำรวจซึ่งมีภารกิจรักษาความสงบเรียบร้อยภายในรัฐและการควบคุมอาชญากรรม บทบาทที่คาดหวังของสายลับคือ การกระทำใด ๆ ที่ตอบสนองต่อภารกิจการสืบสวนปราบปรามยาเสพติดตามที่เจ้าหน้าที่ต้องการ ซึ่งเป็นงานที่เจ้าหน้าที่ไม่อาจกระทำได้โดยฐานะของเจ้าหน้าที่เองหรืออาจต้องใช้ระยะเวลานาน บทบาทความสำคัญของสายลับส่วนหนึ่งขึ้นอยู่กับมุมมองของเจ้าหน้าที่แต่ละบุคคลซึ่งมีลักษณะเป็นอัตวิสัย รูปแบบของความสัมพันธ์ระหว่างเจ้าหน้าที่สืบสวนกับบุคคลที่เป็นสายลับจะแตกต่างกันไปในแต่ละคู่สัมพันธ์ การใช้สายลับได้ก่อให้เกิดผลกระทบในหลายด้าน เป็นต้นว่า สายลับต้องอยู่ในวัฏจักรของการกระทำความผิดและมีโอกาสกลับไปกระทำความผิดซ้ำ และด้วยลักษณะที่เป็นความลับทำให้การตรวจสอบความโปร่งใสของการทำงานเป็นได้ยากอันส่งผลกระทบต่อสังคมและกระบวนการยุติธรรมทางอาญาหลายประการ แนวทางพัฒนาการสืบสวนโดยวิธีใช้สายลับที่เหมาะสมกับบริบทของประเทศไทยจึงควรแก้ไขเพิ่มเติมกฎหมายวิธีพิจารณาคดียาเสพติด พ.ศ. 2550 หมวด 1 ว่าด้วยการสืบสวน โดยให้ระบุถึงการสืบสวนโดยวิธีใช้สายลับ พัฒนาระบบงานยุติธรรมทางอาญาให้ทุกฝ่ายยึดหลักการค้นหาความจริงในเนื้อหา และสร้างมาตรการกำกับดูแลให้ดียิ่งขึ้น

การศึกษานี้ มีวัตถุประสงค์เพื่อศึกษา ปัญหาการซื้อขายผลิตภัณฑ์ด้านความงามผ่านระบบพาณิชย์อิเล็กทรอนิกส์ในสังคมไทย ปัจจัยที่ส่งผลต่อพฤติกรรมการตกเป็นเหยื่อและการกระทำผิด รวมถึงผลลัพธ์ของการตกเป็นเหยื่อ และแนวทางการป้องกันการตกเป็นเหยื่อ โดยใช้การวิจัยเชิงคุณภาพ (Qualitative Research) ด้วยวิธีการสัมภาษณ์เชิงลึกจากกลุ่มผู้ให้ข้อมูลสำคัญ 4 กลุ่ม จำนวน 19 คน ประกอบด้วย ผู้เสียหาย ผู้กระทำความผิด เจ้าหน้าที่ที่เกี่ยวข้องกับการดำเนินคดีและกำกับดูแล และผู้ทรงคุณวุฒิที่เกี่ยวข้องกับการโฆษณาผลิตภัณฑ์ด้านความงามบนสื่อออนไลน์ และการวิจัยเชิงปริมาณ (Quantitative Research) โดยเก็บข้อมูลจากผู้เสียหายด้วยแบบสอบถามออนไลน์ จำนวน 27 คน ผลการศึกษาพบว่า ปัญหาที่พบ ได้แก่ ด้านกฎหมาย การบังคับใช้กฎหมาย การชดเชยเยียวยา การควบคุมและกำกับดูแลร้านค้าออนไลน์ การควบคุมความปลอดภัยของสินค้ และการโฆษณาบนสื่อออนไลน์ โดยปัจจัยที่ส่งผลต่อพฤติกรรมการตกเป็นเหยื่อ ได้แก่ ค่านิยมการให้คุณค่าความงาม โอกาสในการตกเป็นเหยื่อ การมีส่วนร่วมของเหยื่อ การพึ่งพาเทคโนโลยีสมัยใหม่และพฤติกรรมของเหยื่อ ทั้งนี้ การพัฒนาแนวทางการป้องกันการตกเป็นเหยื่อในเรื่องนี้ ประกอบด้วย การปรับปรุงอัตราโทษทางกฎหมายเกี่ยวกับเครื่องสำอางให้สอดคล้องกับสถานการณ์ปัจจุบัน การกำกับดูแลเพื่อควบคุมคุณภาพและความปลอดภัยของผลิตภัณฑ์ การบูรณาการความร่วมมือกับหน่วยงานของต่างประเทศในการสืบสวนสอบสวน เป็นต้น

วิทยานิพนธ์เรื่องอาชญากรรมสิ่งแวดล้อม: กรณีศึกษาผลกระทบของการลักลอบนำเข้าขยะอิเล็กทรอนิกส์ในประเทศไทย มีวัตถุประสงค์เพื่อศึกษาสภาพปัญหาและผลกระทบของการลักลอบนำเข้าขยะอิเล็กทรอนิกส์ในประเทศไทย ศึกษาปัจจัยของการลักลอบนำเข้าขยะอิเล็กทรอนิกส์ในประเทศไทยและเสนอแนะแนวทางและมาตรการในการป้องกันและแก้ไขการลักลอบนําเข้าขยะอิเล็กทรอนิกส์ในประเทศไทยให้สอดคล้องกับอนุสัญญาบาเซล (Basel Convention) โดยเป็นการศึกษาเชิงคุณภาพด้วยการวิจัยเชิงเอกสารและการสัมภาษณ์เชิงลึกจากผู้ให้ข้อมูลสำคัญในหน่วยงานภาครัฐบาลและภาคประชาสังคม จำนวน 10 ราย ผลการศึกษาพบว่า สภาพปัญหาการลักลอบนำเข้าขยะอิเล็กทรอนิกส์เริ่มมาจากการที่ประเทศจีนมีประกาศห้ามนำเข้าขยะรีไซเคิลอย่างเด็ดขาดในปี พ.ศ. 2560 และปัญหาการกำจัดขยะอิเล็กทรอนิกส์ที่มีอยู่เดิมของประเทศไทย ทำให้ปริมาณขยะอิเล็กทรอนิกส์ในประเทศไทยมีจำนวนสูงมากขึ้น พบการลักลอบโดยการสำแดงเท็จ การดำเนินการส่วนใหญ่มักยุติที่ชั้นศุลกากรโดยไม่เข้าสู่กระบวนการทางอาญาแม้จะมีกฎหมายระบุไว้ การลักลอบนำเข้าขยะอิเล็กทรอนิกส์จะส่งผลกระทบต่อสิ่งแวดล้อม ระบบนิเวศ สุขภาพ สังคม ชุมชน และเศรษฐกิจของประเทศ สำหรับปัจจัยของการลักลอบนำเข้าขยะอิเล็กทรอนิกส์นั้น มีทั้งหมด 4 ด้าน ได้แก่ ปัจจัยด้านพื้นที่ ปัจจัยด้านการปฏิบัติงานของเจ้าหน้าที่ผู้บังคับใช้กฎหมาย ปัจจัยด้านการบังคับใช้กฎหมาย และปัจจัยด้านความคุ้มค่า ผลการศึกษาแนวทางในการป้องกัน และแก้ไขปัญหาการลักลอบนำเข้าขยะอิเล็กทรอนิกส์มีทั้งหมด 3 ด้าน ได้แก่ ด้านการปฏิบัติงาน และการบูรณาการร่วมกันของหน่วยงานที่เกี่ยวข้อง การปรับปรุงแก้ไขกฎหมาย/นโยบาย/มาตรการ และการบังคับใช้อย่างเคร่งครัด และการสร้างจิตสำนึก และการตระหนักถึงปัญหาสิ่งแวดล้อมให้มากยิ่งขึ้น
