Neither “Post-War” Nor Post-Pregnancy Paranoia: How America’S War On Drugs Continues To Perpetuate Disparate Incarceration Outcomes For Pregnant, Substance-Involved Offenders, Becca S. Zimmerman

This thesis investigates the unique interactions between pregnancy, substance involvement, and race as they relate to the War on Drugs and the hyper-incarceration of women. Using ordinary least square regression analyses and data from the Bureau of Justice Statistics’ 2016 Survey of Prison Inmates, I examine if (and how) pregnancy status, drug use, race, and their interactions influence two length of incarceration outcomes: sentence length and amount of time spent in jail between arrest and imprisonment. The results collectively indicate that pregnancy decreases length of incarceration outcomes for those offenders who are not substance-involved but not evenhandedly -- benefitting white …

Periodically, newspaper or magazine articles appear proclaiming amazement at how white the population of Oregon and the City of Portland is compared to other parts of the country. It is not possible to argue with the figures—in 2017, there were an estimated 91,000 Blacks in Oregon, about 2 percent of the population—but it is a profound mistake to think that these stories and statistics tell the story of the state's racial past. India has the highest number of acid attacks globally every year, and despite the actions taken by the Indian Government and the Supreme Court of India, the crime is on the rise. This increase can be attributed to the patriarchal ideology that is prevalent in India and to India’s inadequate legal system, which does not deliver efficient remedies to the victims. This article will discuss the prevalence of acid attacks in India, motives behind the attacks, consequences on victims, and shortcomings in measures adopted to prevent the crime and provide justice to victims.

Examining the voluntary and forced migrations of Indigenous, African American, and Anglo Americans in the decades immediately following the Revolution, Samantha Seeley argues that the United States took shape as a white republic through contentious negotiations over who could move and where, who could remain and how. On May 6th, 2020, after extensive public comment and review, the Department of Education published the final rule for the new Title IX regulations, which took effect in schools on August 14th. Title IX is the nearly fifty year old piece of the Education Amendments that prohibits sexual discrimination in federally funded schools. This study investigated the knowledge and perception of the ideology of baby-mama concept among the youths. Particularly, this paper assessed the knowledge of the concept of baby mama among youths and also their opinion on the acceptability of this style of family structure. The study employed a qualitative approach through an in-depth interview research method. Forty respondents between the ages of 16 and 40 years were selected across three educational institutions in Oyo state, south-west Nigeria. Alarmingly, the female murder rate in South Africa is five times the global average (BBC News 2019). According to data from 2017 and 2018, a woman is murdered every four hours in South Africa (Wilkinson 2019). More than 30 women were killed by their spouses in August 2019, and at least 137 sexual offenses are committed per day in South Africa (Francke 2019).

This research paper aims to discuss and bring awareness to orgasm representation within heterosexual pornography that is specifically labeled for female consumption. Major areas of focus are on the orgasm gap and clitoral stimulation, sexual satisfaction in heterosexual relationships, and aggressive and violent behaviors depicted in pornography and sexual interactions. These areas are crucial because current research is lacking; it is necessary for more research to be conducted that focuses on orgasm representation and satisfaction. Over 2.5 million youth remain disconnected from education or the workforce well into their adult lives. Nearly one-third of youth who remain disconnected are Black, Indigenous Persons of Color (BIPOC) from low-income communities. The purpose of this research study was to gain an understanding of what systems and processes support re-engagement for formerly disconnected, and subsequently re-engaged, BIPOC students from alternative high school programs in the State of California. Scholars debate the role of legal institutions in promoting human rights in Africa. Much of the discussion focuses on Anglophone countries and does not examine the gender of litigants. We propose a constitutionalism constrained perspective that argues that which and whose rights are adjudicated are shaped by the context of constitutional reform. Where reformists are primarily concerned with safeguarding civil and political rights, high courts may protect civil and political rights claims more often than socio-economic ones. Development Of An Unorthodox Support Model To Mentor Undocumented Immigrant Students, Keisha Chin Goosby

This article addresses the need to better understand impactful mentoring models for undocumented immigrant students (UIS). Based on interviews of 18 mentors of UIS who were college graduates, findings include diverse effective mentoring models, specific mentoring styles and strategies, how mentors identified and leveraged the community cultural wealth of UIS, and the forms of support that mentors used which highlight an unorthodox approach to mentoring UIS. A new model for mentoring UIS is presented with a framework on how to engage in new research. Recommendations are provided for schools, districts, colleges, and universities.

I define girlboss feminism as emergent, mediated formations of neoliberal feminism that equate feminist empowerment with financial success, market competition, individualized work-life balance, and curated digital and physical presences driven by self-monetization. I look toward how the mediation of girlboss feminism utilizes branded and affective engagements with representational politics, discourses of authenticity and rebellion, as well as meritocratic aspiration to promote cultural interest in conceptualizing feminism in ways that are divorced from collective, intersectional struggle. In this article, we argue that we have much to learn from the adolescent developmental experiences of social justice activists on the frontlines. Our team of authors includes the four youth social leaders at the center of the empirical work emerging from our qualitative research. We ground the Freirean concept of conscientização, roughly interpreted in English as critical consciousness building, in the lived experiences of these four youth social leaders in Colombia who have fought tirelessly for justice in their communities. การศึกษาเรื่อง การศึกษาการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทย มีวัตถุประสงค์เพื่อศึกษารูปแบบการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทย ศึกษาการบังคับใช้กฎหมาย ปัญหาและอุปสรรคที่เกิดจากการบังคับใช้กฎหมาย ตลอดจนแสวงหาข้อเสนอแนะต่อการป้องกันและปราบปรามการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทยโดยใช้วิธีการในการดำเนินการวิจัย คือ การวิจัยเชิงคุณภาพด้วยการศึกษาค้นคว้าจากเอกสาร และการสัมภาษณ์เชิงลึกผู้ให้ข้อมูลสำคัญ จำนวน 13 คน ประกอบด้วยพนักงานศุลกากร เจ้าพนักงานตำรวจ พนักงานสอบสวนคดีพิเศษ พนักงานอัยการ เจ้าหน้าที่กรมควบคุมมลพิษ ผู้แทนองค์กรพัฒนาเอกชนด้านสิ่งแวดล้อม และผู้เชี่ยวชาญด้านกฎหมายสิ่งแวดล้อม ผลการศึกษาพบว่า รูปแบบของการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทยที่พบมากที่สุด คือ การนำเข้าเศษพลาสติก ด้วยการขนส่งทางเรือโดยบรรจุของเสียในตู้สินค้า ซึ่งมีประเทศต้นทางที่สำคัญ คือ ประเทศสหรัฐอเมริกา โดยผู้กระทำผิดใช้วิธีการฉ้อฉลทางเอกสารเป็นหลัก และเป็นการกระทำโดยองค์กรอาชญากรรมข้ามชาติ ในขณะที่หน่วยงานบังคับใช้กฎหมายก็เผชิญกับปัญหาและอุปสรรคในการบังคับใช้กฎหมาย อาทิเช่น ปัญหาช่องว่างของกฎหมายในเรื่องหลักเกณฑ์การเปรียบเทียบงดการฟ้องร้องตามกฎหมายศุลกากร เป็นต้น อันนำมาสู่ข้อเสนอแนะเชิงนโยบายในการงดการเปรียบเทียบงดการฟ้องร้องเพื่อดำเนินคดีผู้กระทำผิดในชั้นศาล การนำพระราชบัญญัติป้องกันและปราบปรามการมีส่วนร่วมในองค์กรอาชญากรรมข้ามชาติ พ.ศ. 2556 มาใช้ในการปราบปรามการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทย ตลอดจนการจัดการกับของเสียที่เป็นของกลางและของตกค้างด้วยการส่งกลับต้นทาง เป็นต้น

การวิจัยนี้ มีวัตถุประสงค์ในการนำเสนอขั้นตอนของกระบวนการตรวจพิสูจน์พยานหลักฐานดิจิทัลในประเทศไทย กฎหมายที่เกี่ยวข้อง ตลอดจนปัญหาและอุปสรรค เพื่อนำไปสู่ข้อเสนอเชิงนโยบายในการปรับปรุงกฎหมายและพัฒนากระบวนการตรวจพิสูจน์พยานหลักฐาน โดยเนื้อหาเกี่ยวกับลักษณะเฉพาะของพยานหลักฐานดิจิทัล กระบวนการตรวจพิสูจน์พยานหลักฐานดิจิทัล ประเด็นปัญหาและอุปสรรคจากผู้ที่เกี่ยวข้อง ข้อเสนอเชิงนโยบายและเชิงปฏิบัติ โดยใช้วิธีการวิจัยเชิงคุณภาพจากเอกสาร การลงพื้นที่สัมภาษณ์เชิงลึกและกรณีศึกษา จากการศึกษาพบว่า กระบวนการตรวจพิสูจน์พยานหลักฐานดิจิทัลในประเทศไทย 4 ขั้นตอน มีปัญหาและอุปสรรค คือ 1) การรวบรวมพยานหลักฐาน มีปัญหาในการรวบรวมพยานหลักฐานให้สมบูรณ์ขณะเกิดเหตุโดยไม่ถูกเปลี่ยนแปลงแก้ไข 2) การเก็บรักษาพยานหลักฐาน ไม่เป็นไปตามมาตรฐานการจัดเก็บ และการจัดการพยานหลักฐานดิจิทัล 3) การวิเคราะห์พยานหลักฐานดิจิทัล บุคลากรบางส่วนขาดความเชี่ยวชาญที่จำเป็นเฉพาะด้าน 4) การนำเสนอผลพิสูจน์พยานหลักฐานดิจิทัล มีการโต้แย้ง หรือขาดน้ำหนักในการรับฟังในชั้นพิจารณาคดี ข้อเสนอแนะจากการศึกษาครั้งนี้ คือ ควรมีการปรับปรุงพัฒนากระบวนการตรวจพิสูจน์พยานหลักฐานดิจิทัลในประเทศไทยให้มีมาตรฐานการปฏิบัติที่ชัดเจนในทั้ง 4 ขั้นตอนให้สอดคล้องกับมาตรฐานสากล บุคลากรควรได้รับการอบรมเพิ่มเติมในประเด็นความเชี่ยวชาญเฉพาะด้าน เพื่อช่วยลดปัญหาและอุปสรรคในการปฏิบัติงาน มีการแก้ไขกฎหมายที่เกี่ยวข้อง รวมถึงสนับสนุนให้มีการจัดตั้งสภาวิชาชีพนิติวิทยาศาสตร์ และจัดตั้งหน่วยงานเฉพาะที่ทำหน้าที่ในการกำกับดูแล โดยเริ่มต้นจากการส่งเสริมบทบาทของศูนย์ดิจิทัลฟอเรนสิกส์ที่มีอยู่เดิม เพื่อให้การป้องกันปราบปรามอาชญากรรมคอมพิวเตอร์ในประเทศไทยมีประสิทธิภาพมากขึ้น การวิจัยนี้ ได้รับการสนับสนุนทุนการศึกษาจากทุนการศึกษาหลักสูตรดุษฎีบัณฑิต “100 ปี จุฬาลงกรณ์มหาวิทยาลัย” (The 100th Anniversary Chulalongkorn University Fund for Doctoral Scholarship) และทุน 90 ปี จุฬาลงกรณ์มหาวิทยาลัย กองทุนรัชดาภิเษกสมโภช [The 90th Anniversary of Chulalongkorn University Fund (Ratchadaphiseksomphot Endowment Fund)]

วิทยานิพนธ์เรื่องสายลับกับการสืบสวนปราบปรามอาชญากรรมยาเสพติดในประเทศไทย มีวัตถุประสงค์เพื่อศึกษาถึงความเป็นมาและบทบาทของสายลับในการสืบสวนปราบปรามอาชญากรรมยาเสพติดในประเทศไทย พร้อมทั้งศึกษาความสัมพันธ์ระหว่างเจ้าหน้าที่สืบสวนกับบุคคลที่เป็นสายลับในการทำงานปราบปรามยาเสพติด เพื่อวิเคราะห์ผลกระทบที่เกิดขึ้นจากการนำสายลับมาใช้ในการสืบสวนปราบปรามอาชญากรรมยาเสพติด โดยเป็นการศึกษาเชิงคุณภาพด้วยการวิจัยเชิงเอกสารและการสัมภาษณ์เชิงลึกจากผู้ให้ข้อมูลสำคัญ ประกอบด้วย เจ้าหน้าที่รัฐ สายลับ และบุคลากรในกระบวนการยุติธรรม จำนวนทั้งสิ้น 27 ท่าน ผลการศึกษาพบว่า สายลับเป็นกลวิธีในการหาข่าวที่ปรากฏหลักฐานมาตั้งแต่สมัยบรรพกาล ตราบจนกระทั่งสังคมมีพัฒนาการทางด้านกฎหมายและกระบวนการยุติธรรมทางอาญา วิธีการใช้สายลับจึงได้ถูกนำมาปรับใช้ในการทำงานสืบสวนของเจ้าหน้าที่ตำรวจซึ่งมีภารกิจรักษาความสงบเรียบร้อยภายในรัฐและการควบคุมอาชญากรรม บทบาทที่คาดหวังของสายลับคือ การกระทำใด ๆ ที่ตอบสนองต่อภารกิจการสืบสวนปราบปรามยาเสพติดตามที่เจ้าหน้าที่ต้องการ ซึ่งเป็นงานที่เจ้าหน้าที่ไม่อาจกระทำได้โดยฐานะของเจ้าหน้าที่เองหรืออาจต้องใช้ระยะเวลานาน บทบาทความสำคัญของสายลับส่วนหนึ่งขึ้นอยู่กับมุมมองของเจ้าหน้าที่แต่ละบุคคลซึ่งมีลักษณะเป็นอัตวิสัย รูปแบบของความสัมพันธ์ระหว่างเจ้าหน้าที่สืบสวนกับบุคคลที่เป็นสายลับจะแตกต่างกันไปในแต่ละคู่สัมพันธ์ การใช้สายลับได้ก่อให้เกิดผลกระทบในหลายด้าน เป็นต้นว่า สายลับต้องอยู่ในวัฏจักรของการกระทำความผิดและมีโอกาสกลับไปกระทำความผิดซ้ำ และด้วยลักษณะที่เป็นความลับทำให้การตรวจสอบความโปร่งใสของการทำงานเป็นได้ยากอันส่งผลกระทบต่อสังคมและกระบวนการยุติธรรมทางอาญาหลายประการ แนวทางพัฒนาการสืบสวนโดยวิธีใช้สายลับที่เหมาะสมกับบริบทของประเทศไทยจึงควรแก้ไขเพิ่มเติมกฎหมายวิธีพิจารณาคดียาเสพติด พ.ศ. 2550 หมวด 1 ว่าด้วยการสืบสวน โดยให้ระบุถึงการสืบสวนโดยวิธีใช้สายลับ พัฒนาระบบงานยุติธรรมทางอาญาให้ทุกฝ่ายยึดหลักการค้นหาความจริงในเนื้อหา และสร้างมาตรการกำกับดูแลให้ดียิ่งขึ้น

การศึกษานี้ มีวัตถุประสงค์เพื่อศึกษา ปัญหาการซื้อขายผลิตภัณฑ์ด้านความงามผ่านระบบพาณิชย์อิเล็กทรอนิกส์ในสังคมไทย ปัจจัยที่ส่งผลต่อพฤติกรรมการตกเป็นเหยื่อและการกระทำผิด รวมถึงผลลัพธ์ของการตกเป็นเหยื่อ และแนวทางการป้องกันการตกเป็นเหยื่อ โดยใช้การวิจัยเชิงคุณภาพ (Qualitative Research) ด้วยวิธีการสัมภาษณ์เชิงลึกจากกลุ่มผู้ให้ข้อมูลสำคัญ 4 กลุ่ม จำนวน 19 คน ประกอบด้วย ผู้เสียหาย ผู้กระทำความผิด เจ้าหน้าที่ที่เกี่ยวข้องกับการดำเนินคดีและกำกับดูแล และผู้ทรงคุณวุฒิที่เกี่ยวข้องกับการโฆษณาผลิตภัณฑ์ด้านความงามบนสื่อออนไลน์ และการวิจัยเชิงปริมาณ (Quantitative Research) โดยเก็บข้อมูลจากผู้เสียหายด้วยแบบสอบถามออนไลน์ จำนวน 27 คน ผลการศึกษาพบว่า ปัญหาที่พบ ได้แก่ ด้านกฎหมาย การบังคับใช้กฎหมาย การชดเชยเยียวยา การควบคุมและกำกับดูแลร้านค้าออนไลน์ การควบคุมความปลอดภัยของสินค้ และการโฆษณาบนสื่อออนไลน์ โดยปัจจัยที่ส่งผลต่อพฤติกรรมการตกเป็นเหยื่อ ได้แก่ ค่านิยมการให้คุณค่าความงาม โอกาสในการตกเป็นเหยื่อ การมีส่วนร่วมของเหยื่อ การพึ่งพาเทคโนโลยีสมัยใหม่และพฤติกรรมของเหยื่อ ทั้งนี้ การพัฒนาแนวทางการป้องกันการตกเป็นเหยื่อในเรื่องนี้ ประกอบด้วย การปรับปรุงอัตราโทษทางกฎหมายเกี่ยวกับเครื่องสำอางให้สอดคล้องกับสถานการณ์ปัจจุบัน การกำกับดูแลเพื่อควบคุมคุณภาพและความปลอดภัยของผลิตภัณฑ์ การบูรณาการความร่วมมือกับหน่วยงานของต่างประเทศในการสืบสวนสอบสวน เป็นต้น

วิทยานิพนธ์เรื่องอาชญากรรมสิ่งแวดล้อม: กรณีศึกษาผลกระทบของการลักลอบนำเข้าขยะอิเล็กทรอนิกส์ในประเทศไทย มีวัตถุประสงค์เพื่อศึกษาสภาพปัญหาและผลกระทบของการลักลอบนำเข้าขยะอิเล็กทรอนิกส์ในประเทศไทย ศึกษาปัจจัยของการลักลอบนำเข้าขยะอิเล็กทรอนิกส์ในประเทศไทยและเสนอแนะแนวทางและมาตรการในการป้องกันและแก้ไขการลักลอบนําเข้าขยะอิเล็กทรอนิกส์ในประเทศไทยให้สอดคล้องกับอนุสัญญาบาเซล (Basel Convention) โดยเป็นการศึกษาเชิงคุณภาพด้วยการวิจัยเชิงเอกสารและการสัมภาษณ์เชิงลึกจากผู้ให้ข้อมูลสำคัญในหน่วยงานภาครัฐบาลและภาคประชาสังคม จำนวน 10 ราย ผลการศึกษาพบว่า สภาพปัญหาการลักลอบนำเข้าขยะอิเล็กทรอนิกส์เริ่มมาจากการที่ประเทศจีนมีประกาศห้ามนำเข้าขยะรีไซเคิลอย่างเด็ดขาดในปี พ.ศ. 2560 และปัญหาการกำจัดขยะอิเล็กทรอนิกส์ที่มีอยู่เดิมของประเทศไทย ทำให้ปริมาณขยะอิเล็กทรอนิกส์ในประเทศไทยมีจำนวนสูงมากขึ้น พบการลักลอบโดยการสำแดงเท็จ การดำเนินการส่วนใหญ่มักยุติที่ชั้นศุลกากรโดยไม่เข้าสู่กระบวนการทางอาญาแม้จะมีกฎหมายระบุไว้ การลักลอบนำเข้าขยะอิเล็กทรอนิกส์จะส่งผลกระทบต่อสิ่งแวดล้อม ระบบนิเวศ สุขภาพ สังคม ชุมชน และเศรษฐกิจของประเทศ สำหรับปัจจัยของการลักลอบนำเข้าขยะอิเล็กทรอนิกส์นั้น มีทั้งหมด 4 ด้าน ได้แก่ ปัจจัยด้านพื้นที่ ปัจจัยด้านการปฏิบัติงานของเจ้าหน้าที่ผู้บังคับใช้กฎหมาย ปัจจัยด้านการบังคับใช้กฎหมาย และปัจจัยด้านความคุ้มค่า ผลการศึกษาแนวทางในการป้องกัน และแก้ไขปัญหาการลักลอบนำเข้าขยะอิเล็กทรอนิกส์มีทั้งหมด 3 ด้าน ได้แก่ ด้านการปฏิบัติงาน และการบูรณาการร่วมกันของหน่วยงานที่เกี่ยวข้อง การปรับปรุงแก้ไขกฎหมาย/นโยบาย/มาตรการ และการบังคับใช้อย่างเคร่งครัด และการสร้างจิตสำนึก และการตระหนักถึงปัญหาสิ่งแวดล้อมให้มากยิ่งขึ้น
