This special issue is fortunate in its timing. The topic of public perceptions of the courts is having a rare moment in the limelight thanks to the drama of Florida’s ballots and what can count as a vote (or what opportunities there are for recounting ballots) in the U.S. Presidential election. The outcome of the political election seemed to rest on successive decisions by the judicial system: in particular, Florida’s trial and appellate courts, the federal court of appeals, and ultimately the U.S. Supreme Court. This report is designed to provide an overview of the Medicaid provisions of the Ticket to Work and Work Incentives Improvement Act of 1999, Public Law 106-170. This report considers the implications of the Act for the design and support of comprehensive, Medicaid-financed systems of health care for workers with severe disabilities and impairments, with a specific focus on persons with mental illness and addiction disorder disabilities. The Act, described by advocates for persons with disabilities as the most important piece of disability-related legislation since the enactment of the Americans with Disabilities Act of 1990, expands the availability of health …

In his essay, "The discovery of what it means to be an American," James Baldwin described how his exile in Paris led him to new self-knowledge about his national identity. Baldwin left the US to survive what he called "the color problem," but was surprised to find he shared a sense of being "not at home" with white Americans in Europe. He was American in ways he had not realized. Exile afforded him intellectual freedom, but his growing consciousness of the French-Algerian war led him to understand that "there are no untroubled countries in this fearfully troubled world." Evaluates project to establish rehabilitation centers for people disabled by war in Cambodia. Interim evaluation covers the period 1996-10/01. Veterans International/Cambodia (VI/C) is the implementing agency. VI/C's USAID-funded rehabilitation efforts are providing highly successful and valuable interventions for people with disabilities. The grant support has enabled people with amputations, spinal cord injuries, cerebral palsy, polio, and a number of other pathologies to receive high-quality rehabilitation and prosthetic and orthotic services. Numerous patients have had significantly positive functional and social outcomes, with particularly good outcomes for patients with amputations and clubfeet, and good outcomes for those with polio and spinal cord …

This analysis reviews the key elements of the United States Supreme Court's 1999 decision in Olmstead v L.C. as well as Federal implementation guidelines issued by the United States Department and Human Services. The Olmstead decision interprets the Americans with Disabilities Act ("ADA," PL 101-336), whose requirements apply to the use of all public funds. However, Medicaid represents the single largest source of public funding for both institutional and non-institutional services for persons with disabilities. As a result, when states expend Medicaid funds on care for persons with disabilities, two independent sets of legal requirements are triggered: those contained in …

The objective of this research was to describe transit priority techniques in Zürich and understand how the city implemented its program. Most transit priority improvements are relatively simple and inexpensive; however, they have proved to be difficult to implement and sustain. The research effort consisted of a case study with interviews and surveys. We interviewed many persons associated with the development and implementation of Zürich’s transit priority program. A survey to evaluate support of transportation decision-makers in Santa Clara County, California, illustrated transit improvements in a typical U.S. city. The data was compared to a similar survey in Zürich. The …

The devastating consequences of the four coordinated hijackings and deliberate crashes of three of the planes into the World Trade Center in New York and the Pentagon in Washington, D.C., on September 11, 2001—an event unprecedented in the annals of terrorism—have wiped out all sense of progress and focused national attention on aviation security. This survey provides a preliminary review of the activities of pumpout facilities in the No Discharge Areas of Massachusetts. It highlights areas of concern, identifies potential improvements and focuses further research.

Based on data from Massachusetts Coastal Zone Management, there are 100 pumpout facilities in Massachusetts, located in 56 towns. Of these 52, have one or more pumpout boats. Due to financial limitations and the time available, any attempt to survey all these facilities was beyond the scope of this study. However, it had been suggested that from CZM’s, DMF’s and EPA’s standpoint, the areas of greatest interest were those …

We studied wolf (Canis lupus) predation on elk (Cervus elaphus) in Yellowstone National Park from 17 March to 15 April 1997 (severe winter conditions) and from 2 to 31 March 1998 (mild winter conditions) 2-3 years after wolves were reintroduced to the park. Elk composed 91% of 117 kills. Data comparisons for 1997 versus 1998 were: hunting success rate, 26% versus 15%; kill rate, 17.1 kg/wolf/day versus 6.1; percent of kill consumed in first day, 7 versus 86; percent femur marrow fat of adult kills, 27 versus 70; calf:adult ratios of kills, 2:33 versus 17:23; sex …

The Commonwealth’s economic growth over the past decade has led to more jobs and an increasing median income, but the rising tide has not lifted the boats at the bottom. The bottom 20 percent of the Commonwealth’s families with children have not found relief. Growth in earnings has been almost completely offset by the loss of public support, which in turn has strained the private sector’s emergency support system. Poverty rates for families have dropped only slightly, child poverty rates and the percentage of families who are very poor have increased, and the need for emergency housing and food services …

The Aardvark Clear Mine, Limited (a private British company) of Scotland has been designing and producing a variety of mechanical minefield clearance machines for seventeen (17) years. The Mark IV Joint Services Flail Unit (MKIV, see picture 1 on the next page) has been in production since 1999, and it is the product of years of improvement to the Aardvark Flail System basic design. Explicit Versus Implicit Income, Thomas J. Kniesner, James P. Ziliak

By supplementing income explicitly through payments or implicitly through taxes collected, income-based taxes and transfers make disposable income less variable. Because disposable income determines consumption, policies that smooth disposable income also create welfare improving consumption insurance. With data from the Panel Study of Income Dynamics we find that annual consumption variation is reduced by almost 20 percent due to explicit and implicit income smoothing. Consumption insurance is as important economically as private health or automobile insurance. Although taxes have become an increasingly important source of consumption insurance, the 2001 income-tax reform legislation should have little effect on implicit consumption insurance.

The purpose of this research was to assess and project the effects of online shopping on vehicular traffic. It was anticipated that as more people purchased goods and services online. short-distance traffic would be reduced. The method of study was personal interviews following a literature review of this subject. Efforts were focused on consumers’ shopping behaviors and the resulting effects on short-distance traffic. Survey data were combined with forecasts of online shopping volume from eMarketer, and estimates of total trip savings were made for the years 2000 and 2004. The results were not encouraging. We estimated that online shopping reduced …
