This article analyzes the effect of regional economic integration on cross-national policy through the ASEAN Open Skies treaty, particularly in Indonesia, Philippines, and Singapore. This qualitative research applies the concepts of intergovernmentalist-supranationalist regional institution and causal-mechanism that lead to cross-national policy convergence. I argue that ASEAN regionalism as an intergovernmentalist institution affects the process of policymaking, the implementation of ASEAN Open Skies in the regional level, and the adoption of it in the domestic level. To respond the Asian financial crisis in 1997-1999, the governments of Indonesia and Malaysia took different measures to their macroeconomic policies. The government of Indonesia tightened their fiscal and monetary policies, discontinued their intervention in foreign exchange market, and liberalized various sectors of economics while the government of Malaysia adopted expansive monetary and fiscal policies, continued their intervention in foreign exchange market, and controlled capital flows. Why was the same crisis responded by different macroeconomic policies? The article would employ spiral model of conflict proposed by Robert Jervis as a theoretical framework to scrutinize contemporary US and Chinese contemporary competition. As a result, this paper shows how threat assessment could trigger a spiral of conflict through state’s tendency to overestimate threat level and its failure to perceive that defensive behavior can be interpreted as offensive by the belligerent. The field of transitional justice currently views retributive and restorative justice as a means of reconciliation dichotomously. With practice becoming increasingly legalistic, the restorative approach is seen as not forcing accountability. This is a mistake. This article will attempt to show that prosecutions and truth and reconciliation commissions can complement one another to attain the most justice for the most people. Using the case studies of Uganda and the Democratic Republic of the Congo, I will examine under what conditions retributive and restorative justice will be used, and how they can be used to promote national reconciliation.
