Universities, through their libraries, now aim to make more of the scholarship produced available for free to all through institutional repositories. This session will focus on authors' rights and publishing contracts. When academic publishers agree to publish academic works, they require the authors to sign agreements before doing so. In the past, these “agreements” – contracts, by another name – often have contained provisions that primarily benefit the publishers, including assigning intellectual property rights in the works to the publishers and limiting authors’ abilities to use their works after transferring their rights. Digitization and the preservation of digitized materials presents many complex legal questions, like ownership, copyright, and conflicting laws. Digital materials may be subject to many levels of legal restrictions like copying, storage, access, and modification of content. The speaker will probably confuse things even more by talking about some issues that are coming over the hill including legally enforceable duties of stewardship, loss of academic scholarship and legal authority, and arguments against strict enforcement of copyright law. It’s also time to move from collaborations, because they’re good idea, to legally established partnerships, because they have teeth.

The African Copyright and Access to Knowledge (ACA2K) project is a pan-African research network of academics and researchers from law, economics and the information sciences, spanning Egypt, Ghana, Kenya, Morocco, Mozambique, Senegal, South Africa and Uganda. Research conducted by the project was designed to investigate the extent to which copyright is fulfilling its objective of facilitating access to knowledge, and learning materials in particular, in the study countries. The hypotheses tested during the course of research were that: (a) the copyright environments in study countries are not maximising access to learning materials, and (b) the copyright environments in study countries …

Abstract

This article offers reference librarians practical advice on how to approach legal information requests that arrive via the reference desk, as well as through e-mail and chat. It suggests how to avoid the unauthorized practice of law by focusing on the activities reference librarians can safely perform when faced with legal questions from both their on-site and virtual users. The article discusses how reference librarians can conduct effective legal reference interviews both in person and online. Additionally, it suggests ways to include instruction in legal reference encounters, and possible sources for referral of questions that require professional legal assistance.
