Law Faculty Articles and Essays
This article recounts the literature of the late 1990s and early 2000s, when some librarians, considering the changing form of government information, questioned whether the FDLP would survive in its existing form and recommended FDLP changes that would keep depository libraries engaged as the means of accessing digital government information evolved. In the later 2000s, articles and reports included comprehensive suggestions to the GPO, by and on behalf of library associations, of ways to make depository libraries stronger partners in the FDLP. Possibly in response to these calls for reform, the GPO polled depository libraries in its 2012 FDLP Forecast …
From Creativity To Classification: A Logical Approach To Patent Searching, Marian G. Armour-Gemmen
From Creativity To Classification: A Logical Approach To Patent Searching, Marian G. Armour-Gemmen
Faculty & Staff Scholarship
Engineering students and professors need to understand and search intellectual property. In the past, librarians have instructed them on using the United States Patent Classification (USPC). In 2015, after a period of transition, the United States Patent and Trademark Office phased out the USPC and began exclusively classifying in the Cooperative Patent Classification (CPC). This adoption presented librarians a challenge of instructing students and professors in the easiest and most effective patent search. By tying patent searching to an example and presenting classification in an understandable fashion using CPC in conjunction with USPC, this writer presents a logical directed search …

Being a competent attorney means being a competent technologist. ABA Model Rule 1.1 (Competence) requires all lawyers to stay abreast of technology even if they still use a Dictaphone and typewriter and think “the cloud” refers to the fluffy white stuff in the sky. It can be malpractice to misuse or misunderstand technology, and this misuse can take many forms. Lack of familiarity with technology can lead to improper production of confidential information, delays in litigation, wasting time and client funds, ending up on Above the Law (and not in a good way), and more.
Legal technology courses are becoming …

You've probably heard of ROSS Intelligence, Kira Systems, or Lex Machina but what about Premonition, Docubot, or the Do Not Pay chatbot? Artificial intelligence has the potential to transform the practice of law. Or does it? Skeptics predicted a legal apocalypse while optimists predict positive outcomes. Either way, it's a revolution. Find out more about how AI is, and will, impact the legal industry. Topics will include defining artificial intelligence, the history of AI’s development, as well as big law’s approach to AI, ethics implications, and how AI is currently being used in the legal environment. We’ll also discuss whether …

Finding legal information in the United States can be difficult and/or confusing for the layperson. Electronic databases such as LexisNexis or Westlaw may only be accessible for those who can afford it. Even with access to these databases, those without legal training may find them to be overwhelming. This chapter aims to shed some light on the process of doing federal legal research as well as recommend Internet sites where the layperson can get access to free legal resources.

[Excerpt] The UNH School of Law Intellectual Property Library celebrates its twentieth anniversary this year. It is a fortuitous time for this look back and for strategic considerations for the future. This anniversary comes at a time in the history of legal education when conditions over the past few years have intensified the analysis of mission and resources for law school libraries. This article is a retrospective review of the history and dynamics surrounding the founding and first twenty years of growth. It is also an analysis of the future growth and mission of the IP Library during times that …

In this study I ask the question: Can standardized information literacy tests help assess and benchmark the learning of information skills by Canadian law students? This study replicates an earlier study that found that a standardized test of information literacy competencies, SAILS, was not an effective measure of law student information literacy levels. By applying the same test under similar conditions to another group of law students, I found that while the test did not measure legal research competencies, it was effective in measuring basic information literacy skills in law students with often surprising results. I argue that legal research …

Librarians As Advocates For Social Media Privacy, Sarah Lamdan
LACUNY Institute 2015
Librarians must continue their traditional roles as privacy rights activists and intellectual freedom upholders into the digital age, and across electronic information sources, including social media fora. Social media is quickly becoming a major source of information and center for information seeking, and librarians have an opportunity to promote and help shape social media policies that protect users’ privacy and assure that users can seek information without inhibition. One way librarians can be involved in the promotion of online privacy is by joining the social media user rights movement and advocating terms of use agreements that protect information seekers that …

Searching for information and using that information appropriately is an essential part of every engineering design project. It has been reported that design engineers spend about 30% of their time searching for information. Experience shows that even senior level students have not received proper training, either directly or indirectly, in information literacy (IL). They usually search for information intuitively. For mechanical and aerospace engineering students at West Virginia University Institute of Technology (WVU Tech), the Mechanical Engineering System Design I and II courses (MAE 480 and 481) are probably the last chance to teach students about IL. In this project, …

Website Blocked: Filtering Technology In Schools And School Libraries, Jennifer M. Overaa
Website Blocked: Filtering Technology In Schools And School Libraries, Jennifer M. Overaa
School of Information Student Research Journal
This paper investigates the impact of filtering software in K-12 schools and school libraries. The Children's Internet Protection Act, or CIPA, requires that public schools and school libraries use filtering technology in order to receive discounted rates on technology. As a result, nearly all public elementary and secondary schools today use filtering technology. While the provisions of CIPA narrowly define the content to be blocked, filters are often set to block much more than is required. Filtering technology is often ineffective, and many unobjectionable sites end up being blocked, including Web 2.0 sites and tools needed to educate students in …

For three years, engineering librarians from West Virginia University (WVU) have been teaching information fluency skills to 700-1000 freshman engineering students per year, using a specific information fluency cycle. The librarians’ responsibilities in the Fall 2013 course syllabus included teaching once in each section, providing a two-hour, in-library group sessions to accommodate almost 700 students, delivering an intellectual property Blackboard™ module for students to complete over a specific period of time, and requiring students to complete a Plagiarism Avoidance Tutorial with quiz. Some of these components are similar to those of past semesters. However, past collection of the data was …

Social media platforms such as Facebook, Twitter, and Instagram allow individuals and companies to connect directly and regularly with an audience of peers or with the public at large. These websites combine the audience-building platforms of mass media with the personal data and relationships of in-person social networks. Due to a combination of evolving user activity and frequent updates to functionality and user features, social media tools blur the line of whether a speaker is perceived as speaking to a specific and presumed private audience, a public expression of one’s own personal views, or a representative viewpoint of an entire …

Research And The Professional : Navigating A Spectrum Of Legal Resources., Erin K Gow
Faculty and Staff Scholarship
Legal research is complicated by the growing amount of information available, and there is evidence that legal practitioners require additional training in order to enhance their information literacy and legal research skills. Librarians have a key role to play in developing legal research training, and examples taken from Middle Temple's library are used to illustrate ways in which librarians can offer beneficial training to their library users. This involves assessing the skills, motivation, and needs of the average library user in order to design legal research training that is educationally sound and appealing to the target audience.
