In the typical criminal trial, a defendant is trying to prove he/she is not guilty because they were not the individual that committed the crime. However, another type of defense exists in which the defendant admits they were the culprit, but provides an excuse in an attempt to avoid criminal punishment. These so called "excuse defenses" include insanity, involuntary intoxication, age, and entrapment. In all cases, juries are required to determine whether the defendant had sufficient mental capacity to form the intent to commit the crime. This paper follows my personal journey in learning about this problem, its legal repercussions for individual soldiers, its history within the United States, the actions which are being taken to remedy it, and its cost to the US military as a whole. By taking a more personal approach and by using my personal experience as an intern as a US Army Judge Advocate Corps office, this paper intends to educate the wider college populace about this issue and its current handling by the US Army from the perspective of an insider.

Knowledge Of Juvenile Sex Offender Registration Laws As A Predictor Of Adolescent Sexual Behavior, Cynthia J. Najdowski, Margaret C. Stevenson, Tisha Ra Wiley

Because juveniles can now be registered as sex offenders, we conducted a pilot study to investigate awareness of these policies and sexual behavior histories in a convenience sample of 53 young adults (ages 18 to 23, 79% women). These preliminary data revealed that 42% percent of participants were unaware that youth under the age of 18 can be registered as sex offenders, and when informed that they can be, participants were unaware of the breadth of adolescent sexual behavior that warrants registration. Furthermore, those unaware of juvenile registration policies, compared to those who were aware, were marginally more likely to …

An emerging area of study has begun to look at the perceptions of justice of the family and friends of crime victims – or, secondary victims. It is important to improve understanding of secondary victims’ experiences of justice, partly because knowledge about how they perceive justice may help forensic psychologists assist them more effectively. This research attempted to assess how well existing justice theories could account for secondary victims’ perceptions of justice, and also help determine what is important to them. Moral exclusion refers to a psychological process that removes others from our moral community--those whom we treat with fairness and concern for their welfare. The present research is concerned with how perceived symbolic threats (threats to the ingroup's values, morals, and worldview) and realistic threats (threats to the ingroup's well-being and resources) are related to moral exclusion. Perceived symbolic and realistic threats from an outgroup (Mexican immigrants) were measured (Study 1) and manipulated (Study 2) to discover their predictive and causal relationships with moral exclusion. Sexual homicide is a rare occurrence. Little is known about the offending perspective of sexual homicide from a criminological standpoint. Recently, Chan, Heide, and Beauregard (2011) proposed an integrative theoretical framework using concepts and propositions of Social Learning Theory (differential association, definitions, differential reinforcement or punishment, and imitation) and Routine Activities Theory (a motivated offender, an attractive and suitable target, and the absence of a capable guardian or guardianship) to elucidate the sexual homicide offending dynamics. The distinctive aspect of phenomenological theories of crime is that they are based upon a stated epistemology: how things are known and a specific ontology—the nature of social reality. This specificity aligns itself with neo-Kantian concern with forms of knowing, interpretation, and meaning, as well as with 20th-century concern with perception, cognition, and the framing of events. While there are influences of phenomenological thinking on varieties of theorizing, such as symbolic interactionism, critical theory, queer theory, and gender-based theories of crime, these ideas are refractions and are inconsistent in their reference to and understanding of the foundational phenomenological works. Despite the increased social recognition, law and policy changes within the criminal justice system, and the widespread use of court mandated batterer intervention programs (BIPs) domestic violence continues to be a persistent problem. The lack of significant decline in incidence rates along with a growing body of empirical evidence that indicates BIPs are, at best, only moderately effective raises serious concern. Effective policies and programs are based upon empirically tested theory. The purpose of this study was to investigate the influence of phenotypic variation on criminal judgment. This study had two phases. In the first phase, participants rated multiple headshot photographs on the degree to which African American men possess pronounced Afrocentric features (fuller lips, broader nose, curlier hair, darker skin, etc.). The race of the participants predicted 34.2% of the variance in average skin color ratings above all other variables. White participants rated the Black faces as darker than any other participants rated the same faces. Researchers used the faces rated least, average, and most prototypical of Blacks as the …

Spanish-language testimony is an extra-legal variable not widely studied in the legal psychology field. More emphasis has been placed on the translation of the testimony as well as accent attitudes. The current study extended research conducted by Stephan and Stephan (1986) to investigate the impact of Spanish-speaking defendants and mock-juror's language use and proficiency on sentencing recommendations. Two hundred and seventy-seven participants from the University of Texas at El Paso read a case vignette of a first-degree aggravated assault and asked were asked to provide sentence recommendations for the defendant. Few researchers have studied the predictive ability of childhood animal cruelty motives as they are associated with later recurrent violence toward humans. Based on a sample of 180 inmates at one medium- and one maximum-security prison in a Southern state, the present study examines the relationship among several retrospectively identified motives (fun, out of anger, hate for the animal, and imitation) for childhood animal cruelty and the later commission of violent crimes (murder, rape, assault, and robbery) against humans. Almost two-thirds of the inmates reported engaging in childhood animal cruelty for fun, whereas almost one-fourth reported being motivated either out …

Stereotype Threat In Criminal Interrogations: Why Innocent Black Suspects Are At Risk For Confessing Falsely, Cynthia J. Najdowski

Little theoretical attention has been paid to evidence that Blacks are overrepresented in samples of false confessors compared to Whites. One possible explanation is that innocent Black suspects experience stereotype threat in interrogations and that this threat causes Black suspects to experience more arousal, self-regulatory efforts, and cognitive load compared to White suspects. These psychological mechanisms could lead innocent Black suspects to display more nonverbal behaviors associated with deception and, ironically, increase the likelihood that police investigators perceive them as guilty. In response, investigators might engage in more coercive tactics and exert more pressure to confess on Black suspects than …

Law enforcement is an inherently risky occupation. The number of traffic-related fatalities for law enforcement officers in the U.S. during the past 13 years has been increasing; however, the number of fatalities for the general population in motor vehicle traffic incidents declined during the same time period.

The federal government reports that federal motor vehicle safety standards aswell as behavioral and vehicle safety programs implemented by state and local law-enforcement agencies contributed to the downward trend for the general public.
