Consumer Debt, Alcohol Use, And Domestic Violence In Guam, Thomas K. Pinhey, Daniel A. Lennon, Nicholas A. Pinhey

Pacific Studies

Using community-level economic and crime data derived from secondary sources, this brief study explores the relationships between consumer debt, alcohol use, and domestic violence in Guam for the years 1982 through 1993. The results of the analysis indicate that higher levels of consumer debt are strongly related to greater alcohol consumption and domestic violence, thus suggesting that “financial strain” may be an important variable for understanding patterns of substance abuse and family violence in Guam. The implications of these results for theory and future research on substance abuse and domestic violence are also discussed.

The lecture/tutorial format is the dominant structurethrough which law is taught in Australia. This articleexamines the learning environment of the law tutorial, andsuggests approaches aimed at maximising the learningexperience for students, on the basis of students’ learningpreferences. The discussion utilises Golay’s learningpattern assessment in developing an understanding of thedifferent learning styles of students. Based on thisanalysis, activities are advanced which advocate andimplement joint tutor-student responsibility for learningwithin tutorials. It is argued that students will learn moreeffectively, and expand their learning experiences wheninvolved directly in the structure, format and content ofthe tutorial itself.

Connections Of Self-Esteem And Gang Membership, Annette C. Miller

Student Work

Reasons for gang membership have been hypothesized but very little empirical research has been conducted trying to determine why individuals join and remain in delinquent gangs. Low self-esteem has been suggested as a reason for entering into delinquency and joining a gang. Research has shown gang members have lower overall self-esteem than do non-gang individuals (Wang,1994). An enhancement in this low self-esteem has been suggested as a reason for continuing with gang membership and delinquent behavior. There are mixed results in the research examining the connection of delinquent behavior and increased self-esteem. Kaplan's (1975) self-esteem enhancement theory has not been …

Factors Affecting Fear Of Crime And Victimization Of Residents In Nebraska, Melissa Megerson

Since the 1960's, fear of crime has increased dramatically, causing a heightened interest in the factors contributing to this problem. The purpose of this thesis is to examine factors that affect fear of crime, perceived risk of victimization, and actual victimization. Data was obtained from a telephone interview of 500 Nebraska residents, 18 years of age or older conducted in 1996. Analysis of the data indicates that females and those respondents with an income of under $20,000 have an increased level of fear of crime. Those respondents who were victimized reported a greater perceived risk of victimization. Similarly, those respondents …

This article traces some of the controversies surrounding DNA evidence and argues that although many have been laid to rest by scientific developments confirmed in the National Research Council's second DNA report, there remain several problems which are likely to lead to continued questioning of standard ways prosecutors present DNA evidence. Although much about the report is to be commended, it falls short in several ways, the most important of which is in its support for presenting random match probabilities independent of plausible error rates. The US Supreme Court decision Deshaney v. Winnebago County Department of Social Services cited; "the police or other government agents are under 'no general duty' to provide services, such as protection, to any particular citizen. But rather, duty to provide public services owed only to the public at large, and absent special relationships between police and individuals"(09 S.Ct. 998/1989). At the same time of this decision, the public was undergoing a trend of proliferating millions of personally owned firearms for self-defense and sport. In addition, citizens are now carrying concealed handguns in the 31 states that allow such a behavior. …

Dispute settlement under the General Agreement on Tariffs and Trade (“GATT”) has come under increasing strain in recent years. The major powers often ignore GATT dispute settlement decisions which do not comport with their economic interests. This situation undermines the credibility of the GATT and threatens the system's framework. If dispute settlement under the GATT continues to be ineffective as it has been through much of the 1980s and early 1990s, GATT member states (“Members”) may well lose faith in the system, begin reimposing the tariffs that were present before the GATT, thereby risking worldwide trade war and possibly consequences …

Dissertations and Theses

Racial and ethnic minorities are disproportionately represented in Portland, Oregon's criminal justice system. Laws, legal procedures and practices that excessively target minorities are not new phenomena. This study focused on a history of political and social conditions in Oregon, and subsequently, Portland, from the 1840's to 1895, that created unjust state laws and city ordinances that adversely impacted Native Americans, African Americans, and Chinese Immigrants. Attention was also given to the Jewish population.

The approach was to examine available arrest and court records from Oregon's and Portland's early beginnings to ascertain what qualitative information records could provide regarding the treatment …

Third Circuit Holds That Prayer At Graduation Is Unconstitutional Even If It Results From A Student Vote, Richard E. Moberly

Despite the Supreme Court's 1992 holding in Lee v. Weisman that state-sponsored prayer during a public school graduation ceremony violates the Establishment Clause, the issue of graduation prayer has recently resurfaced. Seeking to avoid Lee's prohibition, school boards have allowed students to decide by majority vote whether prayer will occur at graduation. The Third Circuit recently held, however, that these state-authorized student referenda regarding prayer violate the Establishment Clause. In ACLU v. Black Horse Pike Regional Board of Education, the court properly recognized the danger that popular votes could pose to the protections of the Establishment Clause, yet …

Is devolution of power to sub-national governments by the constitution of federal states or by delegation in other nations a threat to maximizing the benefits of free trade within the Americas? Conversely, is the drive towards regional free trade a threat to the goals of federalism and decentralization? These are two of the many questions that arise in revisiting NAFTA and eyeing the successful creation of a Free Trade Agreement of the Americas (FTAA) by the year 2005, an initiative launched by thirty-four nations within the region in December 1994.

Methylenetetrahydrofolate reductase catalyzes the reduction of methylenetetrahydrofolate to methyltetrahydrofolate, which serves as the methyl donor for the conversion of homocysteine to methionine in the reaction catalyzed by methionine synthase. Recent studies have provided evidence for association of a common polymorphism of methylenetetrahydrofolate reductase with elevated levels of blood homocysteine, a metabolite correlated with increased cardiovascular risk in humans. In this chapter, we review earlier studies on the properties of the mammalian enzyme, interpreting these observations in the light of the deduced amino acid sequence for the human enzyme. The catalytic portion of the human enzyme shows significant sequence homologies with …

The Narrow And Shallow Bite Of Romer And The Eminent Rationality Of Dual-Gender Marriage: A (Partial) Response To Professor Koppleman, Richard F. Duncan

The Supreme Court's opinion in Romer has a very narrow and shallow bite. It does not hold that homosexuals are a suspect or quasi-suspect class under the Equal Protection Clause. It does not overrule or undermine the Court's landmark decision in Bowers v. Hardwick."° It does not hold that moral disapproval of homosexual conduct is invidious or irrational, nor does it in any way state or imply-as Professor Koppelman asserts-that laws that discriminate against homosexuals are always "constitutionally doubtful ... because they will always arouse suspicion that they rest on a bare desire to harm a politically unpopular group."

It bears repeating that the Supreme Court's decision in Romer is of trivial doctrinal import. The Court did not recognize homosexuals as a suspect or quasi-suspect class, nor did it reverse or undermine its landmark decision in Bowers v. Hardwick. Moreover, the narrow holding of Romer suggests quite strongly that typical laws disadvantaging homosexuals--the military exclusion, the heterosexual paradigm of civil marriage, and perhaps even better-crafted and more narrow versions of Amendment 2--do not offend the Equal Protection Clause. These laws rationally advance legitimate government interests and should easily pass scrutiny under the rational basis test applied by the …
