In recent years, some legal scholars have argued that legal scholarship could benefit from a greater reliance on theories of human behavior that arise from biological evolution. These scholars contend that reliance on biological evolution would successfully combine the rigor of economics with the scientific aspects of psychology. Complex legal systems, however, are uniquely human. Law has always been the product of cognitive processes that are unique to humans and that developed as a response to an environment that no longer exists. Considering the current staggering number of people under various forms of government supervision, reducing recidivism is a serious concern of the criminal justice system. A possible solution to this problem may lie in intensive supervision programs (ISPs) that were implemented in every state by 1990. This thesis evaluates Washington State's First-Time Offender Waiver (FTOW) to determine whether it is a viable alternative to prison for eligible nonviolent offenders. Specifically, I want to know: (1) Is there is a bias in who is sentenced with FTOW based on demographic variables? (2) Do FTOW recipients recidivate more or less compared to eligible …

Offenders with mental illness who are serving correctional sentences are released to the community.Without support systems linking their transition to community-based programs following release from prison, the services necessary for their community reintegration are often fragmented and attenuated. Nearly two thirds of all inmates return to prison, and offenders with mental illness face major challenges during reintegration and have an even more difficult time living in the community without specialized, informed services. This article describes a Massachusetts program designed to bridge the transition of offenders with mental illness from incarceration to the community.The authors review historical and recent trends that …

I would like to take a look at how federalism affects foreign relations law in the United States. About ten years ago some scholars began questioning the foreign affairs orthodoxy, what is sometimes referred to as foreign affairs exceptionalism, in U.S. constitutional law.' They came to be known as the revisionist scholars. Three features characterize foreign affairs exceptionalism. The first feature is Executive Branch preeminence in foreign affairs, in contrast to congressional control. The second feature is judicial law making in foreign affairs. The federal government's single largest tax subsidy today is for a retirement plan system voluntarily sponsored by employers. Rather, these proposals are likely to enhance the benefits of higher income employees who already have retirement plan coverage, reversing the progress that had been made during the late 1980s and early 1990s toward making the pension tax law system more equitable. I propose that Congress should close, or at least narrow, the loopholes in the pension tax law system that reduce the scope of retirement plan coverage and benefits for rank-and-file workers. Argues for a judicial interpretation of ERISA that encourages employers to select a default investment option for automatically enrolled participants that is broadly diversified in the equity markets, rather than a low-earning money market fund. Another potential conflict of interest arises when an employer includes company stock as an investment option, which can lead to potential breaches of the employer's duty of loyalty under ERISA. The question presented to the federal court is whether Employer has satisfied its fiduciary duty of prudence by selecting company stock as an investment option. Small businesses are an important part of the U.S. economy. When small businesses need to raise capital from the public, they must comply with securities laws and regulations. Most operators of small businesses are unfamiliar with the intricacies of securities law. As a result, they are likely to unwittingly violate these laws. This, combined with the high relative cost to small businesses of registering securities, led the Securities and Exchange Commission (SEC) to create several exemptions, including Rule 504 of Regulation D. Small businesses are an important part of the United States economy. In 1996, there were about 5.5 million small businesses in the United States employing between zero and five hundred workers, about 99% of all non-farm U.S. businesses. Businesses with five hundred or fewer employees employ 53% of the private non-farm work force in the United States, account for 47% of all sales, and are responsible for 51% of the private gross domestic product. During the period 1992 to 1996, small firms with fewer than five hundred employees also created virtually all of the net new jobs in the U.S. …

The purpose of this article is to analyze and theorize about the general applicability standard and its impact on the free exercise of religion. At the end of the day, I will argue that free exercise is alive and well in the wake of Smith and (particularly) Lukumi.

Crime Victims’ Satisfaction With Police Services: An Assessment In One Urban Community, Richard Tewksbury, Angela D. Crews

Criminal Justice Faculty Research

A 3‐month study examined crime victims’ satisfaction with police response to calls for service. Respondents were asked to rate officers with whom they interacted in overall satisfaction, and in courtesy/politeness, speed of response, concern, and helpfulness. Results indicate consistently high overall ratings. Nonparametric statistics indicate that female respondents rated officers significantly higher than male respondents, but no other demographic (age, race, education) or experiential variables (reason for call, location of problem, prior contact with police) significantly impacted ratings. Nonparametric correlations indicated that an officer's perceived helpfulness was the strongest correlate of overall satisfaction, while speed of response was the weakest.

Of all crimes against children, sexual abuse has arguably captured the greatest share of attention from child advocates, professionals, policymakers, and the general public. During the 1980’s, increasing numbers of victims were identified each year (American Association for the Protection of Children, 1988) and concerns about this crime intensified. However, a dramatic shift in child sexual abuse trends has occurred. Data from child protective services (CPS) agencies across the country indicate that the increases of the 1980’s were followed by an extensive period of marked declines in the 1990’s.
