Innocent fatalities are a concern of all social activity with a capacity to kill. This is especially true when the social activity is the death penalty since an innocent person's execution is not simply a tragic collateral consequence of activity with a non-fatal objective. Instead, the taking of life is the goal of the enterprise, and the killing is the intended act of the state.

There is another difference between accidental fatalities in other social activities and those that occur when the capital system miscarries. Typically, the former fatalities are easy to spot and quantify; the latter are not. Precisely …

This article fills that gap by identifying and explaining the ethical obligations law clinic students and supervising clinical faculty encounter in case and client selection due to conflict of interest and competency considerations. There is growing awareness that serious, reversible error permeates America’s death penalty system, putting innocent lives at risk, heightening the suffering of victims, leaving killers at large, wasting tax dollars, and failing citizens, the courts and the justice system.

Our June 2000 Report shows how often mistakes occur and how serious it is: 68% of all death verdicts imposed and fully reviewed during the 1973-1995 study period were reversed by courts due to serious errors.

Analyses presented for the first time here reveal that 76% of the reversals at the two appeal stages where data are available for study were …

This study uses data from the 1997 Survey of Inmates in State Correctional Facilities to examine the characteristics of persons incarcerated for victimizing children and youth. This OJJDP Bulletin, part of the Crimes Against Children series, presents a wide range of information pertaining to victimizers of children, including offense characteristics, offender histories, overall trends, and the severity of sentences received by such criminals. Significant differences between offenders incarcerated for crimes against juveniles and offenders imprisoned for crimes against adults are highlighted. Figures and tables illustrate the Survey's major findings.

This study examines the sociodemographics, drug use, criminal, and treatment histories of 598 residential and outpatient legally coerced drug treatment seekers in the Kentucky Treatment Outcome and Performance Pilot Studies Enhancement Project. Analyses examined whether users/addicts entering chemical dependency treatment under legal coercion differed from nonlegally coerced treatment seekers. Stanley Cohen's theoretical model of social control provided the theoretical framework for the study. Results showed demographic and behavioral differences were noted between respondents under no coercion and those under legal coercion on gender, age, educational status, pretreatment criminality and current treatment modality. The following article examines differences in the social situation of intimate partners as an explanation of racial differences in the female to male ratio of spousal homicides in Canada. An analysis of homicide data from 1961 to 1983 generated by the Canadian Centre for Justice Statistics reveals that the ratio of women killing their husbands to men killing their wives is highest for Aboriginals and lowest for Blacks, with the ratio for Whites falling in between. The possible sources of racial differences in this ratio include the proportion of couples (a) in common-law relationships, (b) who are co-residing as opposed …

Involvement In Sports And Engagement In Delinquency: An Examination Of Hirschi's Social Bond Theory., Randy Hass

Sports have been proposed as a means of reducing participation in delinquency. One criminological theory that would support this hypothesis is Travis Hirschi's social bond theory. The involvement element of that theory proposes that engaging juveniles in non-delinquent activities reduces engagement in delinquency. However, the relationship between sports and delinquency has not been adequately tested. Data from the first wave of the National Youth Survey were examined by ordinary least squares regression to determine if there was evidence supporting school sponsored sports programs as a means of reducing delinquency. As part of OJJDP's Crimes Against Children Series, the Bulletin offers detailed information about overall crime patterns and victim age groups. Specific types of juvenile homicide, including maltreatment homicides, abduction homicides, and school homicides, are discussed in further detail. The Bulletin also explores initiatives designed to prevent homicides of children and youth.

In the not so distant past, before the Internet, doing legal research necessitated access to either a substantial law collection or one of the expensive legal databases, Lexis-Nexis or Westlaw. That limited legal reference to law librarians, some special librarians and reference librarians at large university or public libraries. The Internet has changed all of that, giving any library with an Internet connection access to a wealth of current law, especially at the state and federal level.

Attitudes Toward The Death Penalty In Kentucky: A Comparison Of Survey Results-1989, 1997, 1999, Gennaro F. Vito

Kentucky Justice and Safety Research Bulletin

This bulletin examines changes in the attitudes of Kentucky residents toward the death penalty. Over the period 1989 to 1999, the level of opposition to the death in Kentucky has risen. In 1999, 28.3 percents of the respondents were either strongly (17.3 %) or somewhat (11%) against the death penalty. Also, the percentage of respondents who were unsure about the use of capital punishment declined from 16.3 to 12.5 percent. By 1999, support for the death penalty had declined by 10 percents points (59.2 %).

Presents information on the frequency and nature of crimes committed against children by babysitters. As part of OJJDP's Crimes Against Children Series, the Bulletin draws on the FBI's National Incident-Based Reporting System (NIBRS) to examine victim and offender characteristics, including gender, age, type of injury, and victim-offender relationship. The Bulletin also presents an overview of how NIBRS works to collect a wide range of criminal information for a variety of offenses. The Bulletin concludes by examining the implications of NIBRS data, particularly in regard to the severity of threat posed to children by babysitters.

For the past few decades, criminologists have evaluated the success of treatment programs as the primary strategy to identify the best ways to lower offender recidivism. In doing so, they have repeatedly overlooked staff burnout as a potential barrier to rehabilitation. Because past research in human service agencies in general and prisons in particular has found organizational and administrative shortcomings to have the greatest impact on job strain and discomfort, this exploratory study examined the relationship between administrative support and the burnout of prison treatment staff. Child abuse is commonly regarded as a child welfare problem, and a considerable amount of information has been amassed from this perspective. When a child is assaulted, however, it is not only a child welfare problem, it is a crime, and yet there is a lack of law enforcement data available for researchers to analyze. Use of the National Incident-Based Reporting System (NIBRS), which collects detailed data about crime and its victims, should help fill this gap. Characteristics Of Recidivism Among Intensive And Regular Probationers., Jennifer Joseph

This study examined characteristics of 100 intensive probationers and 100 regular probationers to have a better understanding of why some probationers recidivate and others do not. Logistic analysis was used to analyze the following variables: age, race, gender, employment status, level of education, convicted offense, prior misdemeanor arrests, prior felony arrests, history of drug abuse, and type of probation. It was discovered that age, prior misdemeanor arrests, and offender category were significant variables correlated to recidivism. These findings are consistent with prior research and provide information that can be helpful to probation and parole officers in their supervision of offenders …

An Examination Of Juvenile Delinquency And Victimization Using An Integrated Model Approach., Kimberly Dawn Dodson

The theories of social bond, differential association and routine activities were synthesized into one theoretical model to determine its predictive utility in the explanation of juvenile delinquency and victimization. Using cross-sectional data obtained from the Gang Resistance Education and Training (G.R.E.A.T.) survey, a sample of 1,555 middle school students was examined. The results of the Ordinary Least Squares (OLS) regressions indicate that the integrated model explains between 33% and 37% of the variation in delinquent behavior (i.e., property crime, violent crime and alcohol and illegal drug use). The purpose of this presentation is to examine the growing problem of "Preppie Gangs" in America. Involved youngsters generally come from the affluent upper class and participate in activities similar to traditional gang members. However, they tend to operate in a much safer environment than traditional street gangs and are predominantly "rich white kids". This paper will examine how these groups are currently manifesting themselves as Delinquent Gangs (Mimicking Other Street Gangs), Ideological Gangs (Specific Ideology or Belief System), or Occultic Gangs (Alternative Belief System Connections). Finally the unique issues of activities, causes, and solutions will be discussed .
