Evaluating Sex Offenders Under Sexually Violent Predator Laws: How Might Mental Health Professionals Conceptualize The Notion Of Volitional Impairment?, Cynthia Calkins Mercado, Robert F. Schopp, Brian H. Bornstein

This paper examines the significance of the Supreme Court’s Hendricks and Crane decisions, with focus given to how mental health professionals may conceptualize the notion of volitional impairment. The Hendricks decision authorized postsentence civil commitment for sex offenders having a mental abnormality or personality disorder, rendering them likely to engage in future acts of sexual violence. In the Supreme Court’s majority opinion, Justice Thomas implied that the Kansas Act was legitimized by limiting the class of offenders eligible for this specialized form of commitment to those who are “unable to control” their dangerousness. In Employment Division v. Smith, the Supreme Court revised its jurisprudence of religious liberty by declaring that, as a general rule, the free exercise of religion may be prohibited by government so long as it does so by means of a neutral law of general application. However, in Church of the Lukumi Babalu Aye, Inc. v. City of Hialeah, the Court made clear that "[a] law burdening religious practice that is not neutral or not of general application" violates the Free Exercise Clause unless the government justifies the restriction on religious liberty by passing a surpassingly strict compelling …

How accurately people use verbal and nonverbal cues to detect deception appears to be a function of a skeptical orientation toward the truthfulness of the subject. In previous studies, some differences in gender and the detection of deception are cited, but most studies are inconclusive about whether such differences exist. In the present study, university students are asked to judge brief interviews of suspects in a mock crime criminal investigation. Suspects are either "guilty" or "not guilty" in the mock crime scenario. "Guilty" suspects include two persons who are present at the time of the mock crime. A third person, …

Mentally ill juveniles who are incarcerated in correctional facilities receive minimal or no treatment services. The research in this thesis determines that mentally ill juvenile offenders receive inadequate treatment. It also determined that juvenile correctional officers as well as others in the criminal justice system are not trained properly to deal with mentally ill juveniles.

The Geo-Spatial Analysis And Environmental Factors Of Narcotics Hot Spots, Stefanie Wrae Balchak

A mixed methodological approach with two different analytic procedures and multiple data sources was used to examine narcotics hot spots. The first phase compares two methods of hot spots identification; the prediction model and the actual crimes. The second phase involves an intensive study to better understand the phenomenon of drug hot spots areas consistently shown to be repeat hot spots.

The Effects Of Family Size On The Development Of Delinquency, Tasha Deleeuw Gilbert

This proposed study used a pre-existing data set, which is a longitudinal study of children born between 1959 to 1962. The sample consists of 987 "high risk" black children whose mothers were participating in the Collaborative Perinatal Project at the Pennsylvania Hospital in Philadelphia. Findings demonstrate that family size is more important in predicting delinquency than previously thought.

This research looks to identify precursors to women becoming involved in trafficking for prostitution and/or sexual services in the United States. The failure to find patterns or trends regarding why women are trafficked or what types of women are trafficked most often, helps dispel some myths regarding the stereotypical victim of trafficking.

Perhaps no other special event rivals the Olympic Games in scope, duration, and potential for threat to communities, participants, and dignitaries. This paper reports on the results of a study of safety and security at the Salt Lake Olympic Games by a team of researchers with wide-ranging access to operations, personnel and documents from the security effort at the 2002 Winter Games. The purpose of this study is to measure and compare calls for service at the apartment communities participating in the Crime Free Multi-Housing Program in the belief that a reduction in calls for service should translate to a reduction in crime. ‘Communities That Care’ (CTC) is a research-based operating system designed to help communities identify and reduce risk factors, enhance protective factors, and prevent a number of adolescent problem behaviors, including delinquency, violence, substance abuse, school drop-out, and teen pregnancy. Indiana, PA, is one of approximately 125 communities throughout Pennsylvania that have chosen to use the CTC approach to promote the positive development of children and youth in the local area. This paper presents an initial review of Indiana Area CTC, in terms of the planning and implementation efforts that have taken place during the past five years.

In 2003, the Kentucky Supreme Court adopted the amended KRS 412, effectively making the language of KRE 412 consistent with the analogous Federal Rule of Evidence 412. Now, as in federal court, the provisions of the Rape Shield Law apply in both criminal and civil cases to govern when and how evidence of a victim's alleged sexual behavior or sexual predisposition may be introduced. The article describes the intent of the original Rape Shield Law and the implications of its amended version in both civil and criminal cases.
