Václav Havel had two eventful terms as the first democratic president of the Czech Republic. The documentary Citizen Havel is one rhetorical artifact that captures the way a new democracy and its attendant executive power is constructed consciously in real time in a political culture where such a tradition has largely not existed. Culled from ten years of fly-on-the-wall-style footage, Citizen Havel captures the tensions between the constitutional expectations of the Czech presidency and Havel's own extraconstitutional interpretations of executive power. States have rights to unilaterally determine their own immigration policies under international law and few international institutions regulate states’ decision-making about immigration. As a result, states have extensive discretion over immigration policy. In this paper, I argue that states should join international migration institutions that would constrain their discretion over immigration. Immigration restrictions are morally risky. When states restrict immigration, they risk unjustly harming foreigners and restricting their freedom. Furthermore, biases and epistemic defects pervasively influence states’ decision-making about immigration policy. States should transfer some of their decision-making authority over immigration to more reliable institutions in order to mitigate the …

Many people think that citizenship should not be for sale. On their view, it is morally wrong for states to sell citizenship to foreigners. In this article, I challenge this view. I argue that it is in principle permissible for states to sell citizenship. I contend that, if states can permissibly deny foreigners access to citizenship in some cases, then states can permissibly give foreigners the option of buying citizenship in these cases. War can create a massive amount of death while also straining the capacity of states and civilians to cope with disposing of the dead. This paper argues that such moments exacerbate contradictions between three fields and “economies” (logics of interaction and exchange) – a political, market, and moral economy of disposal – in which order and control, commodification and opportunism, and dignity are core logics. Human rights based approaches to property rights in Sub-Saharan Africa note women’s secondary or derivative rights to land under customary law, correctly identifying inequalities in rules and practice. Communitarian approaches, on the other hand, address the adaptability and accessibility of land regimes defined by customary law. The Strugatskii brothers’ novella Ponedel’nik nachinaetsia v subbotu (Monday Begins on Saturday; 1965) imagines bright young scientists working at the cutting edge between quantum physics and folktale sorcery in a setting that was undeniably contemporary and local. I argue that the story can be best understood as ‘soc(ialist) romanticism’ – an aesthetic mode that celebrates the possibilities for individual questing and agency in late Soviet socialism. Konstantin Bromberg’s 1982 adaptation of the Strugatskiis’s story abandons both the romanticism and complexity of the novella, but, by incorporating elements of the‘youth film’, it represents a different kind of Soviet rom-com.

Empire’s Children is far from the now well-worn tale of imperial decline. It locates the shifting fortunes of the child emigration movement at the heart of the reconfiguration of identities, political economies, and nationalisms in Britain, Canada, Australia, and Rhodesia. Though Britons eventually had to face the diminishing importance of Britishness as either a cultural or racial ideal in the eyes of even their settler colonies, on the whole the story of the child emigration movement’s shifting fortunes testifies to the malleability and resilience of Britishness.

V období mezi lety 1950 a 1980 země v různých částech Latinské Ameriky zaznamenaly nebývale dramatický společenskopolitický vývoj, jehož důležitým mezníkem byla kubánská revoluce. Tato skutečnost se odrazila i v oblasti kultury. Na levicově orientované politické scéně vládlo přesvědčení o nevyhnutelnosti ozbrojeného boje za lepší společnost, přičemž klíčová úloha se přisuzovala cheguevarovské doktrině „nového člověka“. Tímto směrem se obraceli především ti, kteří ve své zemi chtěli svrhnout vládnoucí diktaturu a kořeny četných problémů tehdejší společnosti spatřovali především v sociální nerovnosti. Celou Latinskou Ameriku zachvátily revoluční myšlenky.

Resource management is a highly contested topic, as various methodologies have been employed by governments, corporations, and interest groups across the globe. Contemporary debates regarding resource management primarily focus on two linked issues: the role of government and problem recognition. This paper will explain the two different resource management strategies and delve into the problem recognition process. Ultimately, this paper will examine the Haitian-Dominican borderland to address both of these issues and demonstrate the need for an integrated, sustainable, interventionist approach in the management of borderland resources.

Several political theorists argue that states have rights to self-determination and these rights justify immigration restrictions. Call this: the self-determination argument for immigration restrictions. In this article, I develop an objection to the self-determination argument. I argue that if it is morally permissible for states to restrict immigration because they have rights to self-determination, then it can also be morally permissible for states to deport and denationalize their own citizens. We can either accept that it is permissible for states to deport and denationalize their own citizens or reject the self-determination argument. To avoid this implication, we should reject the …

Based on micro-level analysis of the developments in the steel sector in Poland, Romania and Slovakia, this paper examines the effects of multinational corporations (MNCs) on labour unions in Central and Eastern Europe. It makes a three-fold argument. First, it shows that union weakness can be attributed to unions’ strategies during the restructuring and privatization processes of postcommunist transition. Consequently, tactics used for union regeneration in the West are less applicable to CEE. Rather, the overcoming of postcommunist legacy is linked to the power of transnational capital. Customary law is an alternative legal framework to statute or public law. In the past the existence of customary law was viewed as problematic due to the uncertainty which accompanies legal pluralism. Increasingly, scholars are recognizing legal pluralism as simply a reality to be negotiated, rather than a problem. One frequently proposed solution to the difficulties posed by the existence of customary law is to write it down, or ascertain it, in order to provide for legal certainty. A community recovering from war or ethnic conflict has to find ways of reweaving the fabric of economic and social life with new patterns of interaction and changed demographics.² In post-­‐‑conflict settings customary law has a particular attraction because of the moral authority it brings to the establishment of order. Customary law is familiar, tied to the identity and history of a community, and operates independently of outside resources. Some bioethicists and political philosophers argue that rich states should restrict the immigration of health workers from poor countries in order to prevent harm to people in these countries. In this essay, I argue that restrictions on the immigration of health workers are unjust, even if this immigration results in bad health outcomes for people in poor countries. I contend that negative duties to refrain from interfering with the occupational liberties of health workers outweighs rich states’ positive duties to prevent harm to people in sending countries. There is currently in international law an overstatement of the tie between property and identity. International conventions have folded property into a set of immutable human rights. There needs to be greater flexibility and nuance in this perspective. In this paper we identify two approaches to property rights: the first, which argues that property and identity are necessarily bundled together and considers property to be a human right; and the second which understands them as explicitly separate and views property as a commodity. Beneath the seeming chaos and conflict of Russia's post-socialist experience were structured dynamics of contentious reconstruction of fields (collective relations of power and culture institutionalized as authority and definitions of "normal"). This essay argues that the Russian experience was driven in no small part by contention over remaking core meanings and authority of field relations, practices, and boundaries. Contention over field reconstruction emerged as three groups' interests and taken-for granted meanings of normality collided: those of Soviet-era managers, a new class of financial entrepreneurs and elites, and state elites and officials.
