The contemporary neoliberal economic order plays a significant role in American social organization and policy-making. Most importantly, neoliberal ideology drives the creation and imposition of markets in public goods and services and the valorization of free market ideology in cultural life. The neoliberal ‘project of inequality’ is in turn delimited and upheld by an authoritarian system of punishment built around mass incarceration, surveillance, and an unprecedented level of social control directed at the lowest strata of American society – a group that includes both the urban underclass, and unauthorized immigrants.

The commodification of culture, space, and resources is incentivized by neoliberal urbanism. In response, we have seen an attempt to develop collectively organized, oppositional spaces within urban places. The tensions that arise when considering the production of commons in the development of the neoliberal city are the central focus of this paper. As I will observe, these spaces are subjected to commodification as they become increasingly de-politicized through neoliberal ideologies. In order to theorize about these contradictory elements, I observe a makerspace in Richmond, Virginia called HackRVA. Specifically, I consider HackRVA as an urban commons. This paper draws upon the principles of critical discourse analysis in order to examine the production of capitalist and consumerist discourses within contemporary nonhuman animal rights activism. The analysis presents evidence to suggest that the discourses being produced via the websites of People for the Ethical Treatment of Animals (PETA) and The Vegan Society are consistently being constructed through market-centric ideologies that treat activists mainly as middle-class consumers. This paper argues that the consistent presence of neoliberal discourse signals an instructive entanglement with broader sociopolitical issues. Contesting Austerity: The Potential And Pitfalls Of Socioeconomic Rights Discourse, Joe Wills, Ben Warwick

This article argues that, while socioeconomic rights have the potential to contribute to the contestation of austerity measures and the reimagining of a "postneoliberal" order, there are a number of features of socioeconomic rights as currently constructed under international law that limit these possibilities. We identify these limitations as falling into two categories: "contingent" and "structural". Contingent limitations are shortcomings in the current constitution of socioeconomic rights law that undermine its effectiveness for challenging austerity measures. By contrast, the structural limitations of socioeconomic rights law are those that pertain to the more basic presuppositions and axioms that provide the foundations …

This paper examines the relationship between neoliberalism and patterns of violence in Latin American cities. I argue that those neoliberal policies which have so impacted key agricultural and manufacturing sectors in Latin America also disrupt economically-driven social relations, making that the region’s transition to democracy a violent one. Although transitions from authoritarianism to democracy as a whole remove old relations between the government and the public, the criminalization of poverty as created and perpetuated by neoliberal ideology leads to higher rates of incarceration while colluding with criminal organizations in order to avoid lengthy and expensive urban renewal programs. Ecosystem service valuation (ESV) attempts to transform the opposition of human economic necessity and ecological conservation by valuing the latter in terms of the services rendered by the former. However, despite a number of ESV-inspired sustainability initiatives since the 1990s, global ecological degradation continues to accelerate. This suggests that ESV has fallen far short of its goals of sustainable social transformation—a failure which has generated considerable criticism. This paper reviews three prominent lines of ESV criticism: 1) the neo-Marxist criticism, which emphasizes the “fictitious” character of ecosystem commodities; 2) the liberal criticism through Friedrich Hayek's concept “scientistic objectivism”; and 3) …

Neoliberalism can be understood as the deregulation of the economy from political control by deliberate action or inaction of the state. As such it is both constituted by the law and deeply affects it. I show how the methods of historical materialism can illuminate this phenomenon in all three branches of the the U.S. government. Considering the example the global financial crisis of 2007-08 that began with the housing bubble developing from trade in unregulated and overvalued mortgage backed securities, I show how the repeal of the Glass-Steagall Act, which established a firewall between commercial and investment banking, allowed this …

Commentaries on the financial meltdown that began with Lehman Brothers’ collapse in September 2008 trace its origins to greedy bankers exploiting lax regulatory practices to take excessive risks through exotic and arcane financial instruments. The response of some Argentine workers to the 2001 crisis of neoliberalism gave rise to a movement of worker-recovered enterprises (empresas recuperadas por sus trabajadores or ERTs). The ERTs have emerged as former employees took over the control of generally fraudulently bankrupt factories and enterprises. The analysis of the ERT movement within the neoliberal global capitalist order will draw from William Robinson’s (2004) neo-Gramscian concept of hegemony. Today, we cannot talk just about plain control, but we must talk about the nature of the interaction of the one who is being controlled and the one who controls, an interaction where the one that is “controlled” is asking for more control over himself/herself while expecting to be compensated by a surplus of freedom to satisfy trivial needs and wishes. Such a liberty for the fulfillment of trivial needs is being declared as freedom. But this implies as well the freedom to choose not to be engaged in any kind of socially sensible or politically articulated struggle.
