This article explains the proliferation of U.S. billionaire wealth during the neoliberal period (1980 to the present). Using the work of scholars, investigative journalists, and government researchers, it examines descriptive evidence from the past forty years of the economic, social, and political trends associated with the capital accumulation that led to so much wealth being concentrated with so few individuals. It further creates a theoretical framework of institutional factors (or “drivers”) that help to understand how these trends link together to provide a comprehensive explanation for the increase of billionaires in comparison with other economic gauges like GDP, income distribution, …

Michel Foucault is well-known for his theorizations of institutional power, normativity, and biopolitics. Less well-known is the fact that Foucault developed his analysis of biopolitics in and through his historical investigation of neoliberalism. Today, while critique of neoliberalism has become a commonplace of humanities discourse, and popular resistance to neoliberalization rocks the southern hemisphere, it remains unclear that the historical specificity of neoliberalism is well-understood. In particular, the relation between classical liberalism and neoliberal governance remains murky in popular debate. The defining antinomy of the post-2008 crash phase is argued to be the one between neoliberalism and populism. This essay aims to complicate the terms of this antinomy and offers a reading that problematizes the association of neoliberalism with internationalism and globalization on the one hand and populism with nationalism and anti-imperialism on the other. This article argues that, while socioeconomic rights have the potential to contribute to the contestation of austerity measures and the reimagining of a "postneoliberal" order, there are a number of features of socioeconomic rights as currently constructed under international law that limit these possibilities. We identify these limitations as falling into two categories: "contingent" and "structural". Contingent limitations are shortcomings in the current constitution of socioeconomic rights law that undermine its effectiveness for challenging austerity measures.
