Private Censorship, Disinformation And The First Amendment: Rethinking Online Platforms Regulation In The Era Of A Global Pandemic, Tzu- Chiang Huang

The proliferation of online disinformation and the rise of private censorship are paradigmatic examples of the challenges to traditional First Amendment jurisprudence in an algorithmic society. The limitations of traditional First Amendment jurisprudence are amplified by the impact of the COVID-19 pandemic in two ways. On the one hand, in the wake of the pandemic, we have entered an “infodemic” era where the volume of disinformation, as well as the harm it causes have reached unprecedented levels. The massive fact-checking, flagging, and content removal campaigns run by major digital platforms during the 2020 elections and the Covid-19 pandemic did some good. However, they failed to prevent substantial portions of the population from believing that the election was stolen or that vaccinations are dangerous.

In this Article, we argue that the reason for the ineffectiveness of truth-based solutions—such as fact-checking— is that they do not reach the heart of the problem. In the United States, public transit ridership in 2020 declined by 79% compared to 2019 levels. With lockdowns implemented during the early days of the pandemic, direct human-to-human interactions migrated to virtual platforms (e.g., Facebook, Twitter, and Reddit). Social media platforms have aided researchers in answering numerous questions about current societal dilemmas, including COVID-19. This study investigates the public’s perception of transit systems via a social media analysis given the emergence of vaccines and other COVID-19 preventive measures. Where studies have shown that visuals are the primary means of political communication, research continues to focus largely on text-based information. To add to our understanding of visual-political communications, this article analyses Indonesian election posters since the 1950s. Drawing on historical materials and on a content analysis of 4,000 election posters, it asks why election posters have been designed and distributed in particular ways. Findings indicate that in the past, posters used singular, though powerful, social symbols to mobilize demographic groups behind political parties. Democratization theories assume that democracy and media freedom go hand in hand. However, in democracies, politicians and individuals who have a stake in political battles often attack journalists. How can political and electoral incentives that are at the heart of democracy create a minefield for journalists? Examining cross-national patterns of censorship and the experiences of journalists in Venezuela, Mexico, and Brazil captured in over 4,600 case narratives, 30 field interviews, and historical documents, I study the circumstances under which political rivalries result in anti-media violence. Yet, despite the high prevalence of sexual assault, it is the most underreported crime of all crimes reported to the police (Bureau of Justice, 2018). Significant religious difference in the family has become increasingly prevalent in recent years. While religious difference may be challenging for families to negotiate, the manner in which family members communicate about it seems to be helpful in promoting positive interactions between parents and children. The purpose of this study was to conceptualize a parental communicated (non) acceptance continuum in the context of significant parent-child religious difference. We conducted semi-structured interviews with 44 adults who identified a significant religious difference with their parent. Beginning in the early 2000s, menstrual product advertisers in the U.S. and other developed countries began to use red liquid in their advertising to represent period blood rather than the blue liquid used in the past, which is often criticized because it portrays stigmatizing representations of menstruation.
