Who Studies International Law? Explaining Cross-National Variation In Compulsory International Legal Education, Ryan Scoville, Mark S. Berlin May 2019

Who Studies International Law? Explaining Cross-National Variation In Compulsory International Legal Education, Ryan Scoville, Mark S. Berlin

Political Science Faculty Research and Publications

The compulsory study of international law is a universal component of legal education in some states but extremely uncommon or non-existent in others. This article uses global data and statistical methods to test a number of conceivable explanations for this puzzling feature of international society. In contrast to much of the empirical literature on state behaviour in relation to international law, we find that functionalist and socio-political variables carry little explanatory power and that historical variables – specifically, legal tradition and regional geography – instead account for the overwhelming majority of the global pattern. We explore potential explanations for these …

Underground Railroads And Coyote Conductors: Brokering Clandestine Passages, Then And Now, Noelle K. Brigden May 2019

Underground Railroads And Coyote Conductors: Brokering Clandestine Passages, Then And Now, Noelle K. Brigden

Political Science Faculty Research and Publications

This article juxtaposes the Underground Railroad with contemporary Central American smuggling practices. Activists in the US Sanctuary Movement, seeking to provide safe passage to the USA for Central American refugees, summon the legacy of the Underground Railroad as a normative frame for understanding their mission. In the original Underground Railroad, a loose network of ‘conductors’ ushered escaped slaves north to freedom. In contrast to immigrant rights activists and slavery abolitionists, for-profit smugglers have been vilified as violent predators. Nevertheless, surprising similarities in social practices and relationships that underpin such dramatically different cases of migration brokerage point to the contingencies, complexities …

Strategic Communication Campaign For Foreign Properties Restitution Programs, Quoc Tuan Nguyen May 2019

Strategic Communication Campaign For Foreign Properties Restitution Programs, Quoc Tuan Nguyen

Theses and Dissertations

U.S. laws allow citizens to seek compensation for their properties seized by a foreign nation through foreign settlement claims headed by a special commission under the Department of Justice. Only Congress or the Secretary of State could request this commission to open settlement claims programs. This project aims to improve communication outreach for a nonprofit, Boat People SOS, in its campaign to seek compensation for Vietnamese Americans whose properties have been confiscated by the Vietnamese government. The design project will provide an analysis, an execution plan and also consists of a package of informational products such as brochures, Power Point …

Evaluation Of A Wearable Activity Schedule For Promoting Independent Play In Children With Autism Spectrum Disorder, Basak Topcuoglu May 2019

Evaluation Of A Wearable Activity Schedule For Promoting Independent Play In Children With Autism Spectrum Disorder, Basak Topcuoglu

Theses and Dissertations

Activity schedules are an antecedent intervention in which a series of visual cues, presented typically in booklets or binders, function as prompts for steps in a behavior chain (e.g., classroom routine, playing hide and seek). Although activity schedules are useful in getting individuals to manage their own behaviors, their typical presentation format can be cumbersome and stigmatizing for children placed in general education classrooms, placing additional barriers for independence and inclusion across environments for these children. Some researchers have used electronic devices such as tablets to display activity schedules, and although more socially acceptable, these are still cumbersome for young …

Virtually Healthy: Using Virtual Ethnography To Survey Healthcare Seeking Practices Of Transgender Individuals Online, Rogelio Arenas May 2019

Virtually Healthy: Using Virtual Ethnography To Survey Healthcare Seeking Practices Of Transgender Individuals Online, Rogelio Arenas

UNLV Theses, Dissertations, Professional Papers, and Capstones

The use of digital spaces becomes more prevalent as technologies improve and more individuals become connected online. For many, the virtual world may become the primary means by which they engage socially and commercially with larger society. For individuals who identify as transgender or gender nonconforming, the virtual world serves as an environment where the fluidity of identity construction, the security of anonymity, and the physical separation provided by using a digital medium allows for the creation of a secure space for social engagements that may otherwise be discriminatory or infeasible in physical interactions. The stigma, discrimination, and prejudice experienced …

Attitudes Toward Marijuana Legalization: Temporal And Thematic Trends, Daniel James Krystosek May 2019

Attitudes Toward Marijuana Legalization: Temporal And Thematic Trends, Daniel James Krystosek

UNLV Theses, Dissertations, Professional Papers, and Capstones

This dissertation examines historical changes in marijuana legalization attitudes between 1974 – 2018, using a qualitative study of pro-legalization social movements in marijuana culture and quantitative analyses of measures from the General Social Survey (GSS). The main research question asks what themes have been prevalent in pro-legalization social movements (e.g., libertarianism, anti-establishment and anti-drug-war, medical/cancer patient advocacy, market incentives), how these themes have changed over the past several decades, and whether they connect to trends in legalization attitudes in the (GSS).

The first part of this study is qualitative, employing thematic content analysis of the most prominent national pro-marijuana publication. …

Reconsolidation: Unique Cognitive Process Or State Dependent Learning?, Chris Kiley May 2019

Reconsolidation: Unique Cognitive Process Or State Dependent Learning?, Chris Kiley

UNLV Theses, Dissertations, Professional Papers, and Capstones

Accessing a previously consolidated memory trace brings it back into a labile state where it must then undergo a re-stabilization process known as reconsolidation. During this process memories are susceptible to interference and may be updated with new information. Reconsolidation has been demonstrated in animals as well as in the procedural and episodic human memory systems. However, it is still unclear when the effect will occur. Some studies suggest that reconsolidation is only necessary when new information is presented in the same spatial context or when prediction error occurs. More recent work has provided evidence that reconsolidation could be due …

Potential Fossil Yield Classification (Pfyc) Survey Of Nevada Surficial Geology, And A Multi-Sensor, Remote Sensing, Change-Detection Study Of Land-Use/Land-Cover Urbanization Impacting The Las Vegas Formation Located In Northwestern Las Vegas Valley, John Jayson Medema May 2019

Potential Fossil Yield Classification (Pfyc) Survey Of Nevada Surficial Geology, And A Multi-Sensor, Remote Sensing, Change-Detection Study Of Land-Use/Land-Cover Urbanization Impacting The Las Vegas Formation Located In Northwestern Las Vegas Valley, John Jayson Medema

UNLV Theses, Dissertations, Professional Papers, and Capstones

This thesis is a combination of two separate but related projects. The first project is a Potential Fossil Yield Classification (PYFC) survey. The PFYC is a Bureau of Land Management funded survey designed to synthesize paleontologic information into a geographic information system (GIS) as a distributable geodatabase. The database is designed to represent surficial geologic deposits contained in a polygon shapefile. Throughout the State of Nevada each polygon represents a mapped geologic unit at a scale of at least 1:250 k. Each mapped geologic unit is then assigned a “potential fossil yield classification”, a numerical ranking value of 1-5 based …

Nonstate Actors And International Law: Just War Theory Or The Universal Declaration Of Human Rights?, Jason Lee Mitchell May 2019

Nonstate Actors And International Law: Just War Theory Or The Universal Declaration Of Human Rights?, Jason Lee Mitchell

UNLV Theses, Dissertations, Professional Papers, and Capstones

There is a debate taking place within the global war on terror (GWT), and its legal and moral parameters are established by two basic arguments. The first is that “Citizens who associate themselves with the military arm of the enemy government, and with its aid, guidance and direction enter this country bent on hostile acts are enemy belligerents within the meaning of the Hague Convention and the law of war” (Ex parte Quirin, 37). The second is that an “Enemy combatant” is a general category that subsumes two sub-categories: lawful and unlawful combatants. The conclusion as it currently stands is …

Trends In The Rate Of Inpatient Pediatric Bipolar Disorder Diagnosis Between 1996 And 2015, Samantha Sherwood May 2019

Trends In The Rate Of Inpatient Pediatric Bipolar Disorder Diagnosis Between 1996 And 2015, Samantha Sherwood

UNLV Theses, Dissertations, Professional Papers, and Capstones

The rate of PBD in the U.S. increased dramatically between the mid-1990s and mid-2000s resulting in concern regarding the potential for misdiagnosis of PBD. However, given that the rate of PBD diagnosis had not been examined in the U.S. since 2004, the longitudinal trajectory of PBD diagnosis subsequent to the mid-2000s was unclear. Therefore, the present study utilized two datasets of administrative billing claims to assess whether longitudinal changes in the rate of inpatient PBD diagnosis continued to occur subsequent to 2004. Study 1 utilized a nationally representative dataset of inpatient psychiatric hospitalizations between 1996 and 2010. De-identified data were …

Elucidating The Lasting Influence Of Early Pubertal Timing On Disordered Eating Symptoms, Megan Marie Shope May 2019

Elucidating The Lasting Influence Of Early Pubertal Timing On Disordered Eating Symptoms, Megan Marie Shope

UNLV Theses, Dissertations, Professional Papers, and Capstones

Objective: Extant data indicate that girls who mature earlier than their peers are at increased risk for disordered eating symptoms. Nonetheless, whether early pubertal timing exerts differential effects across key disordered eating symptoms (e.g., body weight/shape concerns vs. binge eating) and whether pubertal timing effects are present after the completion of puberty (i.e., in adulthood) remains relatively unclear. Additionally, leading theories posit that pubertal increases in adiposity and psychosocial factors (e.g., perceived pressures for thinness) likely underlie the predictive effects of earlier maturation on disordered eating risk, yet few studies have empirically tested this possibility. The current study aimed to …

A Hepatitis C Screening Tool For An Uninsured Population, Kimberly Belle Babcock-Nobles May 2019

A Hepatitis C Screening Tool For An Uninsured Population, Kimberly Belle Babcock-Nobles

Doctoral Dissertations and Projects

Hepatitis C virus (HCV) is a public health epidemic effecting 3.5 million people in the United States alone. The uninsured, underserved residents of a rural county in North Carolina have limited access to screening and early detection for HCV. Through collective efforts, a free medical clinic partnered with a grant funded, nonprofit organization to provide free hepatitis C testing by use of a mobile medical unit. The aim of this study was to determine if use of an HCV screening tool would increase the number of patients screened for testing as compared retrospectively to the number of patients screened without …

Developing The Refined Sexual Shame Inventory: Validation Study Of The Kyle Inventory Of Sexual Shame, Jang Soon Lim May 2019

Developing The Refined Sexual Shame Inventory: Validation Study Of The Kyle Inventory Of Sexual Shame, Jang Soon Lim

Doctoral Dissertations and Projects

There has been an increase in a need to provide appropriate assessments and treatments for sexual shame associated with pornography use, a dysfunctional result of the development of the Internet and social network services. There is no clinically validated inventory of sexual shame in the literature, while many active studies of shame have recently produced meaningful results. This study aimed to develop a brief measure of sexual shame based on the Kyle Inventory of Sexual Shame (KISS) that has not truly been validated with multiple samples. The KISS is comprised of some items confound cause and effect rather than assess …

Initial Development And Validation Of The Multidimensional Strong Black Woman Scale, Brandi Janee' Chamberlin May 2019

Initial Development And Validation Of The Multidimensional Strong Black Woman Scale, Brandi Janee' Chamberlin

Doctoral Dissertations and Projects

The unique experiences of African American women are well documented through intersectionality research. Taking an intersectional framework, this study is designed to develop and initially validate a new scale, the Multidimensional Strong Black Woman Scale. The Strong Black Woman is characterized by strength, resilience, independence, stoicism, and caretaking. This schema is adopted by many African American women to combat negative racial stereotypes, born out of slavery and discrimination. The Strong Black Woman often neglects her own mental and physical health in order to care for others, and delays help-seeking behaviors. This has a negative impact on mental health. The strong …

Attachment And Burnout: Exploring The Predictive Nature Of Self-Efficacy In A Sample Of Direct-Care Staff Members, Eric Jason Camden May 2019

Attachment And Burnout: Exploring The Predictive Nature Of Self-Efficacy In A Sample Of Direct-Care Staff Members, Eric Jason Camden

Doctoral Dissertations and Projects

The push for least-restrictive care and associated policies has increased the prevalence of youth with higher levels of acuity requiring admission to residential treatment centers. This increased psychiatric severity of children and adolescents served in residential centers places the largest burden on direct-care staff members. As a result, direct-care staff members experience workplace stressors such as staff-member shortages/unplanned call-outs, poor morale, high stress, and burnout. Burnout is widely recognized as a significant hazard for professional caregivers and is a potent barrier to clinical effectiveness. Extant literature on burnout examines individual and organizational factors that lead to burnout experiences, and this …

Assessing Hospitalizations Due To Assaults At Dell Seton Medical Center (2015-2018), Stephani L. Curry

Dissertations and Theses (Open Access)

Physical assaults are a major public health concern in the United States, with rates being on the rise during the last couple of years (WISQARS Nonfatal Injury Reports, n.d.). In Austin at the Dell Seton Medical Center [DSMC], physical assaults are a main reason for hospitalization, making up nearly 10% of their hospitalizations, with around 250 patients per year. No subgroup of the population is risk free from physical assaults; however, national data suggest some sociodemographic groups are at higher risk than others (“Injury and Violence Prevention”, n.d.). Given the diversity of Austin, TX, it was unclear whether local sociodemographic …

Exploring Prenatal Risk Factors Among Hispanic Children With Autism Spectrum Disorders. – A Pilot Study In The Rio Grande Valley, Lauren Tien

Dissertations and Theses (Open Access)

Background: Peer-reviewed studies suggest that a hostile gestational environment is associated with delayed neurological development in infants. Autism spectrum disorder (ASD) is estimated to affect 1 in 59 children in the United States; however, few studies have specifically investigated risk factors for autism in Hispanic children. Purpose: The University of Texas RGV Hispanic Autism Research Center (HARC) studied Hispanic children with ASD and their biological mothers to identify potential environmental exposures and prenatal risk factors that could impact the risk for ASD through preliminary research in the Rio Grande Valley. Methods: This pilot study recruited 25 Hispanic mothers and their …

Trans Stories, Trans Voices: How The Internet Empowers Transgender Creators To Have Agency In Trans Fiction, Pepper J. Heifner May 2019

Trans Stories, Trans Voices: How The Internet Empowers Transgender Creators To Have Agency In Trans Fiction, Pepper J. Heifner

Undergraduate Honors Theses

Although many advocates believe that the increased representation of transgender people in mainstream fiction will lead to more understanding for the transgender community, many transgender scholars (Page, Richards) are critical of representation that is created without any involvement of actual transgender people. Some fear that the more radical perspectives of trans lives are being erased and replaced with a homogenous idea of the kinds of trans people who are “acceptable” (cárdenas). To avoid this homogeneity, it is important to allow for a multiplicity of trans perspectives and empower transgender people to have agency over their own narratives.

The goal of …

Building Safe, Secure And Sustainable Futures In The South China Sea, Michelle Mei Ling Lim May 2019

Building Safe, Secure And Sustainable Futures In The South China Sea, Michelle Mei Ling Lim

Research Collection Yong Pung How School Of Law

This essay argues that by framing security in the South China Sea through the lens of territorial claims and power relations the bigger picture of a safe, secure and sustainable South China Sea is neglected. The essay reflects on a photograph from my childhood on the shores of the South China Sea. In the photograph, I have a little red bucket in my hands and a wide grin on my face as I prepare to build a sandcastle. In the intervention, I recall how it feels to be truly secure. By returning to the joys of childhood experienced on the …

The Effects Of Emotion On The Holistic Processing Of Faces, Julianna M. Murray May 2019

The Effects Of Emotion On The Holistic Processing Of Faces, Julianna M. Murray

Theses, Dissertations and Culminating Projects

Face perception is an important ability that allows us to carry out social interactions, recognize others, assess emotions, and understand social cues. Many researchers believe that faces are processed holistically, meaning that humans combine the many parts of a face into a single visual representation. The face is viewed as a complete whole, rather than a collection of specific facial features. Consequently, processing a face holistically makes it more difficult to selectively attend to parts of the face. A small subset of literature has showed that the emotional state of the perceiver can affect the degree to which a stimulus …

Analyzing The Necessity To Modify Standardized Test Statutes, Ashley Hernandez May 2019

Analyzing The Necessity To Modify Standardized Test Statutes, Ashley Hernandez

Theses, Dissertations and Culminating Projects

In recent years, standardized tests have been challenged by many academic scholars, legal journalists, psychologists and scientific researchers. They claim these tests are an arbitrary form of measuring academic success. Across many grade levels, from elementary to graduate school, there has been concern over the efficacy of these tests. Yet, many neglect to consider the benefits of standardized testing and the reasons why they were implemented and continue. Many educational systems have made standardized tests optional to combat issues of regarding arbitrary content, bias and discrimination. Yet, as those pushing for standardized test reform continue to suggest otherwise, there is …

Embryo Litigation : The Legal Categorization Of Embryos As Protected Humans Or Property, Caroline Koboska May 2019

Embryo Litigation : The Legal Categorization Of Embryos As Protected Humans Or Property, Caroline Koboska

Theses, Dissertations and Culminating Projects

This thesis explores the issue of the unknown legal status of frozen embryos in the United States. With an examination of the issue through the discipline of law, it becomes evident that the lack of legislation and guidance on the issue has left it a matter up to the states, rather than the federal government. Central to the issue is the history and laws of abortion in the United States that can help provide precedent. The thesis examines embryos in light of property law, contract law, and family law. Also included is a review of embryos through a second discipline …

You Can Go Your Own Way : Examining The Pathways Of College Student Leaders, Margaret Judith Toich May 2019

You Can Go Your Own Way : Examining The Pathways Of College Student Leaders, Margaret Judith Toich

Theses, Dissertations and Culminating Projects

According to the International Leadership Association, more than 2,000 academic and co-curricular programs exist at universities across the nation (Guthrie, Teig, & Hu, 2018). Evaluation of programs is largely piecemeal—meaning that the additive effects of these programs are not examined. The purpose of this study is to address the current gap in the literature by holistically assessing the impact that these leadership experiences have on the participating students rather than looking at the consequences of these experiences individually. The current study uses 99 students’ data from a five- year, multi-institutional, longitudinal study to examine the pathways that these undergraduate students …

Lived Experiences Of Indian Women Technology Professionals Working Temporarily In The United States, Sudha Nagarajan May 2019

Lived Experiences Of Indian Women Technology Professionals Working Temporarily In The United States, Sudha Nagarajan

Theses, Dissertations and Culminating Projects

This original and topical qualitative study explored the lived experiences of ten Indian women technology professionals working in the U.S. on non-immigrant H-1B visas. This study examined the role of cultural socialization and acculturative processes in the development of cultural identity. Narratives of the participants were interpreted using the Voice-Relational Listening Guide (Brown & Gilligan, 1992; Gilligan, 1982, 2015; Gilligan, Spencer, Weinberg, & Bertsch, 2006). The first theme of negotiated compromises explored the impact of gender role expectations associated with cultural socialization on career and marriage options, relational interdependence, and adaptation to changing sociocultural environments. The second theme of cultural …

Speaking Of Recovery, Thomas A. Conklin May 2019

Speaking Of Recovery, Thomas A. Conklin

Theses, Dissertations and Culminating Projects

This empirical study analyzed the language used by six individuals in recovery from alcohol use disorder (AUD) who have been participants in the mutual support organization Alcoholics Anonymous (A.A.) as they described their experiences with AUD and recovery. Participants were all White middle-aged Americans without a college education, a demographic cohort that has been identified as being at elevated risk for premature death due to AUD, drug misuse, and suicide (Case & Deaton, 2017). The findings suggest that participants’ experiences with AUD were associated with a constellation of factors, including culture-bound conflicting social identities, ruptured intimate relationships, and chronic unsuccessful …
