Feminist Statutory Interpretation, Kim Brooks Jul 2019

Feminist Statutory Interpretation, Kim Brooks

Articles, Book Chapters, & Popular Press

Leading Canadian scholar Ruth Sullivan describes the act of statutory interpretation as a mix of art and archaeology. The collection, Feminist Judgments: Rewritten Tax Opinions, affirms her assessment. If the act of statutory interpretation requires us to deploy our interdisciplinary talents, at least somewhat unmoored from the constraints of formal expressions of legal doctrine, why haven’t feminists been more inclined to write about statutory interpretation? Put another way, some scholars acknowledge that judges “are subtly influenced by preconceptions, endemic privilegings and power hierarchies, and prevailing social norms and ‘conventional’ wisdom.” Those influences become the background for how judges read legislation. …

Vocational And Life Skills Monthly Data Update: July 2019, Uno Nebraska Center For Justice Research, Katelynn Towne, Michael Campagna

Reports

Grantees use an online data management system to submit data on participants served under their Vocational and Life Skills programming. This data is due monthly and reflects all services provided during the previous month to participants. Evaluators at the Nebraska Center for Justice Research work with grantees directly to manage data entry errors on an ongoing basis during monthly update calls and regular site visits.

The current data derives from an active database, from which data is being entered and updated daily. Data values, including previously submitted information, may fluctuate depending on changes made from data entry oversight. One common …

Searching Activity Trajectories With Semantics, Li-Hua Yin, Huiwen Liu Jul 2019

Searching Activity Trajectories With Semantics, Li-Hua Yin, Huiwen Liu

PhD Student’s Publications Collection

With the widespread use of smart phones and mobile Internet, social network users have generated massive geo-tagged tweets, photos and videos to form lots of informative trajectories which reveal not only their spatio-temporal dynamics, but also their activities in the physical world. Existing spatial trajectory query studies mainly focus on analyzing the spatio-temporal properties of the users’ trajectories, while leaving the understanding of their activities largely untouched. In this paper, we incorporate the semantics of the activity information embedded in trajectories into query modelling and processing, with the aim of providing end users more informative and meaningful results. To this …

The Prosecution Paradox: How The International Criminal Court Affects Civil War Peace Negotiations, Julia Reilly Jul 2019

The Prosecution Paradox: How The International Criminal Court Affects Civil War Peace Negotiations, Julia Reilly

Department of Political Science: Dissertations, Theses, and Student Research

Since the International Criminal Court (ICC)’s inception, observers have disagreed about how it would affect prospects for peace when it is involved in situations of ongoing conflict. Therefore, I ask, why do some of the civil war peace negotiations involving the ICC end with full peace agreements, while others end with resumed violence? I argue that how the Court affects the occurrence and outcome of peace negotiations is largely a function of the role that it plays in the situation. Due to its institutional design, the Court has the capacity to play either an oversight or a prosecutorial role in …

Neurophysiological Alterations Following Concussion: Controlling For The Injury Factor, Caitlin Masterson Jul 2019

Neurophysiological Alterations Following Concussion: Controlling For The Injury Factor, Caitlin Masterson

Department of Psychology: Dissertations, Theses, and Student Research

The topic of mild traumatic brain injury (mTBI) has rapidly gained attention not only in academic science but also in popular media. Unlike severe traumatic brain injury, mTBI is difficult to diagnose. There are no objective diagnostic criteria, and symptoms can vary greatly across individuals. Further, although individuals with mTBI are frequently compared to non-injured individuals, it cannot be concluded with certainty that any differences found between groups can be attributed solely to the head injury and not a more general injury-factor. Identifying a sensitive and specific physiological signal across similar injury groups is critical to establishing a criterion that …

Objective: To evaluate the efficacy of attachment-based family therapy (ABFT) compared with a family-enhanced nondirective supportive therapy (FE-NST) for decreasing adolescents’ suicide ideation and depressive symptoms. Method: A randomized controlled trial of 129 adolescents who are suicidal ages 12- to 18-years-old (49% were African American) were randomized to ABFT (n ¼ 66) or FE-NST (n ¼ 63) for 16 weeks of treatment. Assessments occurred at baseline and 4, 8, 12, and 16 weeks. Trajectory of change and clinical recovery were calculated for suicidal ideation and depressive symptoms. Results: There was no significant between-group difference in the rate of change in …

Data Management Plans And Dmptool, Stacy L. Winchester

Faculty and Staff Publications

Many federal and private funders require a Data Management Plan, or DMP, as part of the grant application process. The University Libraries at the University of South Carolina provide a number of resources and services to faculty and students who need to write plans, including online guides, sample DMPs, and consultations. This presentation, from a workshop titled “Data Management Plans and DMPTool,” walks researchers through the history and components of Data Management Plans and exposes them to available resources, including DMPTool, an online tool that helps researchers write plans that meet specific funder requirements.

The Application Of Risk–Needs Programming In A Juvenile Diversion Program, Lindsey Wylie, Samantha S. Clinkinbeard, Anne M. Hobbs Jul 2019

The Application Of Risk–Needs Programming In A Juvenile Diversion Program, Lindsey Wylie, Samantha S. Clinkinbeard, Anne M. Hobbs

Criminology and Criminal Justice Faculty Publications

As “gatekeepers” into the juvenile justice system, diversion programs are positioned to prevent future delinquency. Although research on the effectiveness of diversion is mixed, the risk–needs–responsivity (RNR) model may explain how diversion programming that matches youth to services based on their risk and needs may reduce reoffending. Most RNR research has included juveniles at the deeper end of the system, fewer studies have examined RNR with early system–involved youth. The current study explored the application of risk and needs matching in a juvenile diversion program by gender and race/ethnicity. Furthermore, we estimated a survival function to estimate risk and needs …

Relationship Of Proximal Predictors Of Success In A Psyd Program On Alumni Distal Factors, Nicole Fontenot Ford Jul 2019

Relationship Of Proximal Predictors Of Success In A Psyd Program On Alumni Distal Factors, Nicole Fontenot Ford

Doctor of Psychology (PsyD)

Due to the new Standards of Accreditation (SoA) by the American Psychological Association (APA), implemented in 2017, there is minimal research to evaluate how proximal competency factors within clinical psychology programs relate to distal outcomes of alumni. This study consisted of 65 doctoral psychology graduates who completed an APA alumni survey 2 and 5 years after graduation. Findings showed strong positive relationships between faculty mentoring, foundational knowledge, program support and clinical training. Results showed proximal factors of faculty mentoring significantly predicted graduates would be employed as psychologists, while program support (peers and faculty) significantly predicted lifelong learning of alumni. Career …

A Culturally-Sensitive Exploration Of Adversity And Resilience Among Trinidadians, Christabel Léonce Jul 2019

A Culturally-Sensitive Exploration Of Adversity And Resilience Among Trinidadians, Christabel Léonce

Doctor of Psychology (PsyD)

Research done by the Center for Disease Control (CDC) found that adverse childhood experiences (ACEs) such as abuse, household challenges, and neglect were linked to later health risks in life and overall well-being (CDC, 2019). Adverse experiences occur worldwide in a variety of culturally-specific ways. Research involving youth in Trinidad and Tobago outlines emerging concerns with violence in homes, communities, and schools (Baker-Henningham et al., 2009). Currently, however, there is limited data on adverse experiences and their long-term impact in Trinidad and Tobago. Trinidadians (n = 79), born and lived in Trinidad till 18 years was surveyed, ranging from ages …

The Effect Of Social Information In The Dictator Game With A Taking Option, Tanya O'Garra, Valerio Capraro, Praveen Kujal Jul 2019

The Effect Of Social Information In The Dictator Game With A Taking Option, Tanya O'Garra, Valerio Capraro, Praveen Kujal

ESI Working Papers

We experimentally study how redistribution choices are affected by positive and negative information regarding the behaviour of a previous participant in a dictator game with a taking option. We use the strategy method to identify behavioural ‘types’, and thus distinguish ‘conformists’ from ‘counter-conformists’, and unconditional choosers. Unconditional choosers make up the greatest proportion of types (about 80%) while only about 20% of subjects condition their responses to social information. We find that both conformity and counter-conformity are driven by a desire to be seen as moral (the ‘symbolization’ dimension of moral identity). The main difference is that, conformity is also …

Classical Economics: Lost And Found, Sabiou M. Inoua, Vernon Smith Jul 2019

Classical Economics: Lost And Found, Sabiou M. Inoua, Vernon Smith

ESI Working Papers

"We argue that neoclassical value theory suffers from a more basic and serious logical indeterminacy, which is inherent in the axiom of price-taking behavior, and which renders price dynamics indeterminate before inquiring as to its stability. If everyone in the economy takes price as given, whence come these prices? Who is giving these prices? Jevons avoided the indeterminacy by assuming that people must have complete information on supply and demand, and the consequent equilibrium prices—‘perfect competition.’ Walras in effect imported an external agent who found the prices by trial-and-error-correction (the Walrasian Auctioneer). Paradoxically, both approaches had the potential better to …

Inklusi Keuangan Melalui Program Layanan Keuangan Digital Dan Laku Pandai, Prani Sastiono, Chaikal Nuryakin Jul 2019

Inklusi Keuangan Melalui Program Layanan Keuangan Digital Dan Laku Pandai, Prani Sastiono, Chaikal Nuryakin

Jurnal Ekonomi dan Pembangunan Indonesia

This study aims to analyse the inclusion rate of two programs, namely Layanan Keuangan Digital (LKD) and Laku Pandai. We found that inclusion rate of LKD program and Laku Pandai program are 28% and 43% respectively when we define inclusion as use of service (access inclusion). However, the rate falls to 5% and 25% respectively when we define inclusion as account ownership. Laku Pandai program has advantages in increasing financial access of people who live in rural area, have low education, and generate low income. We also found that knowledge/certainty in transaction costs (for LKD) and size of access …

Transmisi Kemiskinan Antargenerasi Di Indonesia Tahun 1993–2014, Studi Data Ifls, Memy Irwan, Jossy P. Moeis

Jurnal Ekonomi dan Pembangunan Indonesia

The initial hypothesis states that children from poor household have a tendency to return to poverty as an adult. This is because children from poor household are more difficult to utilize available resources than children from non-poor household. By using McNemar test, the data proved that there was a transmission of poverty in Indonesia during 1993–2014. In other words, poverty alleviation program in Indonesia had not been successfully carried out. Multinomial logit was used to analyzed factors that influence the transmission of poverty. There are various factors that affect the intergenerational transmission of poverty in Indonesia, namely the level of …

Aktivitas Ekspor Dan Inefisiensi Teknis Industri Andalan Ekspor Indonesia, Rika Bettynurindah Rustiawati, Andi Fahmi Lubis

Jurnal Ekonomi dan Pembangunan Indonesia

This study examines the effect of export activity on the technical inefficiency by using firm level panel data taken from Annual Survey of Manufacturing conducted by BPS for the period 2010 to 2014 and focus on Indonesia’s mainstay export industry which classified into low technology and high technology sector. A stochastic frontier model with one stage approach is applied to the translog production function to estimate firm level technical efficiency. The findings support the theoretical implications of the positive impact of export activities on firm’s efficiency and low technology sectors have higher efficiency rate than high technology sectors.

Side Effects Of Self-Referential Discussion: The Impact And Interaction Of Deductive And Inductive Routes Of Identity, Chandler Macswain Jul 2019

Side Effects Of Self-Referential Discussion: The Impact And Interaction Of Deductive And Inductive Routes Of Identity, Chandler Macswain

Master's Theses (2009 -)

Studies of group communication and group identity rest on two competing theoretical concepts of the group, one that prioritizes examining the relationships between members and one that examines the group as a gestalt construct. For live groups, it is not always clear which style, individual or gestalt, is most appropriate or provides more insight into any specific group because groups’ identities and communication behaviors are sometimes explicable by both theoretical concepts. This occurs because in real-world groups the formation process typically involves an amalgamation of both influences. In other words, live groups form identities built around both members’ individual traits …

Significant and reliable change was assessed. Potential mechanisms of change were examined using correlations. Self-report feasibility and acceptability data were collected from therapists and participants respectively.Results. Significant and reliable change was …

Personality Inventory Dsm-5: A Spanish Translation For Hispanics In The United States, Jessica Abigail Carmona Jul 2019

Personality Inventory Dsm-5: A Spanish Translation For Hispanics In The United States, Jessica Abigail Carmona

Theses and Dissertations

The Personality Inventory DSM-5 (PID-5) was created to measure personality pathology and help in the development of a dimensional conceptualization of personality disorders (Krueger, Derringer, Markon, Watson, & Skodol, 2012). It measures five maladaptive personality traits: Negative Affect, Detachment, Antagonism, Disinhibition and Psychoticism. The PID-5 has also garnered significant support for its hierarchical structure, five-factor structure across samples and translations, and its ability to predict variance in internalizing and externalizing disorders (Krueger & Markon, 2014). The current study builds on this literature by translating the PID-5 into Spanish spoken in Latin America and testing the replicability of the five-factor structure, …
