The subject of non-delegable duty has troubled courts for some time. The recent UKSC decision in Woodland v STA has clarified the law somewhat. In the recent decision MCST No. 3322 v Tiong Aik, the Singapore Court of Appeal endorsed the UK position and made clarifications on the Singapore position. This article examines the Singapore position as expressed by the SGCA.

For many children diagnosed with Autism Spectrum Disorder, learning emergency information such as their parents’ names, contact information, or important health information may be useful in case of elopement, getting lost, or abduction. In the present study, I evaluated the use of video self-modeling (VSM) to facilitate acquisition of personal information in comparison to echoic prompts using a parallel treatments design with children with ASD. Components of the intervention included: a test, followed by the prompt (e.g., echoic or VSM) for no response given or for an incorrect response. Mental health courts (MHC) were designed to divert the overwhelming number of individuals with mental illness involved in the criminal justice system from incarceration through specialty court proceedings intended to meet their unique needs. Individuals who have both mental health problems and substance use are at a disadvantage. For them, this combination contributes to more severe mental health symptoms, physical health issues, interpersonal challenges, and legal problems. The co-occurrence of mental illness and substance use is increasing in prevalence within both the community and justice system settings; however, few studies have explored the effectiveness of MHCs for this specific population …

This report, which updates and expands on a report prepared by Law Library staff in March 2015, contains data on 131 countries, indicating whether or not published books are subject to a mandatory deposit requirement at the national level and, if so, how many copies are required, where they must be deposited, and whether the deposit is part of the copyright system. Citations to the controlling legislation for mandatory deposits are provided. In all but thirteen of the jurisdictions surveyed, deposits are required. For some of these thirteen jurisdictions, deposits are voluntary, while in others, no information regarding deposit …

Timothy Williamson offers the ordinary practice, the lottery and the Moorean argument for the ‘knowledge account’ that assertion is the only speech-act that is governed by the single ‘knowledge rule’ or norm, that one must know its content. I show that the emptiness of the knowledge account renders mysterious why breaking the knowledge rule should be a source of criticism. I then argue that focussing exclusively on the sincerity of the speech-act of letting one know engenders a category mistake about the nature of constraints on assertion. This study focuses on the inference of characteristic data from a data set of 507 non-residential buildings. A two-step framework is presented that extracts statistical, model-based, and pattern-based behavior. The goal of the framework is to reduce the expert intervention needed to utilize measured raw data in order to infer information such as building use type, performance class, and operational behavior. The first step is temporal feature extraction, which utilizes a library of data mining techniques to filter various phenomenon from the raw data. In recent times, courts in Singapore and elsewhere have been grappling with the issue of delegability of duty of care. In the process, they have vigorously defended the conventional position that a duty of care is, in general, delegable. Accordingly, attempts at broadening the ambit of vicarious liability and non-delegable duty, respectively, have been carefully scrutinized. The recent Singapore Court of Appeal decision of Ng Huat Seng v Munib Mohammad Madni adds to the judicial thinking on this complicated and controversial subject.

Although gardens are typically appreciated as peaceful spaces of apolitical serenity, this article highlights how gardens can provide new sites and sensibilities that complicate our understanding of diplomacy, war, and peace. While gardens are a popular location for diplomatic performances—for example, the Treaty of Versailles—the global politics of gardens remains underresearched in international relations (IR). To address this gap, the article follows the “aesthetic turn” in IR to examine gardens as contingent social constructions of social-ordering and world-ordering, which both shape and participate in global politics. In this research, we evaluate the applicability of using facial recognition of social media account profile pictures to infer the demographic attributes of gender, race, and age of the account owners leveraging a commercial and well-known image service, specifically Face++. Our goal is to determine the feasibility of this approach for actual system implementation. Using a dataset of approximately 10,000 Twitter profile pictures, we use Face++ to classify this set of images for gender, race, and age. We determine that about 30% of these profile pictures contain identifiable images of people using the current state-of-the-art automated means. We then employ …

Their relationships to both their visitors and their host organization confer a dynamic identity, as they are at once supporting the visitor and supporting the organization. With which does an ombudsman identify, their organization or their visitor? Can the answer be both? This article will explore the opportunities and challenges arising from this tension.

Numerical Cognition In Action: Hand Trajectories Reveal Effects Of Early Musical Training On Numerical Processing In Spanish-English Bilingual Musicians, Daniel Arturo Pizaña

The mouse-tracking study examined whether early musical experience leads to changes of inhibitory control in numerical processing for bilingual speakers, as has not investigated in previous studies. Twenty-eight Spanish-English bilingual students completed two Stroop-like numerical and physical size judgment tasks via a mouse-tracking paradigm. Results showed that response times were slower during both incongruent and neutral trials for bilinguals who had received early musical training (before age 13) when compared to bilinguals who had received late musical training (after age 13) across tasks. Furthermore, hand trajectories revealed that a spatial attraction toward the incorrect response was more pronounced in bilinguals …

Revenue Sharing And Player Salaries In Major League Baseball, James Richard Hill, Nicholas A. Jolly

Economics Faculty Research and Publications

This article analyzes how changes made to the revenue sharing agreement in the 2007 Major League Baseball collective bargaining agreement influenced the salaries of position players and pitchers. The tax rates associated with revenue sharing decreased following ratification of the 2007 agreement. Theoretically, these changes should increase players’ marginal revenue product and, therefore, salaries. Results indicate that position players experienced an increase in salary following the 2007 agreement. Pitchers’ salaries also increased, but by a smaller amount. The effect of the 2007 agreement was different throughout the salary distribution for position players, but uniform throughout the distribution for pitchers.

Research on strikes has traditionally focused on how economic, institutional, and political variables shape strike patterns. Recent work examines how workers' structural, associational, and symbolic power facilitate strikes. Building on this research, this article asks, what factors determine strike outcomes? It analyzes four strikes at MADECO, Chile's largest copper manufacturer, across democratic, authoritarian, and postauthoritarian regimes. Using qualitative and documentary evidence, it argues that strike outcomes reflect workers' capacity to halt or disrupt production and to access government allies who can pressure management to settle strikes in workers' favor. The purpose of this study was to assess the information literacy skills of Education Students at the University of Livingstonia. The study employed a cross-sectional descriptive survey design in which questionnaire was used to collect data. Stratified sampling technique was used to sample students from their respective degree programmes under the faculty of education. Altogether 160 questionnaires were distributed proportionally to respondents and 123 were successfully returned with a response rate of 76.9%.Data was analysed using IBM SPSS where percentages, charts and tables were obtained to present and interpret data. Increasing the power of retrieval cues typically enhances recall and recognition. Is this driven by remembering, knowing, or both? The current study used the remember/know paradigm in different recall tasks that manipulated the power of retrieval cues. In the first two experiments, participants studied words in a semantic or phonetic context, and were tested in one of these contexts, resulting in two match and two mismatch conditions. Participants recalled more in the match conditions, and this was driven by remembering. Parasitic helminths have always been an issue in small ruminant production; pathogens that pose great negative impact on goat health and productivity. Insufficient work has been done to document the prevalence of parasitic helminths in the United States, especially in the south and southeast, where the largest goat populations are found.

The aim of this study was to survey the prevalence of infections by gastrointestinal nematodes in goats in Northwestern Arkansas. Gastrointestinal tracts were examined from 41 goats of various locations around Northwest Arkansas. Worm species were identified and population burdens were determined. Research and society have focused attention on how divorce affects family dynamics for decades. The clinical literature points to significant discrepancies in psychological variables between offspring from divorced versus intact families, suggesting that divorce contributes to negative psychosocial outcomes. Accordingly, investigations have revealed the adverse effects of co-parental conflict and antagonistic communication on divorce offspring’s psychological outcomes. Although parental cooperation and communication are suggested to serve as protective factors, more research is needed, given the current literature’s reliance on measures of psychopathology, yet making conclusions on psychological wellness. These programs combined represent a significant investment of public funds, with more than 45% of the SNP program’s funding coming from the county General Fund (Lam, 2015). Unfortunately, many parents have trouble implementing these programs correctly. Montana, along with many western states, experienced a severe fire season in the summer of 2017. According to the Northern Rockies Coordination Center (NRCC), fires consumed 1,276,456 acres of Montana lands. Nearly half of these lands are U.S. Forest Service owned (Table 1). The severity of the fire season led Montana’s Governor, Steve Bullock, to declare a state of emergency at the beginning of September. At this time, the state had already exceeded the $30 million in its firefighting fund by $14.5 million.1 The NRCC estimates the total costs of fighting Montana’s wildfires topped $390 million.2 The combination of extreme …
