Churchill’S Argument Against Democracy: The Average Voter. Information Levels And News Sources Among Americans, Kyle Priest Apr 2017

Churchill’S Argument Against Democracy: The Average Voter. Information Levels And News Sources Among Americans, Kyle Priest

Political Science Theses and Capstones

A democracy needs an informed public. However, I investigate low levels of political awareness among Americans. I focus on whether people understand issues incorrectly or are simply disengaged and inattentive. There is an important difference between them. Those who are uninformed simply do not know, which would make it easier to turn them into informed citizens. All that would be needed is for them to access the right information. For those who are misinformed, however, it is a tougher task. They believe that their answer is right, and even though they are in fact wrong, they are more willing to …

Asexual-Identified People’S Interactions With Health Care Practitioners, Shelby Flanagan Apr 2017

Asexual-Identified People’S Interactions With Health Care Practitioners, Shelby Flanagan

Undergraduate Research Symposium 2017

People who identify as asexual use this label because, rather than a sexual orientation like “heterosexual,” “homosexual”, or “bisexual,” which labels attraction by gender, they experience a lack of sexual attraction. Previous psychological research on the topic asexuality is limited, but one conclusion agreed upon by several studies is that people who identify as asexual differ from those diagnosed with hypoactive sexual desire disorder (HSDD) in several ways, the most notable of which is that asexual people were shown typically to have little or no distress related to their lack of sexual desire, whereas distress is a key part of …

Family Influence On Chinese International Students’ Sense Of Coherence, Yiwen Zhang Apr 2017

Family Influence On Chinese International Students’ Sense Of Coherence, Yiwen Zhang

Undergraduate Research Symposium 2017

As the number of Chinese international students rapidly increases in U.S. colleges, it becomes important to understand the factors that contribute to their mental health, especially during their first semester of adjustment to the new culture. This study tested the hypothesis that: family condition predicts Chinese International Students’ Sense of Coherence (SOC), the overall capacity of handling tension derived from life stressors, with adaptation performance works as a mediation during their first semester. Data collection sessions were conducted for a collage-based cohort of 43 freshman Chinese international students at the beginning and at the end of their first semester. Participants …

Multidimensional Sales Incentives In Crm Settings: Customer Adverse Selection And Moral Hazard, Minkyung Kim, K. Sudhir, Kosuke Uetake, Rodrigo Canales Apr 2017

Multidimensional Sales Incentives In Crm Settings: Customer Adverse Selection And Moral Hazard, Minkyung Kim, K. Sudhir, Kosuke Uetake, Rodrigo Canales

Cowles Foundation Discussion Papers

In many firms, incentivized salespeople with private information about their customers are responsible for customer relationship management (CRM). Private information can help the firm by increasing sales efficiency, but it can also hurt the firm if salespeople use it to maximize own compensation at the expense of the firm. Specifically, we consider two negative outcomes due to private information — ex-ante customer adverse selection at the time of acquisition and ex-post customer moral hazard after acquisition. This paper investigates potential positive and negative responses of a salesforce to managerial levers — multidimensional incentives for acquisition and retention performance and job …

'People Are Enemies To What They Don't Know' Managing Stigma And Anti-Muslim Stereotypes In A Turkish Community Center, Crystal Paul, Sarah Anna Becker Apr 2017

'People Are Enemies To What They Don't Know' Managing Stigma And Anti-Muslim Stereotypes In A Turkish Community Center, Crystal Paul, Sarah Anna Becker

Faculty Publications

In the wake of the 9/11 terrorist attacks on the World Trade Center, anti-Muslim discourse and sentiment has become pervasive in the West. Using a collaborative ethnographic approach, we observe how participants at a Turkish Community Center (TCC) cultivate stigma management strategies against the cultural backdrop of post-9/11 anti-Muslim stereotypes. In our analysis, we use Goffman's work on stigma and critical race theory to explore the socially embedded nature of stigmatization processes for Turkish Muslims in a local community center. Our findings reveal how aspects of Turkish culture and Islam, together with a structural context …

Microglial Location, Morphology, And Cognitive Performance In Mold-Exposed Mice, Karen Marmon Apr 2017

Microglial Location, Morphology, And Cognitive Performance In Mold-Exposed Mice, Karen Marmon

Theses and Dissertations

We examined changes in brain microglia and cognitive performance following mold exposure and doxycycline administration. Neither mold nor doxycycline caused significant changes in microglial location or morphology. While greater numbers of microglia in control-treated mice were linked with improved performance, greater numbers in mold-treated mice were linked to memory impairments.

Does Making Something Move Matter? Representations Of Goals And Sources In Motion Events With Causal Sources, Laura Lakusta, Paul Muentener, Lauren Petrillo, Noelle Mullanaphy, Lauren Muniz Apr 2017

Does Making Something Move Matter? Representations Of Goals And Sources In Motion Events With Causal Sources, Laura Lakusta, Paul Muentener, Lauren Petrillo, Noelle Mullanaphy, Lauren Muniz

Department of Psychology Faculty Scholarship and Creative Works

Previous studies have shown a robust bias to express the goal path over the source path when describing events (“the bird flew into the pitcher,” rather than “… out of the bucket into the pitcher”). Motivated by linguistic theory, this study manipulated the causal structure of events (specifically, making the source cause the motion of the figure) and measured the extent to which adults and 3.5- to 4-year-old English-speaking children included the goal and source in their descriptions. We found that both children's and adults’ encoding of the source increased for events in which the source caused the motion of …

Cultivating The Concrete Jungle: Examining Urban Agriculture In The Motor City - Detroit, Mi, Sultan Muhammad Apr 2017

Cultivating The Concrete Jungle: Examining Urban Agriculture In The Motor City - Detroit, Mi, Sultan Muhammad

Masters Theses

The maintenance and development of sustainable food systems is becoming an essential aspect of maintaining an efficient urban environment. Likewise, addressing food and job security within America for the entirety of the population has proven difficult in the face of increasing poverty, particularly in urban areas. Urban agriculture has become a favored system of producing local fresh quality food, increasing employment opportunities, beautifying brown spaces and improving environmental conditions through the benefits of increased vegetation. UA exists in America, but as of yet have not sufficiently addressed the prevailing conditions of food insecurity, particularly within poor communities. This study will …

Salesperson Networking Behaviors And Creativity: Exploring An Unconventional Relationship, Michael T. Krush, Raj Agnihotri, Gerrard M. Macintosh, Ashish Kalra Apr 2017

Salesperson Networking Behaviors And Creativity: Exploring An Unconventional Relationship, Michael T. Krush, Raj Agnihotri, Gerrard M. Macintosh, Ashish Kalra

Management and Marketing Faculty Publications

A great deal of emerging research explores the antecedents and outcomes of salesperson creativity. However, relatively fewer scholarly endeavors have delved into assessing the social antecedents of salesperson creativity. Addressing this issue, the current research focuses on the link between one critical social antecedent in sales research, namely that of networking behaviors, and creativity among salespeople. Specifically, we include customer and professional networking behaviors and study their direct, interactive, and curvilinear effects on salesperson creativity. Empirical findings show that professional networking as well as customer networking are positively related to salesperson creativity. Further, we demonstrate the non-linear effects of professional …

Domicile Dismantled, Kerry Abrams, Kathryn Barber Apr 2017

Domicile Dismantled, Kerry Abrams, Kathryn Barber

Indiana Law Journal

Part I of this Article discusses the legal and factual background of Mas v. Perry. This narrative reveals how the case reflects both the changes in American society that were beginning to occur at that time and the struggle of the concept of domicile to keep pace with those changes. Part II traces the development of the fundamental shift in gender roles that began several years before Mas was decided. This section argues that the growing number of women attending college, embarking upon careers, and forming two-career marriages increased the difficulty of measuring domicile, while undermining the efficacy of a …

Law And Identifiability, Daphna Lewinsohn-Zamir, Ilana Ritov, Tehila Kogut Apr 2017

Law And Identifiability, Daphna Lewinsohn-Zamir, Ilana Ritov, Tehila Kogut

Indiana Law Journal

Psychological studies have shown that people react either more generously or more punitively toward identified individuals than toward unidentified ones. This phenomenon, named the identifiability effect, has received little attention in the legal literature, despite its importance for the law. As a prime example, while legislators typically craft rules that would apply to unidentified people, judges ordinarily deal with identified individuals. The identifiability effect suggests that the outcomes of these two forms of lawmaking may differ, even when they pertain to similar facts and situations.

This Article is a preliminary investigation into the relevance of the identifiability effect for law …

Doux Commerce, Religion, And The Limits Of Antidiscrimination Law, Nathan B. Oman Apr 2017

Doux Commerce, Religion, And The Limits Of Antidiscrimination Law, Nathan B. Oman

Indiana Law Journal

This Article addresses the question of law, religion, and the market directly. It does so by developing three theories of how one might conceptualize the proper relationship between commerce and religion. The first two theories I offer are not meant to be summaries of any position explicitly articulated by any particular thinker. There is a paucity of explicit reflection on the question of markets and reli-gion and virtually no effort to generate broad legal theories of that relationship. Rather, these theories are an attempt to explicitly articulate clusters of intuitions that seem to travel together. My hope is to show …

“Illegal” Migration Is Speech, Daniel I. Morales Apr 2017

“Illegal” Migration Is Speech, Daniel I. Morales

Indiana Law Journal

Noncitizens must comply with immigration laws just because citizens say so. The citizenry takes for granted its monopoly on immigration control, but the legitimacy of this arrangement has been called into question by cutting-edge political theorists. One prominent theorist argues, for example, that basic democratic principles require that noncitizens living outside the United States have a say in the formation of immigration law since they must obey it. This Article provides a legal response to these political theory developments, assimilating them, along with the facts on the ground, into an account of “illegal” migration as First Amendment speech.

If noncitizens’ …

Death And Dignity, Michael Gardner Apr 2017

Death And Dignity, Michael Gardner

Brigham Young University Prelaw Review

This paper discusses the contemporary debate over physician-assisted suicide and focuses specifically on Oregon’s Death with Dignity Act. Because the majority of the states have yet to pass legislation on physician-assisted suicide, the greatest debate over the legality of euthanasia is yet to come. This paper addresses the arguments for and against physician-assisted suicide with the purpose of educating the reader regarding the social, moral and ethical consequences of allowing or denying its practice.

Redefining Immutability: Utah's Model For Advancing Lgbt Rights, Zachary Herzog Apr 2017

Redefining Immutability: Utah's Model For Advancing Lgbt Rights, Zachary Herzog

Brigham Young University Prelaw Review

This paper attempts to explain the Supreme Court’s recent efforts to expand the definition of immutable rights to protect LGBT Americans and argues that gender identity also be included in that definition. States should expand this definition in their own constitutions and do so in a way that protects the interests of the LGBT community as well as other demographics. Utah Senate Bill 296 is a good example of how this definition can be successfully expanded, and should be a model for states in which LGBT antidiscrimination legislation has been less effective.

Leaving Behind Self-Righteousness: Using Mutual Respect And Compromise To Solve Emerging Conflicts Between Religious Liberty And Same-Sex Marriage, Benjamin Issa Apr 2017

Leaving Behind Self-Righteousness: Using Mutual Respect And Compromise To Solve Emerging Conflicts Between Religious Liberty And Same-Sex Marriage, Benjamin Issa

Brigham Young University Prelaw Review

This paper attempts to provide a reasonable framework for thinking about religious liberty issues following the Supreme Court's decision in Obergefell v. Hodges. Following the decision in that case, which requires states to wed same-sex couples, there has been a national debate about when - and if - religious business owners can discriminate based on sexual orientation. This issue pits religious liberty organizations against LGBT rights organizations, and leaves both sides feeling demonized and misunderstood. This paper advocates a more nuanced approach, and suggests that reasonable compromise is possible if we are willing to leave behind self-righteousness and instead engage …

The Systematic Neglect Of Inmates Suffering From Substance-Use Disorder In The American Prison Systems, J Lyons Apr 2017

The Systematic Neglect Of Inmates Suffering From Substance-Use Disorder In The American Prison Systems, J Lyons

Brigham Young University Prelaw Review

While the problem of crime and its perpetuation is multifactorial and inherently complex, the mental and physical health of criminals falls under the legal oversight of the penal system. Prisoners have a legal right to quality medical care—a right that is often forgotten and neglected by society at large and, more specifically, the court system itself.

Workplace Discrimination And The Inefficiency Of The Ellerth/Faragher Defense, Kimberly F. Medina Apr 2017

Workplace Discrimination And The Inefficiency Of The Ellerth/Faragher Defense, Kimberly F. Medina

Brigham Young University Prelaw Review

This article addresses the growing problem of workplace discrimination. Even though a few states have implemented laws requiring employers to train their employees on workplace discrimination, the number of discrimination claims has continued to rise each year. In 1998 the Supreme Court ruled on two important cases regarding workplace discrimination. Their opinion on these cases established what is known as the Ellerth/Faragher defense. The Ellerth/Faragher defense sets standards that an employer must meet to claim affirmative defense in cases of illegal discrimination. This article argues that the current standards set in this defense are flawed and need to be updated. …

Abstinence-Only Sex Education On Trial, Kendall W. Orton Apr 2017

Abstinence-Only Sex Education On Trial, Kendall W. Orton

Brigham Young University Prelaw Review

Title V abstinence-only sex education funds are used to fund programs that do not reduce sexual activity, STDs, or pregnancy in high school students, contrary to the purported goals of public school sexual education. This paper outlines the history and legal and social research regarding sexual education. It also argues that comprehensive sex education does not violate the Establishment clause or Free Exercise clause by applying the Lemon doctrine. This paper advocates that the United States government should only fund comprehensive sexual education models that have shown positive results and promote healthy attitudes about sex.

Child Prisoners: Asylum-Seeking Detainees In The U.S. And The Violation Of The Flores Settlement Agreement, Miriam L B Sweeney Apr 2017

Child Prisoners: Asylum-Seeking Detainees In The U.S. And The Violation Of The Flores Settlement Agreement, Miriam L B Sweeney

Brigham Young University Prelaw Review

The Flores Settlement Agreement allows for asylum-seeking minors to be released from detention if the minors are in unsafe circumstances. Children are experiencing physical and mental harm in asylum-seekers’ detention. This harm constitutes a lack of safety. Therefore, the current conditions of detention for asylum-seekers violate the Flores Settlement Agreement.

The Battle Of Birthright Citizenship, Joshua White Apr 2017

The Battle Of Birthright Citizenship, Joshua White

Brigham Young University Prelaw Review

This article examines the legal case behind denying birthright citizenship to the children of illegal aliens born on U.S. territory and thereby correcting the present interpretation of the Citizenship Clause. Currently, children of illegal aliens born on U.S. territory are automatically granted citizenship jus soli. This removes the sovereignty of the American citizen by supplanting the citizen with an illegal alien in determining who can become citizens of the United States. To resolve this problem, Congress must enact legislation specifically restricting birthright citizenship from children of illegal aliens. While other articles focus on the morality of accepting refugees or illegal …

Reevaluating The Constitutionality Of Blanket Primaries, Soren J. Schmidt Apr 2017

Reevaluating The Constitutionality Of Blanket Primaries, Soren J. Schmidt

Brigham Young University Prelaw Review

I argue that the Supreme Court’s ruling in California Democratic Party v. Jones should be reconsidered and overturned, allowing states to adopt blanket-primary election systems. Given the crucial role that primaries play in the public process of elections, parties’ rights of association should not trump the right of the people to select their own representatives. In Jones, the Court applied a stricter constitutional test than necessary, leading to an erroneous conclusion. I demonstrate why a more flexible test would have been more appropriate for judging primary elections. Under this alternative test, public state interests are weighed against party rights injuries. …
