Cases warranting the grant of an anti-suit injunction can be divided into three main categories: breach of agreement, vexatious, oppressive, or unconscionable conduct, and abuse of process. A series of Singapore cases have demonstrated that the boundaries between the first two categories are ambiguous in Singapore law. This ambiguity reflects a lack of clarity about the principles underlying anti-suit injunctions and creates uncertainty as to the applicable analysis for each category. This article argues that the two categories should be distinct in kind, with both categories remaining part of the court’s equitable jurisdiction. Such an approach will provide a good …

There are few cases outside the US that deal with the assessment of damages for infringement of intellectual property rights. When they do, as Lord Shaw said: “[It involves] the exercise of a sound imagination and the practice of the broad axe.” This article discusses decisions where the infringer has ended up paying at the low end of what it would have paid as a legitimate user. What is the historical connection between deinstitutionalization and the Olmstead decision? The purpose of this study was to examine and analyze policy within a historical perspective the connections between institutional care, deinstitutionalization, the Olmstead decision, and the effect on persons with intellectual disabilities lived experience, in the state of Illinois.
The data collected include, the transcripts of interviews with four participants, artifacts from policy documents and historical papers accessed from the Disability Museum online journals. The creation of a table for use in coding themes as associated with 5 (out of 18) core concepts for disability policy.

Effects Of The Minimum Wage On Employment Dynamics, Jonathan Meer, Jeremy West

The voluminous literature on minimum wages offers little consensus on the extent to which a wage floor impacts employment. We argue that the minimum wage will impact employment over time, through changes in growth rather than an immediate drop in relative employment levels. We conduct simulations showing that commonly-used specifications in this literature, especially those that include state-specific time trends, will not accurately capture these effects. Using three separate state panels of administrative employment data, we find that the minimum wage reduces job growth over a period of several years. Therapists can impact the likelihood a given patient will benefit from psychotherapy. However, therapists are rarely held accountable for their patients' outcomes. As a result, low performing providers likely continue to practice alongside providers with high response rates. In the current study, we conducted a Monte Carlo simulation to illustrate a thought experiment—what happens to patient outcomes if therapists with the worst outcomes were removed from practice? We drew initial samples of 50 therapists from three simulated populations of 1,000 therapists with a mean patient response rate of 50% and different effect sizes for therapist variability in outcomes. We say that agreeing to agree is possible for an event E if there exist posterior beliefs of the agents with a common prior such that it is common knowledge that the agents' posteriors for E coincide. We propose a notion called Dutch book which is a profile of interim contracts between an outsider and the agents based on the occurrence of E, such that the outsider makes positive profit in all states. In this paper, we study a partially linear dynamic panel data model with fixed effects, where either exogenous or endogenous variables or both enter the linear part, and the lagged dependent variable together with some other exogenous variables enter the nonparametric part. Two types of estimation methods are proposed for the first-differenced model. This study aims to advance our conceptual understanding of selection procedures by exploring the effect of response fidelity (i.e., written constructed response vs. behavioral constructed response) on test performance, validity, and applicant perceptions. Stimulus fidelity (multimedia stimulus) was kept constant. In a field experiment, 208 applicants for entry-level police officer jobs completed a multimedia situational judgment test with written constructed responses and behavioral responses. We hypothesized the behavioral response mode (a) to be a better predictor of police trainee performance one year later, (b) to be less cognitively saturated, (c) to exhibit higher personality (extraversion) saturation, and (d) to be …

This article summarizes the results of a research program conducted in 11 Latin America countries, addressing two questions: (1) what factors determine territorial development dynamics that lead to economic growth, poverty reduction, and improved income distribution? (2) What can be done to stimulate this kind of territorial dynamics? This article is the introduction to a volume containing findings from a program conducted over five years in 11 Latin America countries, to answer three questions: (1) Are there rural territories that have experienced simultaneous economic growth, poverty reduction, and improved distribution of income?; (2) What factors determine these territorial dynamics?, and, (3) What can be done to stimulate and promote this kind of territorial dynamics? The article outlines the analytical and policy issues and the methodology, summarizes the remaining 10 papers in the collection, and presents a conceptual framework that itself is one of the results of the program.

This paper develops the approximate bias of the ordinary least squares estimator of the mean reversion parameter in continuous-time Levy processes. Several cases are considered, depending on whether the long-run mean is known or unknown and whether the initial condition is fixed or random. The approximate bias is used to construct a bias corrected estimator. The performance of the approximate bias and the bias corrected estimator is examined using simulated data.

How can agents in the military, who control the means of coercion, commit not to expropriate from producers? In this paper we propose competition within the military as one of the mechanisms that can deter predation and consequently create commitment. In our model, even if agents within the military could expropriate all output costlessly, it is attractive to protect producers from predating military units. This marginal defensive advantage and consequently defence is an effective way to potentially eliminate is because there is a other military units, reducing competition and leading to higher future payoffs. In this paper we consider model averaging for quantile regressions (QR) when all models under investigation are potentially misspecified and the number of parameters is diverging with the sample size. To allow for the dependence between the error terms and regressors in the QR models, we propose a jackknife model averaging (JMA) estimator which selects the weights by minimizing a leave-one-out cross-validation criterion function and demonstrate its asymptotic optimality in terms of minimizing the out-of-sample final prediction error. Employees’ communication behaviors are an important area of research for public rela-tions. In this study, employees’ communication behaviors in a de-identified context havebeen studied from the perspective of online flaming by analyzing “confessions” posted on aFacebook confessions page. The theoretical perspectives of the uses and gratification theoryand employee communication behavior in public relations literature were adopted in thisstudy. Positive and negative “confessions” were analyzed to identify employees’ motiva-tions in posting them. Sustainability and Social Justice
Framed by concepts of territorial project, social coalitions, and scalar relationships, we analyze rural territorial dynamics under conditions of rapid expansion in natural gas extraction. Analyzing recent economic, political, and territorial transformations of Bolivia's gas-rich region, Tarija, we argue that pre-existing territorial projects of a diverse set of subnational and national actors have: (i) shaped the influence of the gas industry on local dynamics; (ii) changed the scale relationships between local communities, the state, and companies; and (iii) mediated the transformation of territories in ways determined by the nature and aspirations of these territorial projects.

This paper describes the implementation of long wave radiation (LWR) exchange as part of a co-simulation process of an urban scale simulation program, CitySim, and a building scale program, EnergyPlus. This coupling process was achieved through the use of functional mockup units (FMU) to exchange various weather, load, and environmental information between the two simulation engines. LWR is an important factor to exchange between the programs as CitySim has more advanced capabilities for radiation exchange calculations from a set of urban buildings and EnergyPlus has a more advanced building heating and cooling load calculation engine. Impact Of International Remittances On Schooling In The Philippines: Does The Relationship To The Household Head Matter?, Tomoki Fujii

We study the impact of international remittances on schooling in the Philippines, taking into account the school-age individual's relationship to the household head. This consideration is important because employment opportunities abroad may be taken at the expense of the quality of child rearing. Our estimation results indicate that there are, indeed, significant negative guardian effects on school attendance and education expenditures when children with overseas parents are looked after by a relative other than a parent or grandparent. However, these negative effects tend to be outweighed by the positive impact of remittance flows from overseas.

The aim of this article is to empirically identify convergence clubs in energy intensity among 109 countries from 1971 to 2010 by using a recently developed methodology, i.e., a new regression-based convergence test, introduced by Phillips and Sul (2007). This log t test allows us to endogenously identify the groups of countries that converge to different equilibriums and those that do not converge to any convergence clubs. We mainly find that, first, world countries do not seem to converge at the same steady-state level; instead, they form four separate clubs converging to their own steady-state paths and few countries are …

This article describes the results of a pilot study to determine the feasibility and acceptability of a mental health promotion program that was developed to address minority stressors and promote coping skills among lesbian, gay, bisexual, transgender, and queer (LGBTQ) youth. It was hypothesized that the program would be feasible to implement within the context of a gay–straight alliance (GSA) and that GSA members would find the program acceptable (e.g., educational, enjoyable, helpful, and relevant).
