In Quarella SpA v Scelta Marble Australia Pty Ltd [2012] SGHC 166, the High Court of Singapore (per Prakash J) rejected an application to set aside two related arbitration awards. The ground for setting aside was an alleged misinterpretation of a choice of law clause by the tribunal. In rejecting the application, the High Court demonstrated its unwillingness to set aside an award when the tribunal has considered and respected the choice of law clause (regardless of the interpretation the tribunal ultimately preferred). Notably, the High Court did not close the door on instances where the tribunal may have failed …

Racial/Ethnic Differences In The Relationship Between Neighborhood Disadvantage And Adolescent Substance Use, Abigail A. Fagan, Emily M. Wright, Gillian M. Pinchevsky

Criminology and Criminal Justice Faculty Publications

Although social disorganization theory hypothesizes that neighborhood characteristics influence youth delinquency, the impact of neighborhood disadvantage on adolescent substance use and racial/ethnic differences in this relationship have not been widely investigated. The present study examines these issues using longitudinal data from 1,856 African American, Hispanic, and Caucasian adolescents participating in the Project on Human Development in Chicago Neighborhoods (PHDCN). The results indicated that neighborhood disadvantage did not significantly increase the likelihood of substance use for the full sample. When relationships were analyzed by race/ethnicity, one significant (p ≤ .10) effect was found; disadvantage increased alcohol use among African Americans …

This paper utilizes the behavioral agency model to investigate why many formerly public companies have been converted to privately held corporations. Using a matched pairs sample and categorical binary regression, and controlling for effects found in previous studies, we explore how the equity ownership of those entrusted to manage firms, the firms’ executives, might affect their perceptions of the risks of going private and might therefore affect the decision to take a company private. This study complements prior research examining the predictors of public to private transactions and illustrates how behavioral agency theory can provide insight into a major decision …

Beyond Stochastic Volatility And Jumps In Returns And Volatility, Garland Durham, Yang-Ho Park

While a great deal of attention has been focused on stochastic volatility in stock returns, there is strong evidence suggesting that return distributions have time-varying skewness and kurtosis as well. Under the risk-neutral measure, for example, this can be seen from variation across time in the shape of Black-Scholes implied volatility smiles. This paper investigates model characteristics that are consistent with variation in the shape of return distributions using a stochastic volatility model with a regime-switching feature to allow for random changes in the parameters governing volatility of volatility, leverage effect and jump intensity. The Elementary School Success Profile Model of Assessment and Prevention (ESSP MAP) is an assessment and intervention strategy designed to improve student academic performance and behavior. The current analysis uses a quasi-experimental design to examine the relationship between a 3-year implementation of the ESSP MAP and aggregate academic outcomes. Students in one 3rd grade cohort (2007-2008) from 4 schools in 1 district received the intervention as they progressed from 3rd to 5th grade. Longitudinal hierarchical linear modeling with cross-classified effects of schools (N = 10) and cohorts (N = 11) was used to compare trajectories of reading proficiency percentages for …

Racial And Ethnic Disparities In Food Insufficiency: Evidence From A Statewide Probability Sample Of White, African American, American Indian, And Hispanic Infants, Yunju Nam, Jin Huang, Colleen Heflin, Michael Sherraden

This study examines racial and ethnic disparities in the experience of food insufficiency among families with infants, focusing on the roles of socioeconomic characteristics. It uses the SEED for Oklahoma Kids baseline survey data collected from a probability sample of white, African American, American Indian, and Hispanic caregivers of infants randomly selected from Oklahoma’s birth certificates. Fairlie’s extension of the Blinder-Oaxaca decomposition is employed to analyze these data. Results suggest that whites experience food insufficiency at a statistically significantly lower rate than do the three minority groups. Compositional gaps in economic and noneconomic resources are found to explain much of …

The purposes for this comparative analysis were to (a) compare the efficacy of NASA media relations strategies according to NASA's stakeholders and (b) reveal if these media relations strategies have a causal relationship or correlation with U.S. space policy. NASA employees reflected positive responses to questions related to the efficacy of NASA media relations strategies and the overall communications philosophy of the organization. Journalists who report on NASA through traditional and online channels had mixed responses toward the organizations media relations efforts during crisis situations like the Columbia and Challenger shuttle disasters. Certified nursing assistants (CNAs) perform an important role in the long-term care system because they provide the majority of paid care to nursing facility residents. Unfortunately, annual CNA turnover often exceeds 100 percent nationally. Many factors account for this, including stressful working conditions, low pay, and limited benefits. The end result of high turnover is compromised continuity of care for residents, which often leads to poor quality and substandard care. The case is timely, in that only ten percent of new product introductions result in a profitable business.
