Appeal Waivers And The Future Of Sentencing Policy, Nancy J. King, Michael E. O'Neill

Vanderbilt Law School Faculty Publications

This paper is the first empirical analysis of appeal waivers clauses in plea agreements by which defendants waive their rights to appellate and postconviction review. Based on interviews and an analysis of data coded from 971 randomly selected cases sentenced under the United States Sentencing Guidelines, the study's findings include (1) in nearly two-thirds of the cases settled by plea agreement, the defendants waived their rights to review; (2) the frequency of waiver varies substantially among the circuits, and among districts within circuits; (3) the government appears to provide some sentencing concessions more frequently to defendants who sign waivers than …

This paper examines Singapore's innovations in electoral and spatial integration. In examining the Group Representation Constituency and the Ethnic Integration Policy, a critique is made of the official discourse that multiracialism is internalized and entrenched in Singapore's political psyche and electoral process. While the electoral and spatial integration policies are driven by the objective of enhancing multiracialism, their actual workings do not adequately advance the development of norms and values that would be truly supportive of the need for a multiracial legislature and an abiding commitment to multiracialism. We present a spatial map of the Italian House of Deputies during the XIII Legislature obtained by applying the Poole and Rosenthal methodology to roll call data. We estimate coordinates for almost all the 650 Deputies that were on the House’s floor at the time, and we aggregate them according to parties. We find that voting patters generate basically a two dimensional political space. The first dimension represents loyalty to either the ruling coalition or the opposing one. The second dimension is represented by the European Union. These findings are consistent with the exceptional case of the party Northern League, …

There is tremendous momentum for economic and financial integration in East Asia today. Partly inspired by the formation of the European Union and partly as a response to the 1997/98 Asia financial crisis, many East Asian countries are showing greater commitment to regional economic cooperation. A number of bilateral free trade agreements (FTAs) have either been concluded or are being negotiated.1 At a less formal level, the ASEAN+3 grouping has brought the whole region together in regular consultations over trade, investment, as well as monetary and exchange rate policy matters.

The threat of another major terrorist attack in the United States remains high, with the greatest danger coming from local extremists inspired by events in the Middle East. Although the United States removed the Taliban government and destroyed al Qaeda’s training camps in Afghanistan, events in Europe and elsewhere have shown that the terrorist network leadership remains determined to carry out further attacks and is capable of doing so. Therefore, the United States must systematically conduct research on terrorist strikes against transportation targets to distill lessons learned and determine the best practices for deterrence, response, and recovery. Public transit systems around the world have for decades served as a principal venue for terrorist acts. Today, transit security is widely viewed as an important public policy issue and is a high priority at most large transit systems and at smaller systems operating in large metropolitan areas. Research on transit security in the United States has mushroomed since 9/11; this study is part of that new wave of research. Remembering The Good, Forgetting The Bad: Intentional Forgetting Of Emotional Material In Depression, Jutta Joormann, Paula T. Hertel, F. Brozovich, Ian Henry Gotlib

The authors examined intentional forgetting of negative material in depression. Participants were instructed to not think about emotional nouns that they had learned to associate with a neutral cue word. The authors provided participants with multiple occasions to suppress the unwanted words. Overall, depressed participants successfully forgot negative words. Moreover, the authors obtained a clear practice effect. However, forgetting came at a cost: Compared with the nondepressed participants and with the depressed participants who were instructed to forget positive words, depressed participants who were instructed to forget negative words showed significantly worse recall of the baseline words. Purpose. Red signals are typically used to signify danger. This study was conducted to investigate a situation identified by train drivers in which red signals appear yellow when viewed at long distances (∼900 m) through progressive-addition lenses.

Methods. A laboratory study was conducted to investigate the effects of defocus, target size, ambient illumination, and surround characteristics on the extent of the color misperception of train signals by nine visually normal participants. The data from the laboratory study were validated in a field study by measuring the amounts of defocus and the distances at which the misperception of the color of …

The Nature Of Metropolitan Governance In Urban America: A Study Of Cooperation, Conflict, And Avoidance In The Kansas City Region, Curtis H. Wood

In this study I determine the dominant pattern of governance in the Kansas City metro based on interviews with 46 city administrative officers in cities over 2,500 in population. Consistent with theories of cooperation, I found that the dominant governance strategy is intergovernmental cooperation in the delivery of public services punctuated by conflict and avoidance/defection when intergovernmental service delivery arrangements involve infrequent interaction between the parties and when the presence and influence of the regional council of government is minimal.

Starting with the “consolationist” and “fragmentationist” arguments in American local government and contemporary patterns of increasing jurisdictional cooperation and regionalization, this paper examines patterns of jurisdictional cooperation and power sharing in metropolitan regions, and analyses the influence of extrajurisdictional benefits on local government decisions to engage in regional agreements. Our findings are based on a survey of local government officials in the Kansas City Metropolitan area. Cooperation is examined using an Axelrod-type prisoner’s dilemma scenario. Participants include elected officials, chief administrative officers, and department-level administrators—Police Chiefs, Parks and Recreation Directors, Fire Chiefs, and Public Works Directors. The range of interlocal contractual arrangements in the realm of public safety in Florida provides a research site to examine the extent to which these arrangements have been used by local governments. We developed a contractual perspective on interlocal contractual arrangements as relational contracts by arguing that their institutional designs are partly an effort of involved parties to reduce transaction costs that are the product of the properties of the services themselves; and partly by state statutes that allowed mix approaches to contractual arrangements. This paper empirically examines the interrelationships between service characteristics and the structure of networks among local jurisdictions using relational data across a set of diverse services from Pinellas County in Florida. In metropolitan areas, cities as well as counties work together to become increasingly efficient in public service delivery, and hence, engage into a variety of cooperative arrangements such as bilateral or multilateral service agreements. Increasing restraints on jurisdictions’ fiscal capacity have further forced them to look for cooperative avenues. Despite the increased interest in voluntary services cooperation, little is known about the factors that encourage local governments to enter into collaborative services arrangements with each other. This paper addresses this question through an analysis of interlocal contracting arrangements for police and fire services reported by 464 local governments in Michigan. While the contracting of public services is increasing common in local governments across the country, collaborations on police and fire services have proved far more difficult to achieve. We develop and apply a theoretical framework for understanding how local governments respond to the perceived costs and benefits of intergovernmental cooperation. Our theory connects local government decisions to economic and political costs and benefits at both the local and regional levels, as well as the institutional context in which collaborative decisions take place. This paper explores the factors that contribute to successful interlocal agreements. Success is defined in terms of achieving agreement objectives, increasing the effectiveness of the public service, and increasing the efficiency of the public service. Influential factors of interest include the reason the interlocal agreement was created, the estimated costs and benefits of participation in the agreement, and the types and levels of communication between the parties to the agreement. Increasingly, state and local governments are promoting intergovernmental coordination, cooperation, and/or outright consolidation (3Cs) based on the perceived economies of scale advantages of such joint actions. However, the growing public finance and political science literature on interregional cooperation highlights the fact that transactions or other cooperation costs may preclude the realization of economies of scale benefits. Despite this evidence, some proponents go as far as to view such collaborative actions as effective policy tools for enhancing regional economic development and competitiveness.
