In 2003, the Kentucky Supreme Court adopted the amended KRS 412, effectively making the language of KRE 412 consistent with the analogous Federal Rule of Evidence 412. Now, as in federal court, the provisions of the Rape Shield Law apply in both criminal and civil cases to govern when and how evidence of a victim's alleged sexual behavior or sexual predisposition may be introduced. The article describes the intent of the original Rape Shield Law and the implications of its amended version in both civil and criminal cases.

Identity As A Source Of Moral Motivation, Sam A. Hardy, Gustavo Carlo

Theory and research regarding moral motivation has focused for decades on the roles of moral reasoning and, to some extent, moral emotion. Recently, however, several models of morality have positioned identity as an additional important source of moral motivation. An individual has a moral identity to the extent that he or she has constructed his or her sense of self around moral concerns (e.g., moral values). This paper reviews theory and research linking moral identity to moral behavior and commitment. Additionally, it suggests several key unanswered questions about moral identity and provides recommendations for future research.

With the growing demand on cluster analysis for categorical data, a handful of categorical clustering algorithms have been developed. Surprisingly, to our knowledge, none has satisfactorily addressed the important problem for categorical clustering – how can we determine the best K number of clusters for a categorical dataset? Since categorical data does not have the inherent distance function as the similarity measure, traditional cluster validation techniques based on the geometry shape and density distribution cannot be applied to answer this question. Solving The Bargaining Democracy Problem Using A Constitutional Hierarchy Of Law, Clas Wihlborg

In the “bargaining democracy” groups form coalitions that are able to grant benefits to themselves through legislation. These benefits may lack popular support. A constitutional hierarchy of conflicting laws is proposed to resolve this democratic problem. In the hierarchy more “rule-oriented” legislation dominate. The hierarchy would create a momentum of the political process towards more rule-oriented legislation and policy debate. The difficulty of defining a rule operationally is overcome by limiting the task of a constitutional court to simply rank conflicting policy actions in terms of criteria for rules.

The author examined how the residents in the five-county region of the metropolitan area (Clackamas, Columbia, Multnomah, Washington, and Yamhill) voted in the 2004 general election on selected ballot measures in order to understand the political values of the neighborhoods in which we live. Using geographic information systems (GIS), we mapped the distribution of votes by election precinct on what we thought were three of the most revealing measures: the constitutional amendment banning same-sex marriages (Measure 36), the initiative requiring state and local governments to pay landowners when land-use restrictions reduce property value (Measure 37), and the constitutional amendment limiting …

From the Roman aqueducts to Bonneville Dam, humans have built structures to moderate the extremes of natural water flow. Some of these structures, from Roman cisterns to the catch basins under modern city streets, have inadvertently supplied mosquitoes with the standing water in which they thrive and multiply. Even more mosquito habitat may have been created in the last decade by a change in the Clean Water Act. The original drive behind the Act, in 1972, was the elimination of point-source pollution: sewage and industrial discharge into waterways. Since the 1997 financial crisis, ASEAN countries have become involved individually and regionally in the accelerating trend towards bilateral free trade agreements. Singapore began the trend, followed by Thailand, and then other countries including Malaysia, the Philippines and Vietnam. ASEAN also accepted China's proposal for an agreement with the grouping as a whole, leading to similar negotiations with Japan, India and South Korea. A complex web of bilateral agreements is emerging. At present it is not clear how this will affect ASEAN's progress towards deeper regional integration.

In this article, I explore whether regional economic cooperation in the form of growth triangles, made popular during the late 1980s, can continue to be relevant in the face of more formal arrangements such as free trade agreements and other bilateral initiatives in recent years. The discussion is focussed on the Indonesia-Malaysia-Singapore growth triangle which is a pioneering arrangement in Southeast Asia. This project continues to be a successful mode of cooperation among the three countries and will remain a key and subtle framework for regional economic collaboration amidst the plethora of other initiatives. Using a socio-religious approach to autobiography, a sociologist traces her development within the Roman catholic Church and her journey from the center of that religious faith to the margins. As a Feminist sociologist critiquing the institution and its practices which exclude women from ordination, Women-Church, an umbrella organization of feminist groups within the Roman catholic tradition, is used as an example of what a more inclusive religious organization could look like.

On September 10, 2005, the Georgia Archives celebrated its eighty-eighth birthday in a new home, its fourth since 1918. Georgia Secretary of State Cathy Cox formed a unique partnership with state and federal government officials, one county, two cities, a university, and a foundation to accomplish construction of the 171, ooo square-foot building. The construction took just nineteen months from groundbreaking to opening day, but the events that led to the new archives dated back many years, even decades. In fact, though no one knew it at the time, they began with the construction of an interstate highway.

Discordant Harmonies In Fingernail Clam Populations (Musculium Transversum) Of Mississippi River Backwater Lakes, Jim Eckblad

The populations of Musculium transversum from 8 backwater lakes have been studied over a 29-year period based upon over 440 grab samples. These lakes in Navigation Pool 9 of the Upper Mississippi River (UMR) range in size from 2 to 255 hectare surface area, mean depths from 0.2 to 0.9 meters, with mean water exchange times from 0.5 to almost 57 hours. Samples from the 1989-91 period suggested summer Muscu!ium populations had declined to about 9 percent of their mid-1970 levels. Deterministic models have attempted to explain this decline. More recent sampling suggests a substantial recovery of Musculium populations (mid-summer …

During the 1890s, people on the Mississippi River exploited mussel populations to support a thriving button industry. Within a brief time, they noticed significant declines in mussel populations, and called on the U.S. Bureau of Fisheries to save the resource. This paper discusses mussel propagation studies, techniques, and activities carried on in association with the Fairport Biological Laboratory (Iowa) from about 1908 to 1932. While scientists developed sophisticated techniques and had success in mussel propagation, changing habitat conditions in the river (caused mainly by pollution and dam construction) meant limited success in rescuing mussel stocks, while the introduction of plastic …

The continued steady growth of public sector unions compels public administrators to understand the influence labor organizations exert upon local governments. The following study demonstrates the extent of union influence upon police expenditures in Florida. Union influence not only increases total police expenditures and personal services expenditures, it also causes operating expenses to rise. Union influence is less pronounced, and possibly even non-existent in capital outlays expenditures because of possible lack of interest on the part of the union in this area and also because of the existence of economically predetermined policies regarding capital outlays such as vehicle purchases. A digital geologic map of Sonora quadrangle was produced at 1:24,000 scale using the geographic information system GIS) software Maplnfo. The geology of Sonora quadrangle consists of sedimentary rocks from the Ordovician, Devonian, Mississippian, and Pennsylvanian Systems. The Cotter, Powell, and Everton formations represent the Ordovician System. The Clifty and Chattanooga formations represent the Devonian System. The St. Joe Limestone, Boone, Batesville, and Fayetteville formations represent the Mississippian System. The Hale formation represents the Pennsylvanian System. The St. Joe Limestone crops out extensively in Sonora quadrangle and is unconformably overlain by the Boone formation in the southern portion of the …

Introduction: This study examines demographic and socioeconomic aspects of the Latino population of the New York City area between 1999 and 2004.

Methods: Data on Latinos and other racial/ethnic groups were obtained from the U.S. Census Bureau American Community Survey, reorganized for public use by the Minnesota Population Center, University of Minnesota, IPUMSusa. Cases in the dataset were weighted and analyzed to produce population estimates.

Results: The most striking differential when household income patters are examined is that among Latino households there was almost no increase in median household income between 1999 and 2004. Among whites, African Americans, and Asians …
