Labouring For Inclusion: Debating Immigrant Contributions To Chile, Megan Sheehan Nov 2021

Labouring For Inclusion: Debating Immigrant Contributions To Chile, Megan Sheehan

Sociology Faculty Publications

Over the last three decades, Chile has experienced transformative migratory flows, becoming more diverse in the process. As migrants from Latin American and Caribbean countries settle in Chile, they often face stereotypes laminating race, ethnicity, and nationality and shape paths toward inclusion through the job market. Amid the implementation of visa restrictions and the rollout of a new migration law, current debates over migration foreground ideas about which groups productively contribute to the nation’s development – discourses often linked to labour. Government rhetoric and policy debates frame a broader discussion of the role of migration in Chile, with both Chileans …

Responding To Violence From Abroad: The Mexican Diaspora Mobilising From Brussels And Paris Through Art-Based Strategies, Larisa Lara-Guerrero Nov 2021

Responding To Violence From Abroad: The Mexican Diaspora Mobilising From Brussels And Paris Through Art-Based Strategies, Larisa Lara-Guerrero

Peace and Conflict Studies

Over 150,000 people were intentionally killed in Mexico since 2006, after the Mexican government decided to openly combat organized crime. Against the backdrop of the security crisis, members of Mexican society have developed national and transnational strategies to contribute to the respond to the rampant violence in their homeland.

By introducing a transdisciplinary approach and peacebuilding theories, this paper argues that Mexican migrants living in Brussels and Paris have been able to orchestrate transnational art-based strategies to contribute to the violence alleviation in their country of origin. In particular, this empirical paper argues that Mexican migrants living in these two …

The Problematic Practices During The Process Of Marriage Proposal/Match Making, Hakima Afzaly Nov 2021

The Problematic Practices During The Process Of Marriage Proposal/Match Making, Hakima Afzaly

Three Minute Thesis (3MT®) at UNI

In Afghanistan, marriage is considered as something that completes life. It is very common to hear from Afghans that “without marriage, life and faith are incomplete.” Besides, the religion of Islam does not encourage celibacy. In fact, Islam states that the followers of Islam have legal rights to have sexual pleasure. Nevertheless, sexual intimacy is only permitted within marriage and sexual activity outside of marriage is considered illicit sex. It is considered adultery (Zena) that results in punishment. This is another reason why marriage is essential among the Afghan population, who are predominantly Muslims. That is why most Afghan parents …

SAIPAR Case Review

The law on sentencing in Zambia is to a great extent chaotic and in disarray. No clear standards are set by the superior courts to guide lower courts and litigants. Often the sentences are at variance with constitutional norms and there has been no sustained effort to align the law of sentencing with constitutional standards, save for a few cases concerning corporal punishment. Somehow, a judicial culture has evolved and continues to grow of sentencing people without regard for constitutional norms. Yet the constitution is the supreme law, the ultimate source of all law and ought to permeate all laws …

The Pandemic, Environmentalism, And Re-Thinking Social And Political Philosophy: Pandemic 2: Chronicles Of A Time Lost, Edward Sandowski, Betty J. Harris Nov 2021

The Pandemic, Environmentalism, And Re-Thinking Social And Political Philosophy: Pandemic 2: Chronicles Of A Time Lost, Edward Sandowski, Betty J. Harris

International Dialogue

In Pandemic!2-Chronicles of a Time Lost, Slavoj Žižek continues his discussions, written and performed in multiple media, of the pandemic that has severely afflicted the world for what seems so very long. And there are more trials coming, into the indefinite future, possibly, at worst, he imagines, terminated by a grand climate/ecological crisis and its consequences, which may, admittedly, end humanly experienced time altogether.

Do Politics Repel Truth? Hannah Arendt On Political Controversies In Dialogue With Plato, Marie-Josée Lavallée Nov 2021

Do Politics Repel Truth? Hannah Arendt On Political Controversies In Dialogue With Plato, Marie-Josée Lavallée

International Dialogue

This article uncovers Hannah Arendt’s debt to Plato’s work in her analyses of political controversies of her time, as Nazi propaganda and state lies on American involvement in the Vietnam War, and her assessment of the failure of the French Revolution. While her relation to Plato’s oeuvre when she tackles political issues most often took the form of a stormy and one-sided dialogue resembling a monologue, her treatment of these controversies shows that Arendt had at times an authentic, open, and fruitful dialogue with the Greek philosopher. To make sense of these phenomena and events, she uses a range of …

Fleeing From War Or Pandemic, And Returning Home, Rory J. Conces

International Dialogue

Today, the word ‘flee’ connotes a moral weakness for many, perhaps even cowardice for some. However, that is not entirely accurate. Fleeing may be a morally decent response to a dangerous situation. As the American philosopher Todd May wrote in his insightful book A Decent Life: Morality for the Rest of Us (2019): “Most of us seek to live a morally decent life. We are not moral monsters, but neither do we strive to be moral saints. [There are] avenues of moral improvement that do not require us … to sacrifice our deepest commitments and projects ….[Why? That which] … …

Forbearance, Endogenous Development, And Aid Work, Selina L. Haynes, Mark S. Williams

International Dialogue

The international aid industry continues to export paid and unpaid Westerners to undertake development work of questionable and suspect utility to Africa, and to the less-developed countries of other regions. Despite its widespread acceptance in the West and tremendous financial support, this work has been criticized as failing to meaningfully improve the quality of life due to a multitude of systemic challenges within the industry. This range of challenges includes the intrinsic power imbalances found between debtor nations and their creditors; the dominant position of great powers within international organizations and as the funders of international non-governmental organizations; the pathological …

Complex Effects Of International Relations: Intended And Unintended Consequences Of Human Actions In Middle East Conflicts Ofer Israeli. New York:, Kenneth Christie Nov 2021

Complex Effects Of International Relations: Intended And Unintended Consequences Of Human Actions In Middle East Conflicts Ofer Israeli. New York:, Kenneth Christie

International Dialogue

Ofer Israeli, in this book, offers us an original and encompassing study of the complex effects of international relations, elucidating for readers the intended and unintended consequences of human action. And that is no simple task given the often-chaotic way that international relations seem to play out in real life. Hindsight, particularly in international relations is beneficial but not always conducive to change and how we make decision-making effective goes beyond how we see our national interests play out. Any effort to alleviate, change these disastrous outcomes in the post 1945 period would have been welcome but we can see …

The Challenges Faced By University Educators In Singapore When Referring Students To Counsellors: An Instrumental Case Study, Poh Yaip, Steven Ng, Yee Lin Chung Nov 2021

The Challenges Faced By University Educators In Singapore When Referring Students To Counsellors: An Instrumental Case Study, Poh Yaip, Steven Ng, Yee Lin Chung

Research Collection School of Social Sciences

This study examines the difficulties faced by two university professors working in a public, autonomous university in Singapore, when referring students to counselling services. Educators typically observe how students interact and behave in class, and may refer students to counselling services. However, there is little research into how educators experience and view this role, particularly in higher education in Asia. Two university professors who had referred students to their university’s counselling centre took part in semi-structured interviews for the study. From these interviews, the study revealed educators can face a range of challenges in their referral role, such as lack …

Asia Embraces Digital Currency And Cryptocurrency, David Kuo Chen Lee

Asian Management Insights

A decade ago, everyone was sceptical about cryptocurrency. Today, Asian governments are harnessing its technology to raise payment efficiency and improve financial inclusion. Initially, the technology was advocated and harnessed by ‘cypherpunks’, that is, individuals who advocate the use of cryptography and other strong encryption technologies to promote social and political change. At that time, being a cypherpunk meant standing on the opposite side of the government; today, I see cypherpunks, otherwise more appropriately known as cryptopunks, working closely with governments.

Mineral Sands Resources (Pty) Ltd And Another V Redell And Others And Two Related Cases 2021 Sa 268 (Wcc), Dunia P. Zongwe

SAIPAR Case Review

This case teaches activists how to respond when they get SLAPPed. It introduced a defense mechanism to prevent lawsuits launched by big corporations to silence criticisms. North American lawyers commonly refer to these lawsuits as ‘strategic litigation (or lawsuits) against public participation (SLAPP). Two scholars from the United States of America (US) coined this acronym.2 And, in 2021, for the first time in South Africa, a court recognized the SLAPP phenomenon and accepted a defense against this kind of lawsuits.

When big corporations SLAPP activists and journalists, and their lawyers, judges should not slap back those corporations by accepting anti-SLAPP …

Swartbooi And Another V Speaker Of The National Assembly (Sa 38-2021) [2021] Nasc (4 August 2021), Dunia P. Zongwe

SAIPAR Case Review

In Swartbooi, the Supreme Court of Namibia failed to give flesh, blood and bones to a theory that could unify the cases that dealt with the separation of powers in Namibia. Though few lawyers would disagree with the outcome of its judgment, the Court nonetheless achieved this outcome by retreating into its legalistic shell.

At the same time, the Swaartbooi case completed a triangle that plotted all the possible relationships between the three organs of state in Namibia. After Ex parte in re: the Constitutional Relationship Between the Attorney-General and the Attorney-General (hereinafter referred to as ‘AG and PG’) addressed …

Dipak Patel V. The Minister Of Finance And The Attorney General Ccz 5 Of 2020 [2021], Chanda Chungu

SAIPAR Case Review

The Constitutional Court judgment of Dipak Patel v. The Minister of Finance and the Attorney General dealt with an application by Dipak Patel who sought, inter alia, a declaration that the failure by the Minister of Finance to bring all public debt that was contracted by the Executive to the National Assembly for approval was contrary to the Constitution. This case review seeks to provide a lucid and clear analysis of the Constitutional Court judgment, discussing the soundness of the court’s reasoning and approach to the issue of how public debt should be contracted.

Dipak Patel V. The Attorney General [2020] Ccz 005, Josiah Kalala

SAIPAR Case Review

In 2016, the Constitution of Zambia was amended, introducing a provision that required the National Assembly to approve all debt before it was contracted. The Constitutional amendment also introduced a requirement that legislation relating to the contraction and guaranteeing of debt should provide the category, nature and other terms and conditions of a loan, grant or guarantee that will require approval by the National Assembly before the loan, grant or guarantee is executed. Unfortunately, since the constitutional amendment in 2016, the government of Zambia acquired numerous loans without the approval of the National Assembly of Zambia. The Petitioner, a former …

SAIPAR Case Review

This action concerned an appeal from the Industrial Relations Court where an employee was employed on a permanent contract by Voluntary Services Overseas Zambia as an Administrative Officer on 11th July 1996. He was later promoted to the position of Officer Manager.

In 2001/2002, the employer changed its employment policy from employing staff on permanent terms to employing them on fixed-term contract. The facts that led to the Rulings stemmed from a judgment rendered against Chimanga Changa Limited whereby the Commercial Division of the High Court of Zambia awarded Export Trading Limited a sum of money relating to unpaid goods supplied. Frankson Musukwa (Suing On His Own Behalf And As Executive Director Of Zambia Deaf Youth And Women) & Others V. Road Transport And Safety Agency, Natasha Kapuka

SAIPAR Case Review

The facts giving rise to the Musukwa case emanate from the revolving debate on whether deaf people should be allowed to drive in the same way that able-bodied individuals have the liberty to. The Petitioners (all deaf) approached the Court seeking a ruling to the effect that S.62 of the Road Traffic Act, No. 11 of 2002 violate Articles 11(b), 22(1)(a) & 23(2) of the Constitution of Zambia. The Petitioners contended that the Respondent’s refusal to grant the 2nd Petitioner a driver’s license, and its decision to revoke the 3rd Petitioner’s license was a violation of their freedom of movement …
