Party Autonomy And Consumer Arbitration In Conflict: A “Trojan Horse” In The Access To Justice In The E.U. Adr-Directive 2013/11?, Norbert Reich

Arbitration clauses in consumer contracts have been subject to controversy in many jurisdictions; recent U.S. and Canadian Supreme Court case law have been used as examples. European Union (E.U.) law, which originally excluded arbitration in general from the Brussels/Rome regimes, has recently taken a mixed, and to some extent limited, approach by including Alternative Dispute Resolution (ADR) entities “imposing” a solution in its recent ADR Directive 2013/11. There seems to be an indirect encouragement to develop consumer arbitration schemes in E.U. Member States as a second route to justice. It is too early to evaluate this new and somewhat clandestine …

The momentum behind development of global online fast track low value high volume dispute resolution (hereafter ODR) continues to accelerate. Consumer and business groups around the world are promoting fair, proportionate, effective, online, fast track redress for low value high volume cross border e-commerce disputes. As a result, there will continue to be increasing demand for a variety of effective ODR systems design and procedural rules. Strangers In Their Own Lands: A Story Of Japanese Brazilians, Ken Aragaki

Brazil is home to the largest Japanese community outside of Japan. Since the first dispatch of Japanese immigrants in 1908, more than 240,000 people moved from Japan to Brazil between the early 1900s and the 1970s. Many of them settled outside the city of São Paulo and started working as coffee farmers under unfamiliar and harsh conditions. Today, according to some estimates, more than 1.6 million people of Japanese descent live in Brazil.
As Japan became the world’s economic power, it sought foreign workers to fill its booming labor market. The government turned to Japanese Brazilians and started granting them …

Unsettling: The Flawed Us Refugee System, Kanyakrit Vongkiatkajorn

The US has had a long commitment to resettling refugees, and currently funds one of the largest third-country resettlement programs through UNHCR in the world. However, an examination of US's refugee resettlement program shows that the program often does not live up to its promises, and has long ignored systemic issues. This report takes a specific look at the experience of newly-resettled Syrian refugees, and includes memos by the author that was submitted for a larger group project.

Citizen Havel And The Construction Of Czech Presidentiality, Timothy Barney

Václav Havel had two eventful terms as the first democratic president of the Czech Republic. The documentary Citizen Havel is one rhetorical artifact that captures the way a new democracy and its attendant executive power is constructed consciously in real time in a political culture where such a tradition has largely not existed. Culled from ten years of fly-on-the-wall-style footage, Citizen Havel captures the tensions between the constitutional expectations of the Czech presidency and Havel's own extraconstitutional interpretations of executive power. Ultimately, this essay argues that Citizen Havel is one influential representation of how Czech “presidentiality” during the post-communist transition …

In 2009, the United Nations Food and Agriculture Organization (FAO) adopted the Agreement on Port State Measures to Prevent, Deter and Eliminate Illegal, Unreported and Unregulated (IUU) fishing (PSMA). Countries that ratify the treaty commit to exert greater control at ports over foreign-flagged vessels to detect IUU catch before it is offloaded from vessels, and prevent the ill-gotten catch from entering the world’s markets. The PSMA, when effectively implemented globally, will be a major deterrent to IUU fishing. A major challenge to selecting ports for enhanced controls has been the lack of data on which ports are the world’s largest …

Partners Diversification And Exposure Of African Countries To International Crises: The Case Of Kenya, Giscard Assoumou Ella
International Journal of African Development
The objective of this paper is to characterize the exposure of Kenyan's income to international income, monetary and price shocks. The results suggest that the partners’ diversification permits them to resist to international shocks. In fact, Chinese conjuncture tends to be less exposed to OECD countries' income and inflation shocks. Also, income in this country more depends on domestic investment and household consumption, in comparison to the exposure to OECD country shocks. In this context, we observe that the exposure of Kenyan income to OECD shocks regresses when the dependence to Chinese conjuncture progresses.
