Getting a Handle on Hazardous Waste Control (Summer Conference, June 9-10)

The conference chairman was University of Colorado School of Law professor Lawrence J. MacDonnell.

During the past ten years Congress has made the regulation of hazardous waste a priority. This conference focuses on the Resource Conservation and Recovery Act, as amended in 1984, and the Comprehensive Environmental Response, Compensation and Liability Act.

This conference attracted about 100 registrants from 16 states plus the District of Columbia. John G. Welles, Regional Director for EPA Region 8, presented a luncheon address.

This paper will compare the global conventions concerned with controlling ship-borne pollution, noting the major differences in regulations concerned with the prevention, control and reporting of pollution incidents, as well as the enforcement provisions of these conventions. The Development And Constitutionality Of The 1971 Delaware Coastal Zone Act, Francis Cameron

In June 1971, the Delaware Legislature passed the Delaware Coastal Zone Act that barred heavy manufacturing industry from locating in an area one to six miles deep along the state's 115 mile coastline. The act created a State Coastal Zone Industrial Control Board to hear appeals from decisions of the State Planner. In addition, the act prohibited the construction in the bay of marine terminals for the transshipment of liquid and solid bulk materials of any substance, (specifically aimed at offshore oil and coal transfer) from vessels to onshore facilities. Air pollution is clearly one of the major social problems confronting contemporary American society. Yet the United States is still without an effective federal pollution control program, and those state and local control programs that do exist are largely ineffective. Until government regulation is able to keep the expulsion of air contaminants within tolerable limits, it will be necessary for those seeking to control air pollution to rely upon the assertion of private rights.
