As Latin America faces increasing climate-related health crises that disproportionately affect populations experiencing poverty and social exclusion, it becomes increasingly urgent to realize the most vulnerable's right to health. While the region's new constitutionalism (NLAC) has made progress in protecting this right, it has only recently begun to intersect with climate change law through rights-based climate litigation. This dissertation takes a transdisciplinary multi-methods research approach to answer the following question: How do health crises emerge within, and how are they addressed by courts through, domestic climate litigation in Latin America? International fisheries are being overexploited, and the current institutional structure in place to manage them is not working effectively. Presently, two sets of intergovernmental institutions oversee global fishing. The first comprises roughly three dozen regional fisheries management organizations (RFMOs), approximately 19 of which are charged with regulating fishing in the areas they oversee. The second set consists of global organizations that touch on but do not directly regulate fisheries issues, such as the United Nations Food and Agriculture Organization (FAO), the World Trade Organization (WTO), the World Bank, and the International Maritime Organization (IMO). In the course of the past calendar year the United States has been struck by a series of droughts, tornadoes, hurricanes, blizzards, wildfires, and floods whose size and path of resulting damage defy previously established patterns. The U.S. thus joins nations on every continent that have increasingly experienced extreme and extremely damaging weather events over the past two decades.

At the same time, the world’s oceans have been exhibiting a less-visible but equally dangerous sequence of temperature rise, acidification increase, fish kills, coastal erosion, salinity shifts, algae blooms, and steady decreases in commercially available fish and shellfish species.

This issue brief considers the role and nature of existing and potential international dispute resolution fora in relation to international environmental law. It addresses impediments at the international level, such as limited access to justice by non-state actors and the lack of technical and scientific capability. As a conceptual paper, it highlights two possible remedial options: an international environmental tribunal and an international environmental court.

Recent studies on environmental regimes suggest that important lessons and policy recommendations may be drawn from the functioning of the multilateral trading regime. This brief compares the needs and goals of the trade and environment regimes, and discusses how insights from over sixty years of experience of the multilateral trading system might provide ideas for redesigning the architecture of the international environmental regime. It further calls for a better dialogue and improved complementarities between the two fields in order to enhance coherence within international law.

The municipalities surrounding Boston Harbor are requesting that the Commonwealth of Massachusetts designate the waters of Boston Harbor as a No Discharge Area (NDA) pursuant to the Clean Water Act, Section 312(f)(3). An NDA is a body of water in which the discharge of vessel sewage, whether treated or not, is prohibited. The No Discharge Area would be called the Boston Harbor No Discharge Area.

While the waters of Boston Harbor are under the jurisdiction of a number of different municipalities, water quality issues affect the harbor as a whole. Past efforts to clean up the harbor have occurred across …
