A Dissent From The Miranda Dissents: Some Comments On The 'New' Fifth Amendment And The Old 'Voluntariness' Test, Yale Kamisar

Articles

F the several conferences and workshops (and many lunch conversations) on police interrogation and confessions in which I have participated this past summer3 are any indication, Miranda v. Arizona' has evoked much anger and spread much sorrow among judges, lawyers and professors. In the months and years ahead, such reaction is likely to be translated into microscopic analyses and relentless, probing criticism of the majority opinion. During this period of agonizing appraisal and reappraisal, I think it important that various assumptions and assertions in the dissenting opinions do not escape attention.

The Neo-Positivist Concept Of International Law, Anthony D'Amato Jan 1965

The Neo-Positivist Concept Of International Law, Anthony D'Amato

Faculty Working Papers

The question "Is international law really law?" has not proved troublesome, according to Hart, because "a trivial question about the meaning of words has been mistaken for a serious question about the nature of things." Hart defends international law in Bentham's terms as "sufficiently analogous" to municipal law. It is important to see in what way this analogy is viewed by Hart in order to determine whether the reasoning he offers is too high a price to pay for accepting a neo-positivist into the circle of those who hold that international law is really law.

Territorial Trademark Rights And The Antitrust Laws, Richard F. Dole Jan 1965

Territorial Trademark Rights And The Antitrust Laws, Richard F. Dole

Michigan Legal Studies Series

Trademarks are devises used by business men to distinguish their goods from those of others. The utility of trademarks to purchasers lies in the identification of different lines of merchandise by different trademarks. On the other hand, perhaps the greatest advantage of trademarks to business derives from the connotations associated with marks by skillful advertising. Legal protection of trademark rights thus has a dual aspect: preventing others from copying marks both guards the identification function of trademarks and maintains exclusive rights in the commercial value of trademarks created by advertising. A Senate committee described the hybrid nature of trademark protection …

Foreseeability In American And English Law, Harry G. Fuerst Jan 1965

Foreseeability In American And English Law, Harry G. Fuerst

Cleveland State Law Review

Foreseeability is "the ability to see or know in advance, hence, the reasonable anticipation that harm or injury is the likely result of acts or omissions." In order to determine culpable negligence and establish the right to recover for a wrong, there must be a sequence of events like concatenation, or a series of united events like the links of a chain, called proximate cause. The definition of proximate cause is, "that cause which in natural and continuous sequence, unbroken by any efficient intervening cause, produces the injury, and without which the result would not have occurred."

Soviet Tort Law: The New Principles Annotated, Whitmore Gray

Book Chapters

AT 2:20 A.M. ON MAY 1, 1962, while riding his bicycle along the Simferopol' Highway in the company of Baturin, Pronin fell and injured his shoulder. Leaving his bicycle with Pronin, Baturin went on foot to a nearby village to summon medical aid. Pronin waited for him for awhile, and then decided to go back to the village of Volosovo in a passing car. Seeing the Tula-Moscow bus coming, he ran onto the road and waved. The driver, Markelov, seeing Pronin run onto the road 50 feet ahead of the bus, swerved to the left, went into the left lane, …

Soviet Theory Of Jurisprudence, Francis G. Homan Jr.

Cleveland State Law Review

Any examination of Marxian theory and its embodiment in Soviet jurisprudence must first review its roots in Hegelian philosophy. Bolshevism, Fascism and National Socialism have all relied on Hegelian theory, with tremendous political impact on modern history.

Grand Jury Secrecy, Richard M. Calkins Jan 1965

Grand Jury Secrecy, Richard M. Calkins

Michigan Law Review

When a leading state such as Illinois enacts "reform" legislation, an impact on the legislatures of other jurisdictions may be anticipated. Accordingly, a need exists for an examination of this legislation in the light of the common-law background of grand jury secrecy and for a further analysis of it in the face of the growing trend toward more liberalized discovery of grand jury minutes in other jurisdictions. It is the contention of the author that such an empirical study will demonstrate that this legislation adopted by Illinois is contrary to all modern judicial thinking and is, in fact, a retrogressive …

Latin-American Land Reform: The Uses Of Confiscation, Kenneth L. Karst Dec 1964

Latin-American Land Reform: The Uses Of Confiscation, Kenneth L. Karst

Michigan Law Review

This article examines the legislative techniques for taking land, showing their confiscatory operation. For many lawyers, the analysis would then be easily completed: confiscation is wrongful and must be condemned. Rejecting the implicit absolutism of that conclusion, this article inquires into the justifications that can be pleaded on behalf of selective confiscation as an aid in solving some of Latin America's economic and social ills.

Group Legal Services: The Bench, The Bar, And The Brotherhood, Law Review Staff Oct 1964

Group Legal Services: The Bench, The Bar, And The Brotherhood, Law Review Staff

Vanderbilt Law Review

The bar has long sought to make legal services readily available to all persons whatever their situation. Thus, the bar has sponsored legal aid societies and lawyer referral systems, and has promoted neighborhood law offices. These methods all meet the bar's traditional individualistic view that the attorney-client relationship should be direct without any third party interference. However, the lay public, often bewildered by a myriad of unfamiliar names in the yellow pages, continues to seek means of securing legal services more cheaply, more efficiently, and more reliably. Group legal services--whereby an organized group procures legal services for its individual members--are …

The Role Of The American Bar Association In The Selection Of Federal Judges: Episodic Involvement To Institutionalized Power, Joel B. Grossman Jun 1964

The Role Of The American Bar Association In The Selection Of Federal Judges: Episodic Involvement To Institutionalized Power, Joel B. Grossman

Vanderbilt Law Review

One phenomenon of recent domestic politics has been the resurgence of the American Bar Association as a vital, and often influential, group in the political process as well as in the legal profession. There is no better characterization of this than the ABA's assumption of a lead position in a profession-wide campaign to improve the quality of judges selected for the several court systems in the United States. In a relatively short span of time, the ABA has grown from a group with a minimum of influence to one with a quasi-formal role in the federal selection process. Its success …

The Right To Vote And Its Implementation, Donald P. Kommers Jun 1964

The Right To Vote And Its Implementation, Donald P. Kommers

Journal Articles

The quest for political equality has been a major theme of American history. Indeed, since 1789, the American political system has undergone steady progress toward increasing democratization.' Slavery was abolished in 1865. The right to vote is no longer limited by restrictions based on property, race, color, or sex. Since 1913 United States senators have been elected by the people. Political equality is afforded to the citizens of each state through the equal protection and due process clauses of the fourteenth amendment. And the operation of the electoral college, originally intended to house a political elite, has been so modified …

A Reappraisal Of The Role Of Disclosure, Robert L. Knauss Feb 1964

A Reappraisal Of The Role Of Disclosure, Robert L. Knauss

Michigan Law Review

The objective of this paper is to assess the current role of disclosure in its various aspects in security regulation. Following a brief description of the current uses of disclosure in securities regulation, there are separate sections describing and evaluating (1) the obligation of disclosure imposed on issuers at the initial sale of securities, (2) the obligation of disclosure resting on issuers if they have securities which are traded, and (3) obligations of disclosure imposed on parties in the securities business other than issuers. This last section includes obligations of insiders, broker-dealers, and investment advisers, as well as duties of …
