From "Moral Stupidity" To Professional Responsibility, Thomas D. Eisele
Faculty Articles and Other Publications
Within the context-even, the challenge-presented by the first chapter of Seymour Wishman's book, Confessions of a Criminal Lawyer, we symposiasts have been invited to say something about the teaching of courses which in law school go under the titles, "Legal Ethics," "Professional Ethics," or "Professional Responsibility." This last is the
title of a two-credit course that I teach, in what I take to be a fairly traditional form, over the span of a semester at the University of Cincinnati. In this essay, I want to talk about the teaching of such a course; not about how I manage to teach …

Law Quadrangle (formerly Law Quad Notes)
In a special section coinciding with the International Reunion of Law School graduates, Law School graduates who are deeply involved in the globalization of legal practice respond to the question, "If you could leap ahead 10 years, how do you think what you are doing now will change?" And in a thought-provoking prologue, Professor of Law Jose Alvarez and Assistant Dean for International Programs Virginia A. Gordan consider the historical - and historic - impact of Law School graduates from overseas on the legal profession.

Making Traditional Courses More Inclusive: Confessions Of An African American Female Professor Who Attempted To Crash All The Barriers At Once, Angela Mae Kupenda
Journal Articles
"WE MUST DISMANTLE all barriers at once!"' "No, go slow!" These were two of the opposing cries heard during, the civil rights movement. Some thought the only way to eliminate exclusiveness, based on race and gender, was to dismantle all the barriers all at once. Others thought the costs of such change too great and urged for caution and patience. Even in the 1990s, barriers of exclusiveness continue to exist, even in the law school classroom. Here I share my story of how, as a beginning law school professor, I tried to bring change to the law school classroom. I …

Introduction To Law For Second-Year Students?, Alan Watson
Introduction To Law For Second-Year Students?, Alan Watson
Scholarly Works
The casebook method of teaching is, in fact, an exercise in futility. It is the students themselves who are expected to build up a picture of law from the few generally disconnected scraps available to them and with virtually no tools. Students are left to guess what the editors' view of the law is rather than getting to what the law is all about. Instead of looking at the reasoning of a case in the light of the developed conceptual thought that preceded it, and of its place in a structured web of reasoned principle, they are provided in the …

Mandatory Prelicensure Legal Internship: A Renewed Plea For Its Implementation In Light Of The Maccrate Report, Stephen R. Alton
Mandatory Prelicensure Legal Internship: A Renewed Plea For Its Implementation In Light Of The Maccrate Report, Stephen R. Alton
Faculty Scholarship
Since its publication in 1992, virtually everyone who has any opinion about American legal education has been talking about the Mac- Crate Report. Relatively few among this multitude seem actually to have read the report itself. The purpose of this essay is to present an overview of this thoughtful document, along with some thoughts of my own regarding its implications for the future of legal education, particularly its implications for a mandatory prelicensure legal internship.

Judicial Opinions As Binding Law And As Explanations For Judgments, Thomas W. Merrill
Judicial Opinions As Binding Law And As Explanations For Judgments, Thomas W. Merrill
Cardozo Law Review
To what extent does the executive branch have autonomous powers of legal interpretation? The issue is often broadly framed in terms of two disparate understandings of the allocation of interpretative power: "judicial supremacy" and "departmentalism." In this paper, I shall speak of two different understandings of judicial opinions: the idea that judicial opinions (or at least the "holdings" of opinions) are legally binding on actors in the executive branch, and the idea that opinions are, from the perspective of executive actors, merely explanations for judicial judgments. I adopt this locution because it focuses more precisely on the core of the …

After A Decade: "Theory As Practice" At The Center For Environmental Legal Studies, Nicholas A. Robinson
Elisabeth Haub School of Law Faculty Publications
A scholarly center, with an ethically premised mission to further the remedial objectives of Environmental Law: this conception inspired establishment of Pace's Center For Environmental Legal Studies in 19821 when Professor Donald W. Stever, Jr., joined me in launching this new focus through which the Pace University School of Law's Environmental Law Faculty could use their expertise to further, refine, and fashion environmental protection and the conservation of natural resources. In the Center's first decade, our Environmental Faculty managed to exceed our Center's imagined goals, and as the Center enters its march to the year 2002, we are rethinking our …
