The past year proved to be a busy period for the regulation of electronic payments and financial services. In this year’s survey, we discuss rulemakings, enforcement actions, and other litigation that has significantly impacted the law governing payments and financial services. Part II addresses the ongoing fight between federal and state authorities over which should properly regulate Fin- Tech entities and describes some new steps the Office of the Comptroller of the Currency (“OCC”) has taken to assert its authority in this area. Throughout most of 2020, state and local governments faced severe budget crises as a result of the COVID-19 pandemic. Increased demand for state welfare services and rising state expenses related to controlling the spread of COVID-19 stretched state and local budgets to their breaking points. At the same time, layoffs, business closures, and social distancing measures reduced states’ primary sources of tax revenues. Agreements not to compete are generally an anathema to free market advocates. Independent profit maximization is one of the fundamental assumptions of the neoclassical economic model and necessary to its conclusion that markets yield results that are Paraeto efficient. Consistent with this theory, and practical experience, agreements among competitors, or potential competitors, to divide a market, or fix price or quantity are per se violations under our antitrust laws.

American workers have left billions of dollars in 401(k) accounts that they may never be able to find. The problem affects low-wage workers the most, aggravating income-based retirement inequality. Workers who are laid off or change jobs often leave their 401(k) savings in a former employer’s plan. As time passes, communication breaks down between departed employees and their plans, and changes to the employer, plan provider, or individual accounts may prevent the worker from finding the account. International tax regimes (e.g., the “double taxation regime”) are created by states with competing tax jurisdiction to coordinate their tax rules and, specifically, to address common efficiency problems like international double taxation. In developing such regimes, states attempt to balance competing tax policy priorities: efficiency, administrability, and equity. This work engages with equity, as a policy norm of international tax (inter-national tax equity). It is my thesis that the framing/articulation of inter-national tax equity suffers from a narrative problem that, perhaps, stems from its apparent conceptual unclarity and multifarious usage. This Article analyzes how to challenge AAPI (Asian American Pacific Islander) hate—defined as explicit negative bias in racial beliefs towards AAPIs. In economics, beliefs are subjective probabilities over possible outcomes. Traditional neoclassical economics view beliefs as inputs to making decisions with more accurate beliefs having indirect, instrumental value by improving decision-making. This Article utilizes novel economic theories about belief-based utility, which economically captures the intuitive notion that people can derive pleasure and pain directly from their and other people's beliefs. เอกัตศึกษานี้มีวัตถุประสงค์เพื่อศึกษาแนวทางการกำหนดมาตรการทางภาษีเพื่อสนับสนุนการพัฒนาทักษะอาชีพในกรณีการกำหนดค่าลดหย่อนภาษีเงินได้บุคคลธรรมดาสำหรับค่าใช้จ่ายในการเรียนที่รวมถึงการเรียนรูปแบบออนไลน์ ผู้วิจัยทำการศึกษาด้วยวิธีการวิจัยทางเอกสาร โดยการศึกษา รวบรวมข้อมูลกฎหมาย รวมถึงข้อมูลทางด้านอื่น ๆ ที่เกี่ยวข้อง โดยเฉพาะที่เกี่ยวกับหลักเกณฑ์การให้สิทธิประโยชน์ทางภาษีเงินได้บุคคลธรรมดาในต่างประเทศเพื่อวัตถุประสงค์ดังกล่าว นำมาวิเคราะห์ปัญหา ข้อจำกัด และแนวทางในการประยุกต์หลักเกณฑ์ดังกล่าวกับบริบทประเทศไทย จากการศึกษามาตรการปัจจุบันของประเทศไทยพบว่า ประเทศไทยมีการสนับสนุนผ่านภาษีเงินได้นิติบุคคล โดยนายจ้างที่เป็นบริษัทจำกัดหรือห้างหุ้นส่วนนิติบุคคลสามารถนำค่าใช้จ่ายในการฝึกอบรมพนักงานมาหักลดหย่อนภาษีได้ แต่มาตรการดังกล่าวไม่เป็นไปตามหลักความเสมอภาคทางภาษีอากร และไม่สอดคล้องนิยามการพัฒนาฝีมือแรงงานตามพระราชบัญญัติส่งเสริมการพัฒนาฝีมือแรงงาน พ.ศ. 2545 ตลอดจนไม่สอดคล้องกับการเปลี่ยนแปลงทางสังคมและเทคโนโลยีในปัจจุบัน มาตรการที่มีอยู่จึงไม่มีประสิทธิภาพเพียงพอในการส่งเสริมพัฒนาทักษะอาชีพของแรงงานไทย ผู้วิจัยได้ทำการศึกษามาตรการทางภาษีเพื่อส่งเสริมการพัฒนาทักษะอาชีพในประเทศสหรัฐอเมริกา ประเทศแคนาดา และประเทศสิงคโปร์ พบว่าทั้ง 3 ประเทศให้การสนับสนุนผ่านภาษีเงินได้บุคคลธรรมดา มีการกำหนดหลักเกณฑ์ร่วมกันที่สำคัญคือมาตรฐานคุณภาพหลักสูตรที่เรียนและความสัมพันธ์ระหว่างหลักสูตรที่เรียนและอาชีพที่ผู้เสียภาษีประกอบ รวมไปถึงหลักเกณฑ์เฉพาะที่ยกมาวิเคราะห์ ได้แก่ การกำหนดช่วงอายุที่ได้รับสิทธิประโยชน์ทางภาษีของประเทศแคนาดา การอนุญาตให้ใช้ค่าใช้จ่ายในการเรียนเพื่อเปลี่ยนสาขาอาชีพภายในระยะเวลา 2 ปีของประเทศสิงคโปร์ และการกำหนดเพดานรายได้สุทธิสูงสุดที่สามารถใช้สิทธิประโยชน์ทางภาษีได้ของประเทศสหรัฐอเมริกา ซึ่งมีความสอดคล้องกับบริบทปัญหาและแนวโน้มการเปลี่ยนแปลงในสังคมปัจจุบัน ดังนั้น เพื่อสนับสนุนการพัฒนาทักษะอาชีพของแรงงานไทยอย่างมีประสิทธิภาพมากขึ้นกว่าในปัจจุบัน จึงควรเพิ่มเติมมาตรการทางภาษีเงินได้บุคคลธรรมดาโดยกำหนดเป็นค่าลดหย่อนภาษีเงินได้และจำเป็นต้องวางหลักเกณฑ์การควบคุมคุณภาพครอบคลุมไปถึงการเรียนรูปแบบออนไลน์ซึ่งเป็นรูปแบบที่เหมาะสมกับลักษณะการใช้ชีวิตของประชากรวัยทำงานในปัจจุบันด้วย ตลอดจนพิจารณาหลักเกณฑ์ตามสภาพสังคมในปัจจุบัน โดยพิจารณาต้นทุนทางเศรษฐศาสตร์และประโยชน์ของมาตรการเป็นสำคัญ

When Should Governments Invest More In Nudging? Revisiting Benartzi Et Al. (2017), Avishalom Tor, Jonathan Klick

Highly influential recent work by Benartzi et al. (2017) argues—using comparisons of effectiveness and costs—that behavioral interventions (or nudges) offer more cost-effective means than traditional regulatory instruments for changing individual behavior to achieve desirable policy goals. Based on this finding, these authors further conclude that governments and other organizations should increase their investments in nudging to supplement traditional interventions. This article examines the law and economics of behavioral regulation (“nudging”), which governments and organizations increasingly use to substitute for and complement traditional instruments. To advance its welfare-based assessment, Section 1 examines alternative nudging definitions and Section 2 considers competing nudges taxonomies. Section 3 describes the benefits of nudges and their regulatory appeal, while Section 4 considers their myriad costs—most notably the private costs they generate for their targets and other market participants. Section 5 then illustrates the assessment of public and private welfare nudges using cost-benefit analysis, cost-effectiveness analysis, and rationality-effects analysis.

Financial benchmarks estimate market values or reference rates used in a wide variety of contexts, but are often calculated from data generated by parties who have incentives to manipulate these benchmarks. Since the London Interbank Offered Rate (LIBOR) scandal in 2011, market participants, scholars, and regulators have scrutinized financial benchmarks and the ability of traders to manipulate them.

We study the impact on market welfare of manipulating transaction-based benchmarks in a simulated market environment. Our market consists of a single benchmark manipulator with external holdings dependent on the benchmark, and numerous background traders unaffected by the benchmark. We explore two …

Members of legislatures often do not have equal opportunities to participate in legislative negotiations. The lack of inclusiveness in legislative negotiations may result in suboptimal policy outcomes and undermine representative democracy. Legislatures face two categories of barriers to conducting inclusive negotiations: (1) the scope and complexity of legislative negotiations and (2) members' lack of incentives and capacity to engage in inclusive negotiations. Legislatures may be able to overcome these barriers by synthesizing and applying insights from agile project management, design thinking, collective intelligence, social choice theory, and interest-based negotiation. This article explores one of the foundational pillar theories of Law and Economics and specifically Public Choice Theory as espoused by Nobel Laureate James M. สินเชื่อมีผลต่อเสถียรภาพระบบการเงินของประเทศ ธนาคารแห่งประเทศไทยเป็นผู้มีอำนาจตามกฎหมายในการกำกับดูแลระบบการเงินและความมั่นคงของสถาบันการเงิน ในการเปลี่ยนแปลงเข้าสู่ตลาดการเงินดิจิทัลนั้น ได้สนับสนุนให้นำเทคโนโลยีมาใช้ในผลิตภัณฑ์และบริการทางการเงินอย่างแพร่หลายตามแผนยุทธศาสตร์ธปท. ฉบับพ.ศ.2563-2565 โดยธนาคารแห่งประเทศไทยได้อนุมัติให้ผู้ประกอบธุรกิจให้สินเชื่อสามารถปล่อยสินเชื่อส่วนบุคคลดิจิทัล (Digital Personal Loan) พร้อมทั้งออกประกาศฉบับที่ ธปท.ฝกส.(01) ว.977/2563 เรื่องหลักเกณฑ์ วิธีการและเงื่อนไขในการประกอบธุรกิจสินเชื่อส่วนบุคคลดิจิทัลไปยังสถาบันการเงินและผู้ประกอบธุรกิจสินเชื่อส่วนบุคคลภายใต้การกำกับที่มิใช่สถาบันการเงิน โดยมีวัตถุประสงค์เพื่อสนับสนุนให้ผู้บริโภคเข้าถึงบริการทางการเงินได้มากขึ้นและลดการพึ่งพาหนี้นอกระบบ อีกทั้งช่วยลดต้นทุนและความเสี่ยงในการประกอบธุรกิจให้แก่ผู้ให้ประกอบธุรกิจ การศึกษาวิจัยนี้ มีวัตถุประสงค์มุ่งเน้นศึกษาการควบคุมความเสี่ยงในตลาดสินเชื่อส่วนบุคคลดิจิทัลของประกาศธนาคารแห่งประเทศไทยฉบับที่ 977/2563 จากการศึกษาพบว่าประกาศฉบับดังกล่าวมีการควบคุมความเสี่ยงในการปล่อยสินเชื่อส่วนบุคคลดิจิทัลที่ไม่เพียงพอ ส่งผลกระทบต่อผู้บริโภคทางการเงินที่ใช้บริการสินเชื่อส่วนบุคคลดิจิทัล เนื่องจากมีการผ่อนปรนหลักเกณฑ์ที่มากเกินไปในส่วนของการประเมินความน่าเชื่อถือของผู้ขอสินเชื่อและเรื่องการกำหนดให้ใช้เฉพาะข้อมูลทางเลือก (Alternative Data) ดังนั้น เพื่อให้ผู้บริโภคทางการเงินที่ใช้บริการสินเชื่อส่วนบุคคลดิจิทัลได้รับความคุ้มครองมากขึ้น จึงควรมีการแก้ไขเนื้อหาของประกาศธนาคารแห่งประเทศไทยฉบับที่ 977/2563 ในส่วนที่มีการผ่อนปรนหลักเกณฑ์การให้สินเชื่อและการต้องใช้เฉพาะข้อมูลทางเลือก ให้มีการบริหารความเสี่ยงที่เข้มข้นขึ้นเพื่อมิให้ผู้บริโภคก่อหนี้เกินตัว โดยกำหนดให้การให้สินเชื่อแก่ผู้บริโภคบนพื้นฐานของการบริหารความเสี่ยงตามหลักการพิจารณาให้สินเชื่อที่คำนึงถึงสถานะทางการเงิน ภาระหนี้สิน หรือความสามารถในการชำระหนี้ของผู้บริโภคเป็นหลักร่วมกับการใช้ข้อมูลทางเลือก อีกทั้งควรเพิ่มแนวทางการคุ้มครองผู้บริโภคทางการเงินจากการถูกฉ้อโกงหรือหลอกลวงจากผู้ประกอบการสินเชื่อดิจิทัลนอกระบบด้วย

In 2017, Congress created the Opportunity Zone (“OZ”) program to stimulate economic growth in low-income communities. The program was characterized by its unprecedented scale relative to previous place-based development efforts and was described as “perhaps the most ambitious economic development tool to come out of Congress in a generation.” However, the program was quickly criticized on numerous grounds, and its design flaws are so severe that several legislators have called for its reform or repeal.

The “California Effect” is a recurring trope in discussions about regulatory interdependence. This effect predicts that businesses active in multiple jurisdictions sometimes adopt the strictest standards that they face in any jurisdiction globally, even if the law does not require global compliance. Although “fake news” is as old as mass media itself, concerns over disinformation have reached a fever pitch in our current media environment. Online media outlets’ heavy reliance on user-generated content has altered the traditional gatekeeping functions and professional standards associated with traditional news organizations. The idea of objectivity-focused informational content has primarily been substituted for a realist acceptance of the power and popularity of opinion-driven “news.” This shift is starkly visible now: mainstream news media outlets knowingly spread hoaxes, conspiracy theories, and the like.

รายงานเอกัตศึกษาฉบับนี้มีวัตถุประสงค์เพื่อศึกษาและวิเคราะห์ถึงปัญหาในการจัดเก็บภาษี เงินได้บุคคลธรรมดาและภาษีมูลค่าเพิ่มสำหรับโทเคนที่ไม่สามารถทดแทนกันได้ (NFT) ใน 4 ด้านหลัก ๆ ได้แก่ (1) การจัดประเภทเงินได้ (2) ค่าใช้จ่ายที่ถือเป็นรายจ่ายทางภาษี (3) หลักการจัดเก็บภาษีเงินได้ (4) การพิจารณาสถานะทางกฎหมายของ NFT ภายใต้กฎหมายภาษีีมูลค่าเพิ่ม โดยได้ทำการศึกษาเปรียบเทียบกับกฎหมายประเทศสหรัฐอเมริกาและประเทศออสเตรเลีย เพื่อนำมาวิเคราะห์และหาข้อเสนอแนะในการกำหนดแนวทางการจัดเก็บภาษีข้างต้นให้เหมาะสมกับประเทศไทยต่อไป สำหรับประเทศไทยพบว่า กรณีที่ NFT ไม่เข้าลักษณะตามคำนิยาม พ.ร.ก. สินทรัพย์ดิจิทัลฯและมีเงินได้จากการซื้อขาย NFT ดังกล่าว ไม่ว่าจะเป็นเงินได้ฝั่งผู้สร้าง NFT หรือนักลงทุน ถือเป็นเงินได้พึงประเมินตามมาตรา 40 (8) โดยสามารถหักค่าใช้จ่ายที่เกิดขึ้นตามความจำเป็นและสมควร ในขณะที่ผลประโยชน์ที่ได้รับจากการโอนคริปโทเคอร์เรนซีขณะทำธุรกรรมซื้อขาย NFT ถือเป็นเงินได้ตามมาตรา 40 (4) (ฌ) ส่วนหลักการจัดเก็บภาษีเงินได้สำหรับ NFT ถือว่าเป็นแหล่งเงินได้ในประเทศไทยหรือในต่างประเทศให้ใช้หลักพิจารณาจาก Wallet ที่ใช้ในการซื้อขาย NFT อีกทั้งการพิิจารณาสถานะทางกฎหมายของ NFT ภายใต้กฎหมายภาษีมูลค่าเพิ่ม สรุปได้ว่า NFT เข้าลักษณะเป็นสินค้าอยู่ในบังคับต้องเสียภาษีมูลค่าเพิ่ม อย่างไรก็ตาม ยังไม่ได้มีการกำหนดแนวทางในการจัดเก็บภาษีมูลค่าเพิ่มไว้อย่างชัดเจน ทั้งนี้ จากการศึกษาแนวทางการจัดเก็บภาษีเงินได้บุคคลธรรมดาเกี่ยวกับ NFT ในประเทศสหรัฐอเมริกาและประเทศออสเตรเลียพบว่า แนวทางการจัดเก็บภาษี NFT นั้นเหมือนกับแนวทางการจัดเก็บภาษีในสินทรัพย์ดิจิทัลอื่น ๆ จึงส่งผลให้เกิดแตกต่างกับประเทศไทย เนื่องจากประเทศสหรัฐอเมริกาและประเทศออสเตรเลียมองว่า เงินได้ที่เกิดจากการซื้อขาย NFT ของนักลงทุนควรเสียภาษีจากส่วนเกินทุน (Capital Gain) แทนเงินได้ปกติ (Ordinary Income) และกรณีในส่วนของการพิจารณาหลักการจัดเก็บภาษีเงินได้จากการซื้อขาย NFT จะมุ่งพิจารณาถิ่นที่อยู่หรือสัญชาติของผู้มีหน้าที่เสียภาษีเป็นสำคัญ นอกจากนี้ แนวทางการจัดเก็บภาษีมูลค่าเพิ่มของ NFT ทั้ง 2 ประเทศนั้นมีแนวทางให้ NFT อยู่ภายใต้บังคับการเสียภาษีมูลค่าเพิ่มเหมือนเช่นกับประเทศไทย แต่จะมีการกำหนดหน้าที่และวิธีการในการจัดเก็บภาษีมูลค่าเพิ่มไว้อย่างชัดเจน โดยให้ NFT Marketplace ทำการหน้าที่จัดเก็บภาษีขายหรือภาษีสินค้าและบริการและนำส่งให้แก่ภาครัฐ ดังนั้น ประเทศไทยจึงควรนำหลักการทางภาษีที่มีแนวทางอย่างชัดเจนในต่างประเทศมาปรับใช้ให้เกิดความเหมาะสมต่อไป

แนวทางการกำหนดมาตรการเรื่องการนำสัตว์เลี้ยงเข้าใช้บริการในร้านอาหาร, โญดา ลิขิตเจริญนุกูล

การประกอบกิจการร้านอาหารที่อนุญาตให้นำสัตว์เลี้ยงเข้าร้านอาหารด้วย พบว่าเป็นค่านิยมใหม่ในปัจจุบันเป็นอย่างมาก ซึ่งเป็นที่มาจากพฤติกรรม Pet Humanization คือ การเลี้ยงดูสัตว์เลี้ยงเสมือนลูก และจะให้ความสำคัญต่อสัตว์เลี้ยงค่อนข้างสูง อยากให้สัตว์เลี้ยงของตนมีคุณภาพชีวิตที่ดีและมีความสุขเพิ่มขึ้น รวมถึงการพาออกไปเที่ยวเล่นนอกบ้าน ซึ่งไม่ใช่แค่เพียงสวนสาธารณะเท่านั้น แต่ยังรวมถึงห้างสรรพสินค้า หรือการพาเข้าร้านอาหารต่าง ๆ ด้วย กฎหมายที่เกี่ยวข้องกับการจัดการผู้ประกอบการร้านอาหารเกี่ยวกับ การพาสัตว์เลี้ยงเข้าร้านอาหารในไทย พบว่ามีกฎหมายที่มีความเกี่ยวข้องอยู่หลายฉบับ แต่ส่วนใหญ่ในกฎหมายไทยจะบัญญัติไว้ในทางอ้อม ไม่ได้กล่าวถึงการห้ามเข้าโดยตรง เช่น ใน พระราชบัญญัติอาหาร พ.ศ. 2522 นั้นกำหนดเพียงว่าให้ผู้ประกอบธุรกิจอาหารต้องประกอบอาหารให้บริสุทธิ์ ซึ่งได้ให้ความหมายไว้ใน มาตรา 26 แห่งพระราชบัญญัติอาหาร พ.ศ. 2522 ผู้ประกอบการอาจต้องตีความในกฎหมายเองต่อไปว่า ในการจะทำให้อาหารบริสุทธิ์เข้าข่ายตามคำนิยามที่กำหนดไว้ จะต้องปฏิบัติตนอย่างไร ให้ถูกต้องตามคำนิยาม คำนิยามหนึ่งที่ว่าอาหารไม่บริสุทธิ์ คืออาหารที่ได้ผลิต บรรจุหรือเก็บรักษาไว้โดยไม่ถูกสุขลักษณะ ผู้ประกอบการจะต้องเล็งเห็นแล้วว่า ในการที่อนุญาตให้นำสัตว์เลี้ยงเข้ามาร่วมใช้บริการในร้านอาหารนั้น อาจจะทำให้ขนของสัตว์ที่สามารถหลุด และปลิวมาปนเปื้อนในจานอาหารที่กำลังจะนำไปเสิร์ฟ หรือปนเปื้อนไปในครัวที่กำลังเตรียมอาหารอยู่ได้ และเมื่อผู้บริโภคอาหารเหล่านั้นไปแล้วส่งผลให้อาจจะเกิดอันตราย ถึงขั้นแก่ชีวิต หรือสัตว์เลี้ยงอาจจะก่อความรำคาญให้แก่ผู้ที่อยู่ภายใต้ร้านอาหารเดียวกันได้ หรือในอีกกฎหมายที่เกี่ยวข้องอีกฉบับหนึ่งคือ พระราชบัญญัติการสาธารณสุข พ.ศ. 2535 จะมีเนื้อหาส่วนที่เกี่ยวข้องกับสัตว์หรือสัตว์เลี้ยงซึ่งได้บัญญัติไว้ใน หมวดที่ 5 เรื่องเหตุรำคาญ (2) การเลี้ยงสัตว์ในที่หรือโดยวิธีใด หรือมีจำนวนเกินสมควรจนเป็นเหตุให้เสื่อมหรืออาจเป็นอันตรายต่อสุขภาพ นั้นให้ถือว่าเป็นเหตุรำคาญอย่างหนึ่ง ซึ่งเมื่อผู้เขียนพิจารณาจากบทบัญญัติข้างต้นแล้ว ในเรื่องของเหตุรำคาญเกี่ยวกับสัตว์เลี้ยงนี้อาจมีความเกี่ยวข้องการเรื่องการนำสัตว์เลี้ยงเข้าไปใช้บริการในร้านอาหารโดยตรง เนื่องจากการเลี้ยงสัตว์ที่เกินจำนวนสมควร อาจก่อให้เกิดเหตุรำคาญต่าง ๆต่อผู้คนอื่น ๆที่ใช้บริการในร้านอาหาร เนื่องจากผู้เลี้ยงไม่สามารถดูแลสัตว์เลี้ยงของตนได้อย่างทั่วถึง และหมวดที่ 6 เรื่องการควบคุมการเลี้ยงหรือปล่อยสัตว์ มีการกล่าวถึงเรื่องการควบคุมสัตว์เลี้ยงหรือการปล่อยสัตว์เลี้ยงในพื้นที่สาธารณะ โดยมีหลักการสำคัญคือเพื่อรักษาสภาพความเป็นอยู่ในชุมชนให้เหมาะสมต่อการดำรงชีวิตของผู้คน รวมถึงเพื่อป้องกันโรคระบาดที่อาจติดต่อจากสัตว์สู่สัตว์หรือสัตว์สู่คนได้ ดังนั้นเจ้าของสัตว์เลี้ยงจึงจำเป็นต้องปฏิบัติตามอย่างเคร่งครัดเพื่อควบคุมสัตว์เลี้ยงของตนไม่ให้สร้างความเดือดร้อน รวมถึงควบคุมดูแลสัตว์เลี้ยงไม่ให้อยู่ในสภาวะที่สามารถนำเชื้อโรคมาติดต่อผู้คนในสังคมได้ดังนั้นเจ้าของสัตว์เลี้ยงจึงจำเป็นต้องปฏิบัติตามอย่างเคร่งครัดเพื่อควบคุมสัตว์เลี้ยงของตนไม่ให้สร้างความเดือดร้อน รวมถึงควบคุมดูแลสัตว์เลี้ยงไม่ให้อยู่ในสภาวะที่สามารถนำเชื้อโรคมาติดต่อผู้คนในสังคมได้ ในการวิจัยครั้งนี้ จึงเห็นสมควรศึกษาถึงปัญหา และข้อบกพร่องของกฎหมายไทย ซึ่งแสดงให้เห็นว่าการบังคับใช้กฎหมาย บทลงโทษ รวมถึงหน่วยงานของรัฐที่มีอำนาจ ที่มีอยู่ ณ ปัจจุบันไม่สามารถที่จะเข้ามาจัดการผู้ประกอบการร้านอาหารที่อนุญาตให้นำสัตว์เลี้ยงเข้าร้านอาหารได้อย่างเด็ดขาด โดยตรงและเต็มประสิทธิภาพแต่อย่างใด เนื่องจากยังขาดกฎหมายหรือมาตรการที่ให้อำนาจในการเข้ามาจัดการ และควบคุม ดังนั้นควรจะมีการกำหนดมาตรการที่เกี่ยวข้องโดยตรงอย่างชัดเจน รวมถึงอาจจะมีการจัดตั้งหน่วยที่รับผิดชอบขึ้นมาใหม่ เพื่อกำกับดูแลผู้ประกอบการให้ปฏิบัติตามอย่างเคร่งครัด รวมถึงมีบทลงโทษในสำหรับผู้ที่ไม่ปฏิบัติตามด้วย
